Chief Hydie read a memorandum which reviewed the truck ord_nance,and the weight limits allowed. He reported on the' cumber c.d. `violations, and said there had been relatively few corn - plaints' to the Police Department. He then ans•?veree questions from. the' Council.. Mrs. Herbert Rapp., 2410 Bryant Street„ said she had made a truck survey fromthe couch of her living zoom and read a statement which is o i file in .he office of the:.City Clerk. In surramation she said she felt the truck ordinance was not being enforced. Florence Turner, 370 Colorado, speaking for the residents of Colo- rado Avenue -in the area between Alma and M'ddlef eld, expressed their concern about the increased truck traffic: on Colorado and said they had three problerns: (1) the curfew ordinance on Oregon Express- way.foWced trucks to use Colorado during the night and she regeested that the ordinance be amended. to allow trucks on Oregon 24 hours a day; (2) that trucks of more than 7 tons are forbidden by ordinance but this is not being enforced; and (3) that Colorado is a narrow, resi- dential street not b il* to carry the heavy trucks that are forced to use. it to get to Charleston Avenue markets as well as Midtown stores. Mrs. Ethel Anderson, 360 Colorado Avenue, spoke of the arrange- ments made by the. stores with the trucking companies so that goods can be delivered in the night and stated that some stores receive de- liveries every night prior to 7 a. m. Councilman Beahrs moved, any] it was duly seconded, that it be the sense of the Council that administrative officers of the City give this situation study and see if the problem could be better controlled by larger staffing of the Police Department. Councilman Rus moved an amendment t':1at the staff not only study the problem of Police Department staffing tut also make a. complete study of the traffic problem, including a study of the truck ordinance, the recommendations of the committee on truck traffic. and report back as soon as possible. Councilman Beahrs accepted this amendment as part of his original motion. After farther discussion, Councilman Rodgers moved the previous question, seconded by Byxbee. The motion carried on a two-thirds show -of -hands vote. The Beahrs motion then carried unanimously on. a voice vote. In the discussion that followed, Councilman Flint was ruled out of order. When Flint appealed the decision of the Chair, the Chair's ruling was sustained on the following roll call vote: Ayes: Arbuckle, Arnold, Beahrs, Byxbee, Cooley, Dias, Porter, Rodgers, Rohrs, Rus, Woodward, Zweng. Area The 'Council :had received a letter dated April 12 from the Local Agency Formation Commission notifying them they had considered various letters; from residents '',of:.the Monroe Park Area, some of whom favored annexation to Mountairi View and some of whom favored annexation to Palo Alto. After; discussion, the Commission unanimously approved a motion that its'; proper action was to urge the cities of Palo Alto and Mountain Vie.v to :meet. and arrive at a boundary agreement, and to re- quest -that they keep the Local Agency Formation Commission advised. The City Manager pointed to a map displayed on the wall which depited the area and. noted that the 4+cundaries were agreed upon in 1960. No action was required by the Council at this time. (Councilman Porter left the .meeting at this time and did not return. Councilman Rohrs left the meeting at this time and returned after the recess.) Bowen complaining about the posted speed limit of 25 miles per hour along certain sections of, Middlefield Road which are four traffic lanes wide and requesting that the speed limit be raised. Santa Clara FiO d Control -.District Councilman Debs moved that the Council ask the Flood Control District and the .Board.`of. Supervisors for their ideas and the work they have ,.done on flood control for the remainder of the creeks trarsversir,g Palo Alto.' Duck Pond' Councilman Flint ir,.dn<;ated he. did not approve the landscaping which had been done recently around'the duck pond. The City Engineer de- scribed the'recent work and. the. City. Manager pointed out that a map had been on; display at several recent meetings which also depicted. the. improvements. Councilman Flint moved that the plans for the duck pond be brought back before the C,'ouncJ..ands placed on the May 24 agenda. Road'abuut-the City's overhead power and communication lines on his property," whereas the City had required him to connect his lines underground on the two new buildings to be constructed on his property. Paul McCloskey, Jr. , 8.0.1 Welch Road, representing Dr. Sullivan, requested that the City either remove the overhead lines and place their lines underground, or allow his client to connect to the over- head lines: After further clarification of the situation with the City Attorney and ' the City Engineer, Councilman Zweng moved that the staff be requested to file with the Council, at their earliest convenience, a report on the matter with legal iniplications` and with engineering ramifications set forth on how temporary the City's lines might be. The motion !carried unanimously on a voice vote. Barron Cab Company: The Council received an application dated April 26 from Sanford H. Sanger., President of CABS UNLIMITED, INC, , doing business as Barron Cab Company, which requesters four additional cabs under its Certificate of Public''Convenience and Necessity. On motion of Comstock, seconded by. Dias, and carried unanimously, the Council set May 2A, 1965 as the date for the public hearing and referred the natter- to the staff for study. Annexation A:rastradero Hills The Councilreceived an application for annexation of uninhabited ter- ritory which had previously been approved by the Boundary Commis- sion of the County and also considered and approved by the Local 340. 5/10/65 Ager_cy. Palo Alto Human.; Relations Council The Council• received a"letter dated May 1 from the Mid -Peninsula Congress of Racial Equality which requested permission to speak about the Palo Alto Human, Relations`Counc;il. Mr. Henry P. Organ; Chairman of the Ennp1oyment Committee of MPCORE, read the state- ment which had been transrni:tted to the Council and which re-empha-` sated the points preserited`to the Council April 26, 1965. The Counc 1 'had received:a .letter dated May 10 from the Catholic Interracial Council. congratulating'them on establishing the Palo Alto_ Human Relations Council and endorsing the suggestions of CORE. Councilman :Zweng Chen read his statement to the Council dated May _4, 1965, which-deitneatedthe qualifications he believed desirable in the five citizens who -swill be appointed` to the Palo Alto Human Relations Council.
