October 10, 1966
The Council of the City of Palo Alto met in an adjourned meeting from
October 3, 1966, on this date at 7:30 p.m. with Mayor Dias presiding.
Present: Arnold, Beahrs, Comstock, Cooley, Debs, Dias,
Flint, Peaeson, Rohrm, Rus, Sher, Worthington.
Absent: Woodward (arrived 7:40 p.m.)
South Palo Alto Neighborhood Park
Mayor Dias asked the Clerk to read the following motion remaining
before the Council from the meeting of October 3:
"Motion of Councilman Sher. aec :tided by Comstock, to accept
the low bid for construction of South Palo Alto Neighborhood
Park.'°
City Manager Morgan referred to his report of October 5 and recom-
mended that if the bid is approved, the Council obtain the necessary
funds from the unappropriated balance of the Capital improvement
Fund.
Mr. Cole Richmond, 260 Chestnut Street, Palo Alto; Mr. Drew P.
Lawrence, 3925 Nelson, Palo Alto; and Mrs. Raleigh Brashear,

the park.
The motion carried unanimously.

Councilman Flint moved an amendment that in Section 1 following
"$63,000" the words be deleted and "and that the Contingency Fund
of the General Fund be correspondingly decreased" be substituted
for the deleted words. The motion failed for lick of a second.
Discussion followed conc.jrning procedure sirkce the motion to adopt
the ordinance •which was before the Council was almost identical to
a previous motion made on October 3 which had failed. Councilman
Rohr' then withdrew • his motion.
Councilman Arnold moved, seconded by Cooley, to reconsider the
motion made previously. The motion to reconsider carried unanimously.

Councilman. Debs then introduced, seconded by Beahrs, the following
ordinance and moved its adoption:
Ordinance No. 2319 entitled "Ordinance of the Council of the
City of Palo Alto Amending the Budget for the Fiscal Year
1966-1967 to Make an ' Additional Appropriation for Improve-
ment of South Palo Alto Neighborhood Park, Project 65-13."
The motion carried on the following unanimous roll call vote:
Ayes: Arnold, Beahrs, Comstock, Cooley, Debs, Dias,
r lint, Pearson, Rohrs, Rus, Sher, Woodward,
Worthington.
Noes: None.
Electric Substation Expansion
City Manager Morgan read his report of September 22 concerning
the electric substation expansion requirements and proposed appro-
priation ordinance and contract with Hewlett-Packard Corporation.
Discussion followed concerning the need for expansion, and Mr.
Morgan introduced Mr. E. A. Heath, Chief Engineer of the Light
and Power Department, who replied to questions from the Council
concerning technical details of the proposed expansion of facilities.
Councilman Rus introduced the following ordinance and moved its
adoption:

Council of the City of Palo Alto Amending the Budget for Fiscal
Year 1966-1967 to Make an Additional Appropriation for Pur-

Following further questioning of Mr. Heath, the motion to refer
failed on the following roll call vote:

Noes: Arnold, Beahrs, Cooley, Dias, Rohrs, Rus,
Woodward.
The motion to adopt the ordinance was seconded by Councilman
Beahrs and -arried on the following roll call vote:
Ayes; Arnold, Beahrs, Comstock, Cooley, Dias,. Pearson,
Rohrs, Rue, Sher, Woodward.

Councilman Arnold moved, seconded by Cooley, to authorize the
Mayor to execute the contract with Hewlett-Packard Corporation on
behalf of the City. The motion carried on the following 12-1 roll
call vote:
Ayes: Arnold, Beahrs, Comstock, Cooley, Debs, Dias,
Pearson, Rohrs, Rus, Sher, Woodward; Worthington.
Noes: Flint.
Cooncilaaan Debs requested his vote be changed to "no", making
the vote 11-2.
Alma Street Traffic - Orrin and Destination Study
City Manager Morgan 'read his report of September 22 concerning
the methodology and costs of conducting various types of origin and
destination studies on Alma Street.
Councilman Arnold moved, seconded by Beahrs, that the staff be
authorized to implement recommendations nos. 1 and 2 in the letter
of September 20, 1966 from DeLeuw, Lather & Company.
Councilman Rus mo.ed to include recommendations 3 and 4 also.
The rnotio:, failed for lack of a second.

Discussion followed as to the objective of the study and the extent
to which it might be expanded and the costs involved.
Councilman Pearson moved, seconded by Debs, a substitute motion
that the Council request the Board of Supervisors to direct the
Director of Public Works to conduct the study as outlined in the
DeLeuw, Gather & Company letter.

