Present: Arnold, Beahrs, Cooley, Debs, Dias, Flings Pearson, Rohrs, Rus, Sher, Woodward, Worthington Absent: Comstock (arrived 7:40 p.m.) Approval of Minutes Councilman Debs moved, seconded by Worthington, to add at the bottom of page 351, "Following the final requeet of Councilman Debs, the written report was distributed to Council". The motion failed on the following tie roll call vote: Ayes: Comstock, Debs, Flint, Pearson, Sher, Worthington Noes: Arnold, Beahrs, Cooley, Rohrs, Rus, Woodward Abstained: Dias Councilman Debs requested an addition on page 356 under "Time of Filing for Candidates" at the end of the second paragraph. He asked that another sentence, "City Attorney Michalski stated that no such conflict exists", be included. There were no objections. Councilman Flint referrer: to Con oilman Arnold's motion at the bottom of page 351 and asked if it quoted him correctly. Council- man Arnold stated that the motion was correct, but could perhaps be clearer. Councilman Flint suggested that in the interest of clarification the wording be changed to read "that when the part of the report pertaining to Council -appointed officers is received, it be referred to the Personnel Liaison Committee just appointed by Mayor Dias whose members are Councilmen Pearson, Cooley and Worthington and Mayor Dias". There were no objec .ons. Councilman Flint requested that on page 353 in the paragraph beginning "Mr. Henry 'arnbucetm°', after "gone by" the word "since" be changed to "in which". There were no objections. Councilman Flint asked that on page 356 in the paragraph referring to his amendment to Resolution 3924 the word "Valley" be deleted. There were no objections. Councilman Sher pointed out the error in recording the roll call concerning the motion to adjourn reported on page 358. In the 3 6 0 t /26i 66 line indicating those who voted "no", "She" should be changed to "Rus". The Minutes of the Council Meeting of September 12, 1966 were then approved as corrected. Adjournrnent Councilman Arnold moved, seconded by Beahrs, that the time �f adjournment be set at 11:00 p.m. Councilman Conestock moved, seconded by Pearson, an amendment that the meeting be adjourned to October 10, 1966. Counci:rnan Debs stated that it was unlikely the Council would reach the secti ei in the Agenda "New Business" before the fixed adjournment time of 11:00 p. rn. and requested his item referring to uses of the facilities and site of the existing Civic Center and his item suggesting a Ccmmittee of the Whole session to review the new Civic Center plans he moved up on the Agenda to a position wider "Rerelutions and Ordinances" immediately following -consider- ation of the resolutions concerning the University Avenue District Civic Center Off -Street Parking Project 66-8. He also requested that the letter from the League of Women Voters regarding consid- eration of a downtown library and recreational facilities be considered along with his two items. Councilman Rus objected to changing the order of consideration for any of the three items. (Change of order for Agenda items requires unanimous consent of Council, ) 361 9/26/66 Canvass of Votes -Special Election of September 13, 1966 Mayor Dias declared that the Council will now can"ass the returns of the Special Election held on September 13. 1966 and appointed Councilmen Pearson, Sher, Comstock and Flint to conduct the canvass of the returns and the absentee ballots. Mayor Dias stated that the City Clerk has filed her certificate indi- cating that she has compared the signatures on the identification envelope which contains the absentee ballot and the registration affidavit of the voters and is satisfied that the signature on the voter's identification envelope is the voter's signature in each case. Following the Canvass, Mayor Dias announced the whole number of votes cast in the City is 10, 868; and that the title of the policy mea- sures voted upon are: CIVIC CENTER LOCATION, Measure (a) and Measure (b). She announced the number of votes given in the City for Measure (a) is 7,622 and for Measure (b) is 3, 243. Councilman hiss, seconded by Cooley, introduced the following resolution and moved its adoption: Resolution 3925 entitled "Resolution, of the Council of the City of Palo Alt:. Declaring the Results of the Special Eiectian Held on September 13, ,966 in the City of Palo Alto". 