The minutes of December 28, lc?64, were approved as distributed.

Mayor Woodward asked'Councilma.n Rohrs, inasmuch as he
chaired. the meeting of the. Committee of the Whole, to report
on tht Committee's recommendation'. Councilman Rohrs intro_
duced a resolution entitled "Resolution of the Council of the City
of Pa o Alto Appropriating Funds for Equipment and the Activation
o the Pala Attu Hospital and Authorizing Inter fund Loan" and moved,.
seco-:ciee by Ru.s, that the Council approve the request of the Hasp:-
tal.Bc:ard foi activatior,and equipment funds in the amount of
$361, 000, to complete the opening and renovation of the old Palo
Alto Hospital.
Councilman Flint moved an amendment, seconded by Debs, to defog'
$138,000, which wzs working capital comprised of start-up salaries,
operating cash requirements and i'niti;tl supplies. After Counc:i.1
man 13yxbee commented on his re -study of the request and of the
Hospital's profits, Councilman Flint, with the permission of his

Councilman Byxbee moved a substitute motion, which was duly

Mayor Woodward referred to the letter from George A. Ditz, Jr.,
which had been sent to the Council opposing the application; and
also noted that Fire Chief Merriam was available to answer
questions as requested by the Council.
tv Manager Keithiey read a report dated January 7, 1965, which
had been scant. to tiie Council, advising thorn of the major con-
c:tions :tnd requirements which the Fire Department believed
essecitial prer-equisite's to the granting of a use permit for the
operation of a private day` school. He noted that the ;applicant had
selected a site f;i.r from City Utilities!,, that .it would cost thousands
u: cdc.iil, rs to provide utilities to the l:ircposed. school site; that it
. City policy to require the appiicar : to o provide these utilities
in accordance with existing City code.ls and ordinances; that the
proposed improvement project had nc,t yet been approved by the
Cu,r.ci1; and that until it was approved, it was long -:standing, City
pi,i:cy that the services be paid by the person requesting them.
Councilman Porter moved, seconded by Beahrs, tha'7 the Council

The C::ty Manager and the Fire -Chief ;.answered questions from the
Council • Counci.lman Zweng suggested Porter reword his motion
state -that the, :Council grant the use permit subject to the
various restrictions•placed upon this issuance by the Planning
Commission. Councilman Porter and Beahrs agreed to this re-
statement of the -motion:
Bennett B. Kilpack cited statistics on the sewer requirements for -
schools vs. residences; commented on the Ditz letter and on the
phrase "charac,ter of the area" which had been used by the

,Abandoned Easements
Assistant City ManagerMorgan directed the Council's attention
`,o a wall map depicting the two properties on Los Robles Road
which was the subject of a letter from Title Insurance and Trust
Compa.riy in the Fall of 1964 ` and'' said that the property owner
had now written and requestedrequested ,abanclonrnent of the other easement.
It was moved, seconded and carried unanimously that the Council
approve the abandonment of.the easement.
Claire for Damage{ILS.aI,Iey}
City Attorney Michalski reported he had reviewed the claim, of
Leola:M. Malley of 531 Sequoia Avenue, Redwood City, in the
amount of $51, 575, for personal injuries suffered while she was
a patient at the Palo Alto -Stanford Hospital Center on September 2,
1964: and he had concluded from his investigation that the claim
was not -a proper charge against the City. He, therefore, recom-
mended that the, claim be denied in its entirety.
After discussion, ;;t was moved, seconded and carried unanimously
that the Council reject the claim in its entirety.
Claim for Damage (Palmieri)
The City Attorney reviewed, the claim for damage in the amount' of
$28'.00 filed by Frederick W. Palmieri of 420 James Road, Palo
Alto, because of an alleged'stoppage in the City sewer system on
Septernber 4, 1964,, at the James Road address. He reported that
staff investigation had shown that the stoppage occurred in a private
sewer; that there was no liability on the part of the City, and he
recommended that the: claim be denied in its entirety.
Vice Mayor Arnold moved, and it was duly seconded and carried
unanimously, that the Council reject the claim in its entirety.