The motion to implement the recommendations of the traffic con-
sultant then failed on the following roll call vote:

Worthington.

Middlefield/Oregon and

City Manager Morgan referred to his report of September 18 attach-
ing the report made by the City to the City -School Traffic Committee
which has now beeti reviewed by that Committee.
Councilman Comstock moved, and it was duly seconded, that the
Middlefield/Oregon intersection have its signalization revised to
provide split phase signals on Middlefield and to include a green
left -turn ari 0 w.
Following discussion concerning inclusion of green arrowleft-turn
indicators and the effects of deferred and advance green signals for
left turns, Councilman Comstock withdrew his motion and moved to
refer the subject to the Planning and Procedures Committee.
The notion to refer was duly seconded and carried on unanimous
voice vote.
Councilman Comstock moved, and it was duly seconded, that three-
phase signalization be scheduled at Embarcadero/Middlefield a�
not,!rl on the wall charts before the Council and that signalization
include coordination between pedestrian and traffic movements on
Middlefield.
The :notion carried on unanimous 'c.ice vote.

Annual Meeting - Palo Alto -Stanford Hospital Center

Assistant City Attorney Hildebrand stated that the by-laws of the
Palo Alto -Stanford Hospital have stated that the annual meeting of
members shall be held .,_r_- L n
.� ax_ ,�.ane, but that this practice has been
waived recently as it has been found a fall meeting is preferable.
For this reason a change in the by-laws to reflect what is actual
practice has been recommended. He stated that upon his advice,
Mayor Dias had voted for this change at the recent owners meeting,
and that her action should be ratified by the Council at this time.
Councilman Arnold moved, seconded by Beahrs, to ratify the action
of the Mayor taken at the annual meeting in connection with the change
of the annual meeting date to the first Wednesday of October.
The motion carried on unanimous voice vote.
Claim for Damages - Robert E. Krebs
Assistant City Attorney Hildebrand referred to City Attorney
Michalski's letter of September 19 reporting on the claim against
the City of Robert E. Krebs in the amount of $200+. He stated that

because 45 days have elapsed since the filing of the claim, the
claim is deemed denied by operation of law, so no Council action
is necessary.
Written communications
Letter re Downtown Library: Councilman Pearson moved,
seconded by Comstock, to file the undated letter from Major
Donald L. Nichols regarding possible inclusion of a dowatow-n
library in the plans for a downtown Civic Center. The :notion
carried on majority voice vote.
Letter rep Park Boulevard Traffic Control: Councilman Com-
stock moved, seconded by Sher, to file the letter of August 24,
1966 from Chandler Flinkinger regarding Park Boulevard traf-
fic control. The motion carried on a unanimous voice vote.
Letter re Noise and Nuisance Created by Dogs: Councilman
Rus moved, seconded by Cooley, to file the letter from Arthur
Graham of August 15, 1966 regarding the noise and nuisance
created by dogs. The motion carried on unanimous voice vote.
Letter re Park Boulevard Traffic Circulation: Councilman
Cooley moved, seconded by Beahrs, to file the letter of Au-
gust 8, 1966 from Mike Golick regarding Park Boulevard traffic
circulation. The motion carried unanirnotssIy on voice vote.

moved, and it was duly seconded, that the Mayor be instructed
to reply to Mr. and Mrs. John A. Maloney regarding their letter
of August 23, 1966 referring to improvements on Alma Street to
the effect that the City has no intention of tearing down houses
on Alma, or even to make an origin and destination study of =

Letter re United Fund of Santa Clara County: Mayor Dias moved,
and it was duly seconded, to refer the letter of September 1, 1966
from the Santa Clara County United Fund regading their acting
as a "clearing house's for charitable solicitation information to
the Planning and Procedures Committee. The motion carried
on unanimous voice vote.
Letter re Field Act: Councilman Cooley moved, seconded by
Beahrs, to refer the letter and copy of the resolution referring to
the Field Act received from the City of Maria, California, to the
City -School Liaison Committee for possible action. The motion,
carried unanimously on voice vote.
Downtown Civic Center Exterior Design
Councilman Flint moved, seconded by Comstock, that his letter of
August 18, 1966 regarding the modification of the exterior archi-