'The motion carried on the following unanimous roll call vote: Ayes: Noel: Arnold, Beahrs, Comstock, Cooley, Debs, Dias, Flint, Pearson, Rahrs, Ru5, Sher, Woodward, Worthington Nene Councilman Cooley stated he wished to mo-ee to implement the results of the election. Discussion followed concerning wk tier such a motion was in order at this time. - Councilman Sher asked City Attorney Michalski if such a motion was proper under the item concerning the canvass of votes for the Special Election. Mr. Michalski referred to Section 2. 103 of the Municipal Code and replied thzt it rnea:it that unanimous consent was required to xnove an item up on the Agenda and a new item could he considered if a majority of the Council consented. Mayor Lis ruled that she would entertain a motion directly related to the mandate of the people as oxpresaed by the election result and asked Councilman Cooley to state hi, motion. Councilman Cooley moved, seconded by Beahrs, to implement the election 36 follows: fa) Council approves the concept of the Civic Center on the downtown site; (b) Council directs the Public Works 62 /26/66 Committee to consider plans for the Civic Center and report to Council by the first meeting in October, (c) Council instructs the staff to return to Council on October 10 with an amended contract with the architect for inclusion of the downtown library as a sera - rate building on the Civic Center site including multi -purpose rooms for citizen use and further instruct the staff to prepare a contract for the same meeting authorizing drawings for the Civic Center. Councilman Sher challenged the ruling that :he motion was in order. The Chair was upheld on the following roll call :•ote: Ayes: Arnold, Beahrs, Cooly, Dias, Rohre, Roe, Woodward Noe•,: Comstock, Debs, Faint, Pearson, Sher, Worthington Councilman Comstock requested that the Council consider each part of Councilman Cooley's motion separately ; Mayor Dias ruled accordingly and stated that the first part, or section (a) was now before the Council. The motion carried on the following unanimous roll call vote: See P ge 395 Ayes: Arnold, Beahrs, Comstock, Cooley, Dehs, Dias, Flint, Pearson, Rohrs, Rus, Sher, Woodward, Worthington Noes: None It was brought out in the discussion that the matter of space require- ments for each of the two sites voted upon in the Special Election wAs in the Public Works Committee and conaileration of the subject had been held up pending the outcome of the election. Councilman Pearson moved, an it was duly seconded, an amend- ment that when the Public Works Committeefinishes their study, the matter would go befcRe the Council ae a Committee of the Whole to review Civic Center plans. The amendment failed ou the follow- ing roll call vote: Ayes: Noes: Arnold, Beahrs, Cooley, Dias, Rohrs, Rus, Woodward Comstock, Debs, Flint, Sher, Worthington Councilman Flint moved, seconded by Comstock, an amendment that the smatter be referred to the Public Works Committee to be taken up immediately and report back to Council at the earliest possible moment. 363 9/26/66 Following discussion, the amt:ndrnent failed on the following roll call vote: Ayes: Noes: Arnold, Beahrs, Cooley, Dias, F ohrs, Rua, Woodward Comstock, Debs, Flint, Pearson, Sher, Worthington Councilman Worthington moved, seconded by Pearson, an amendment that the Public Works Committee report back on the matter to the Council on September 26. The amendment failed on the following roll call vote: Pearuon, Worthington Noes: Arnold, Beahrs, Comstock, Cooley, Debs, Dias, Flint, Rohrs, Rill, Sher, Woodward Part (b) of Councilman Cooley's motion that Council directs the Public Works Cornmittee to consider plans for the Civic Center and report to Council by the first meeting in October carried on the following roll call vote: Ayes: Arnold, Beahrb, Cooley, Dias, Rohrs, Rus, Woodward Noes: Comstock, Debs, Flint, Pearson, Sher, Worthington Councilman Worthington requested that part (c) of Councilman Cooley's motion: be split into two parts, one relating to buildings and the other to the contract. Mayor Dias ruled the request was in order. -= --Councilman Cooley challenged the ruling of the Chair. The ruling of the Chair was upheld on the following roll call vote: Ayes: Arnold, Beahrs, Comstock, Debs, Diana, Flint, Pearson, Rohr*, Sher, Worthington Noes: Cooley, Rus, Woodward Councilman Flint requested the Council consider :has item concerning modification of the exterior architectural design of the Downtown Civic Center, Councilman Cooley's item concerning changes in the Council Chamber and Councilman Debs' item suggeating a Committee of the Whoresession to review the new Civic Center plans along with the first part of the third section of Councilman Cooley's motion as they are all related to it. Councilman Comstock objected. Councilman Comstock moved. and it was duly seconded. to continue Councilman Cooley's motion until the item cuncernisag the Panning & Procedures Committee recommendations regarding staff atadies for establishment of a dowmtovva community service center was before the Council. 364 9/26/66 T h e motion failed on the following roll call vote: i.yes: Comstock, Debs, Flint, Pearson, Sher, Worthington Noes: Arnold, Beahrs, Cooley, Dias, Rohrs, Rus, Woodward City Manager Morgan was questioned by Council members as to what his action would be in the event the part of the motion under discussion carried. Mr. Morgan stated that since the motion did not include details, he would have to use the proposal concerning the downtown library and multi -Purpose rooms which was before the Council in the past as a guide. Councilman Pearson moved, and it was duly seconded, an amend- ment to refer the choosing of the library site to Public Works Committee for their review and consideration of the use of the present public safety building, present city hall or any other site in downtown Palo Alto. Mayor Dias stated she would rule the motion to amend out of order because it conflicts with the motion before the Council, but would accept it as a substitute motion. Councilman Pearson stated she would then make it a substitute motion. The substitute motion failed on the following roll call vote: Ayes: Comstock, Debs, Flint, Pearson, Sher, Worthington Noes: Arnold, Beahrs, Cooley, Dias, Rohrs, Rus, Woodwa rd Following discussion, the motion that Council instructs the staff to return to Council on October 10 with an amended contract with the architect for inclusion of the downtown library as a separate building on the Civic Center site including multi -purpose rooms for citizen use carried on the following roll call vote: Ayes: Noes: Arnold, Beahrs, Cooley, Dias, Rohrs, Rus, Woodward Cornstock, Debs, Flint, Pearson, Sher, Worthington Councilman Rus moved an amendment to the second section of (c) of Councilman Cooley's'motion to insert "preliminary" before "drawings". Councilman Cooley agreed to include "preliminary" in his motion. Councilman Sher moved, seconded by Flint, to continue the matter until Council has considered the Pubic Works Committee recom- mendation on apace requirements and the letter of Councilman Flint's concerning modifications to the exterior design of the Down- town Civic Center has been sent to the architect and his reply received by the Council. 36E 9/26/66 The motion to continue failed on the following roll call vote: Ayes: Comstock, Debs, Flint, Pearson, Sher, Worthington Noes: Arnold, Beahrs, Cooley, Dias, Rohrs, Rus, Woodward Councilman Flint requested the Council consider his item on the Agenda concerning a letter to the architect regarding modification to the exterior architectural design of the Downtown Civic Center be considered along with the motion before the Council. Mayor Dias asked if he was asking to move the item up on the Agenda. Council- man Flint stated the request was not for out -of -order placement, as it properly belongs with the motion before the Council, and asked for a ruling. Mayor Dias ruled that it did not. Councilman Flint challenged the ruling and the Chair was upheld on the following roll call vote: Ayes: Arnold, Beahrs, Cooley-, Dias, Rohrs, Rus, Woodward Noes: Comstock, Debs, Flint, Pearson, Sher, Worthington Councilman Worthington moved, seconded by Comstock, an amend- ment to add "Cur space for the city hall totaling some 15, 000 gross square feet" to the motion. The motion failed on the following roll call vote: Ayes: Comstock, Debs, Flint, Pearson, Worthington Noes: Arnold, Beahrs, Cooley, Dias, Rohrs, Ras, Sher, Woodward -heitto on that the staff be further instructed to prepare a contract for