tectural design of the Downtown Civic Center be referred to the
Public Works Committee. The motion carried on a majority voice
vote.
'Theatre Consultant
Councilman Pearson moved, seconded by Flint, that a professional
theatre consultant be hired to study and make recommendations for
improvement and upgrading of the Community Theatre to met es-
tablished and accepted standards.
The condition of the Community Theatre was discussed, and it was
brought out in d ecussion that consultants had been hired in con-
nection with lighting and sound equipment and both major and minor
repairs have been made in the past few years.
The motion failed on the following roll call vote:
Ayes: Comstock, Debs, Flint, Pearson, Sher, Worthington.
Noes: Arnold, Beahrs, Cooley, Dias, 4 ;rs, Rus, Woodward.
Junior Museum
Councilman Debs asked, as a point of information, the status of the
report on the Junior Museum. City Manager Morgan replied that
proposals had been invited from architects and are due prior to
November 1, but that about 25 have been re,'eived so far. He stated
that his report will be made early in November.
Storm Drairra 'scilities
Councilman Sher moved, seconded by Comstock, to approve the
agreement for engineering ev;.rvices design for storm drainage im-
provements for the City of Palo Alto.
City Manager Morgan introduced Mr. Lyle Hoag of Brown and
Caldwell who was present to answer queries from the Council in
connection with details of the proposed pumping station.
(Councilman Woodward left the Council Chamber at 10:25 p.m.
and did not return.
(Councilman Rus left the Council Chambers at 10:26 p.m.)
Councilman Rohr. moved, seconded by Cooley, to delete "art
auxiliary engine drive system" in line 2 on page 2 of the. agreement
aid substitute ":mobile diesel electric system", and to change the
amount in the last line of Section 3 from "$77, 000" to "$69, 000."
Councilman Rohrs later offered to change the figure to $71. 000,
but City Manager Morgan stated that $69, 000 did not have to be
changed as costs will not exceed the actual costs of time and material.

The amendment carried on the following roll call vote.
Ayes: Arnold, Beahrs, Cooley, Dias, Flint, Rohrs,
Worthington.
Noes: Cornstock, Debs, Pearson, Sher.
(Councilman Rus returned to Chambers at 10:40 p.m.)
The amended motion to approve the agreement carried on the
following roll call vote:
Ayes: Arnold, Beaters.. Comstock, Cooley. Debs, Dias,
Pearson, Rohrs, Rus, Sher, Worthington.
Noes: Flint.
Changes in Council Chamber
Councilman Cooley moved, seconded by Rohrs, to remove the
barrier in the Council Chambers between the audience and the
Council and staff and to place the podium used by the public on the
west side of the Chambers, and to provide two ventilation fans for
the Chambers. Councilman Arnold asked to vote on each part of
the 'notion separately.
Mayor Dias ruled the motion -oald be considered in separate parts.
The motion to remove the barrier failed on majority voice vote.
Mayor Dias then stated the matter of moving the podium was before
the Council. Councilman Cooley stated he had intended to include
the podium position with the removal of the barrier. Mayor Dias
then ruled another vote would.be taken including both the removal
of the barrier and the move?:rent of the podium. The motion fovea
on the iollowiag roll call vote:
Ayes: Comstock, Cooley, Flint, Rohrs.
Noes: Arnold, Beahrs, Debs, Dias, Pearson, Rus, Sher,
Worthington.
Mayor Dias then asked the Council to vote on the .?past of the motion
referring to the two exhaust fans. The motion failed on the follow-
ing de vote:
Ayee: Arnold, Comstock, Cooley, Flint, Pearson, Rohrs,
Noes: Beahrs, Debs, Dias, Rus, Sher, Worthington.
Uses of Present City Hall
Councilman Debs moved, and it was duly seconded, that the Plan-
uing and Procedures Committee . study the scope of facilities on the
present site and develop a list of criteria to guide the citizens com-
mittee on recreational, library, cultural and senior citizen facility
needs in this area and of the entire City.
Councilman Flint asked whether the Planning and Procedure Com-
mittee was to report to the Council or to the citizens committee to
which this subject has already been assigned. Councilman Debs
replied that the report would be to the Council..
The motion was defeated on the following tie roll call vote:
Ayes: Comstock, Debs, Flint, Pearson, Sher, Worthington.
Noes: Arnold. Beahrs_ Cooley, Dias, R.nhrs.
(Councilman Beahrs left the Chambers at 11:10 p.m.)
Meeting Time - Finance Committee
Councilman Cooley introduced the following ordinance for first
reading and moved its adoption:
Ordinance entitled "Ordir.ance of the Council of the City of Palo
Alto Amending Section 2. 124 of the Palo Alto Municipal. Code
Regarding the Meeting Date of the Committee on Finance."
Councilman Cooley stated that the meeting date set for the Finance
Committee (first Tuesday of each month) often conflicts w.i,th other
meeting dates, and he believes changing the date to the third Tuesday
of each month will result in leas ,meeting conflict.

Councilman Comstock introduced the following resolution anci moved
its adoption:
Resolution entitled "Resolution of the Council of the City of Palo
Alto Declaring Two Parcels of Real Property Surplus to the
City's Needs and Authorizing Sale Thereof at a Public Sale
(Hopkins and Pine)."
Councilman Arnold moved that the matter be continued until the
regular meeting of October 10 and be considered along with the
item concerning Rinconada Park.. Following discussion, -Council-
man Arnold withdrew his motion.

Councilman Sher moved, seconded by Beahrs, to continue the matter
until the Council reaches the item concerning Ri.nconada Park on the
October 10 Agenda.

Remuneration of Councilmen
Councilman Flint referred to his letter of September 20 concerning
the remuneration of councilmen.
Councilman Flint moved, seconded by Comstock, that the Mayor be
authorized to appoint a citizens committee to study the problem of
remuneration of councilmen. The maion failed on majority voice
vote.
Page Mill Road Construction Project - County Project
Councilman Flint referred to his letter of September 20, 1966, con-
cerc.ing Page Mill Road construction and destruction of the natural
scene in the area.
Councilman Flint moved, seconded by Pearson, that the Council ex-
press its displeasure to the Board of Supervisors of Santa Clara
County in the design of the new Page Mill Road between Foothill and
,ltapero Serra as regards preserving natural scenery in the area
and that a copy of his letter to the Council be appended to the com-
snuaication to the Board of Supervisors.
The motion carried on the following roll call vote:
Aye:: Comstock, Debs, Dias, Flint, Pearson, Sher,
Worthington.
Noes: Arnold, Beahrs, Cooley, Rohrs, Rus.
Trailways - New: a M U Road
Councilman Pearson asked, as a point of information, if it was
known whether the ten -foot wide paths which the State indicated
would be put in on the new Page Mill Road are being included in
the construction going on there. City Manager Morgan stated that
he would contact the appropriate State representative and report
back to Ese Council on the status of the paths.

Civic Center Study -
&. ommittee of the Whole Session
Councilman Debs moved, and it was duly seconded, that the Council
set policy that, following the report to Council of the Pubic Works
Committee on Civic Center space requirements, a Committee of the
Whole seesion (or sessions,, as needed) be held to review the new Civic
Center plans. Councilmen Rohrs pointed out that the September 26
motion referring the subject to the Public Works Committee included
"Civic Center plans" also.
Councilman Debs, with the consent of his second, then changed the
motion to include "plans."
Following discussion ar to whether the Public Works Committees should
report to the Council or to a Committee of the Whole, the motion car-
ried on the following roll call vote:
Ayes: Beater s, Comstock, Debs, Flint, Pearson, Rohm,
Sher, Worthington.
Noes: Arnold, Cooley, Dias, Rua.,
Planning Department and
Planning Commissiozirrocedure
Councilman Flint referred to his letter to the City Manager of
September 20, 1966 concerning the denial of his request for a reap
by the Planning Cornrnission. Planning Officer Fourcroy explained
his reasons for denying the map to Councilman Flint. Discussion
followed concerning whether or not councilmen acting in a private
capacity should be able to obtain materials not yet *Wade available
to other councilmen or the general public.

ning Department shall obtain permission from the City Council be-
fore representing the City of Palo Alto an any board, commission,
oz committee, or at any meeting of government agencies at which
business between such agencies ahall be transacted. The motion
fallen for lack of a second.
Additional discussion followed ir..volving questions from members of
the Council directed to City Manager Morgan and Planning Commis-
sion Chairman Stromqui st.
Adjournment
Councilman Cooley, moved, and it was duly seconded, to adjourn.
Councilman Comstock moved, seconded by eearson, to amend the
notion to adjourn to October 24. Counc lerian Cooley agreed to in-
clude the date in his motion.
The motion carried on the following roll call vote:
Ayes: Arnold, Beahra, Comstock, Cooley, Dias, Rohrs,
Rue.
Noe s: Deb.., Flint, Pearson, Sher, Worthington.