the same meeting authorizing preliminary drawings for the Civic Center carried on the following roll call vote: Ayes: Arnold, Beahrs, Cooley, Dias, Rohrs, Rus, Woodward Noes: Comstock, Debs, Flint, Pearson, Sher, Worthington Citizens Committee - Potential Usea of Existin City Hall Mayor Dias moved that she be given approval to appoint a citizens committee to study potential uses of the existingcity hall. Councilman Flint objected, stating that thesubject was not on the agenda. Mayor Dias replied that tine Chair had been upheld regarding con- sideration of matters directly related to the mandate of the people 366 9/26/66 expressed by the results of the Special Election and ruled that con- sideration of a citizens committee to study uses of the existing city hall was in order at this time. Councilman Worthington challenged the ruling. The Chair was upheld on the following roll call vote: Ayes: Noes: Arnold, Beahrs, Cooley, Dias, Et( tars, Rus, W ocoawa rd Comstock, Debs, Flint, Pearson, Sher, Worthington Councilman Debs moved, and it was duly seconded, a substitute motion that all uses of the facilities and site of the existing Civic Center be studied by the Planning & Procedures Committee with special attention given to the following points: (a) recreational, library and cultural needs of the entire City with attention_ to geographical diversification of facilities; (b) recreational, library and cultural needs of Community Center -Newell Road area considered as a unit; and the staff be instructed to prepare a report for the Committee's use. Mayor Dias asked if there was any objection to bringing up Council- man Deb& item under "New Business" at this time as a substitute motion. Co,ir.ciiman Debs asked City Attorney Michalski if his substitute motion was a proper one. htr. Michalski replied Councilman Debs could handle the matter by amending the motion to read "Planning & Procedure Committee" for "citizens' committee". Woodward Debs, Flint, Pearson, Sher, Worthington 367 9/26/66 Hospital Board Appointments At 10:35 p.m. the Council recessed in Executive Session to consider appointments i o the Board of the Palo Alto -Stanford J lospital to fill the two expired terms. The Council returned to Chambers at 10:45 p. m. Mayor Dias announced the reappointments of Conrad F. Gullixson and John A. Stern to new three-year term on the Palo Alto -Stanford Hospital Board. Councilman Faint objected to the procedure used in executive session • "."or approving the appointments. Mayor Dias asked if he would prefer to vote separately on each name publicly. Councilman Flint moved and it was duly seconded, to vote separ- ately on each name publicly in the Council Chamber. The motion failed on show of hands vote. Salary Survey - City Employees Councilman Cooley, seconded by Arnold, introduced the following resolution and moved its adoption: Resolution 3926 entitled "Resolution of the Council of the City of Palo Alto Adopting a Compensation Plan (Effective July 4, 1966)" The motion carried on the following unanimous roll call vote: Arnold, Beaters, Comstock, Cooley, Debs, Dias, Flint, Pearson, Rohrs, Raga, Sher, Woodward, Worthington Ayes: Noes: None Councilman Cooley, seconded by Beahrs, introduced and moved the adoption of the following ordinance: Ordinai.ce No. 2317 entitled "Ordinance of the Council of the City of Palo Alto Amending the Budget for Fiscal Year 1956-67 to Make an Additional Appropriation for Salary Adjustments." The motion carried on the following unanimous roll call vote: ?.yes: Arnold, Beaters, Comstock, Cooley, Debs, Dias, Flint, Pearson, Rohrs, Rus, Sher, Woodward, Worthington Noes: None Councilman Cooley moved seconded by Beabrr, that the Council adopt the recommendations of thre salary consultants and include 368 9/26/66 the two recommendations from the City Manager: (1) the one-half step increase for six classificaV,ons; and (2) that this pay adjustment be retroactive to July 4, 1966, the first pay period of the fiscal year; and that the staff be directed to consult with the State with reference to updating the City pension retirement plan. Councilman Debs moved, seconded by Flint, an amendment that the staff consult with the State and run the survey at their usual cost with reference to updating the pension retirement plans and report back to Council.
