Hall Palo -Alto, California August 29, 19E06 The Council of the City of Palo Alto met in an adjourned meeting from August 22 on this date at 7:30 p. m. with Mayor Dias presiding. Present: Arnold, Cooley, Dias, Flint, Rahrs, Sher, Worthington. Absent: l3eahrs, Comstock, Delos, Pearson, Rus, ;Wcortward. Proposed Ordinance Officially rea.ting a ivision of mrncinications City Manager Morgan outlined the history of the Division of Communi- cations and pr'.sented a proposed ordinance which would amend the Administrative Code and provide for the formal creation of this unit of City government. Councilman Flint introduced the following ordinance for first reading: Ordinance entitled "Ordinance of the Council 0the City of Palo Alto Adding Section 2. 210.6 to the Palo Alto Municipal Code Establishing the Division of Communications." Councilrn j Rohrs seconded the motion which carried on the following unanimous roll call vote: Ayes: Arnold, Cooley, Dias, Flint, Rohrs, Sher, Worthington. Noes: None. Claim for Marna es • Michael 3. Malachowski City '_t y ficitaloki read his letter of August 15 describ ri.g"the claim for damages in the amount of $310.00 filed by Michael 3. Malachowski and recommended the claim be denied. Councilman Cooley moved, seconded by Rohrs, that the claim of Michael 3. Malachowski in the amount of $310. 00 be denied in its entirety. The motion carried on majority voice vote, Councilman Flint abstaining. Proposed A r Ynent a Drive -En Restaurants City Attorney Michalski referred to his report of August 19 regarding a proposed ordinance, establishing and regulating Drive -In Restaurants. Councilman Sher move,l, seconded by Arnold, that the proposed ordi- nance entitled "Ordinance of the Council of the City of Palo Alto Amending Chapter 28 of the Palo Alto Municipal Code Regulating Drive -In Restaurants and Refreshment Stands" be sent to Planning and Procedures Committee for study and report back to Council. The motion carried en majority voice vote. Community Recreation Services Councilman Arnold moved, seconded by Cooley, that the Council approve the proposed agreement. for Community Recreation Services in the Palo Alto Unified School District and authorize the Mayor to slign it, Following discussion, the motion carried unar=—ous? j . He stated that if Mr. Sanchez' applica- tion is app.-oved he must either provide a street himself or support the assessment district. Mr. Fourcroy responded to questions of the Council concerning possible difficul,'.ies which might be encoun- tered in connection with an assessment district in the area. Councilman Flint moved to return the item to the Pl&nning Comrniss'Lon for a definition of the uses of the land proposed for the assessment dis- trict. The motion failed for lack of a second. Councilman Arnold moved, and it was duly seconded, to strike from his motion "thee next" and replace those word with "a future." The motion carried unanimously. Councilman Sher stated he would like to insert before"private" the words "previously proposed street pattern which included the." There being no objection, Councilman Sher's amendment was included in the motion. The motion as amended carried by majority voice vote, Councilman Flint dissenting. 343 8/29/66 Improvement Assessment District orest Avenue and Hale treet Planning Officer Fourcroy referred to the Planning Commi?sion's recommendation concerning the inclusion of an existing 20 -foot pri- vate road or. Forest Avenue in the next improvement assessment district. Councilman Rohrs moved, and it was duly seconded, an amendment to the recommendation as presented by Mr. Fourcroy changing "in the next" to "for consideration in a future." The amend- ment carried unanimously. Councilman Rohrs moved, and it was duly seconded, that the exist- ing 20 -foot private road and turn around on Forest Avenue, vicinity of Hale Street serving 1017, 1019, 1021, 1.023 and 1025 Forest Avenue, be included for consideration in a future improvement assessment district for improvement as a public, dedicated street. The motion carried unanimously. Modification of Downtown Civic Center Design Councilman Flint referred to his l.:.tte r to the Council of August 18 regarding modification of the exterior architectural design of the Downtown Civic Center. Councilman_ Flint moved, seconded by Sher, that the Council request Mr. John Hill of Edward D. Stone's Palo Alto office reply as to whether or not external appearance of the Downtown Civic Center design can be modified without any major change in the cost of the project. Councilman Sher moved, seconded by Flint, an amendment that the communication from the Council to Mr. Hill include as an attach- ment a copy ,of Couneilrnan Flint's letter to the Council so that Mr. Hill will know the kind of changes the Council might have in mind. Councilman Cooley stated that he wntilei move the- item be cont1Y'_t_att _it such movC would be considered in order. Mayor Dias stated that .he would prefer to vote on the amendment and then consider a.nother motion. The amendment carried on the following roll call vote: Ayes: Arnold, Flint, Sher, Worthington. Noes: Cooley, Dias, Rohrs. Councilsn«n Cooley moved, seconded by Rohrs, to continue the matter (_notion to continue takes precedence). Councilman Arnold moved, seconded by Rohrs, an amendment that the matter he continued until September 26, the first Council meet- ing following the Special Election. Councilman Worthington sug- gested the motion include "if the subject is still pertinent." Council- 344 8/29/66 man Arnold agreed to include this phrase in his motion to amend. The amendment carried on majority voice vote. The motion carried on the following r^!1 call vote: Ayes: Arnold, Cooley, Dias, Rohrs, Worthington. Noes: Flint, Sher. Financing Gounty Transit System Councilman Flint referred to his letter of August 18 concerning financing of a county transit -district.- He Moved, seconded by Sher, that the Council request the County to petition the Legislature to either reinstate the Collier -Unruh "in lieu" tax fund for financing county transit operations or else.pr•ovide some alternate rneans of financing. Councilman Arnold moved, seconded by Rohrs, that Councilman Flint's letter be referred to the Planning and Procedures Committee. Councilman Flint moved to continue the item until the September 12 Council :meeting during which time he would get replies to Council questions. The motion died for lack of a second. Councilman Arnold amended his motion to include that the .staff pre- pare a brief history of the Collier -Unruh Act, particularly with re- gard to use of "in lieu" tax funds. Discussion followed concerning the possible reasons the Legislature might have had for repealing the Act and whether the Legislative Counsel in Sacramento might be questioned in this regard. The amendment carried on the following roll call vote: Ayes: Arnold., Dias, Sher, Worthington. Noes: Cooley, Flint, Rohrs, (Councilman Cooley left the Chambers at 9:CO p.m.) Quorum immummamw Councilman Sher suggested the absence of a quorum. (The Council recessed from 9:01 to 9:09 p.m.) The motion to refer the item concerning financing of a county transit district to Planning and Procedures Committee with the staff directed to report to the Committee carried on majority voice vote. 1 345 8/29/6f Palo Alto -Stanford Hospital - t1 ertain Practices ol tfie hospital Councilman Flint referred to his letter of August 19 to Dr. Leroy E. Bates, Director of the Palo Alto -Stanford Hospital, containing several questions concerning practices of the Hospital. Councilman Flint moved, seconded by Worthington, to send his letter to Dr. Bates together with the reply From Mr. Dumas, who replied in Dr. Bates' absence, to the Finance Committee to be considered along with the Palo Alta -Stanford "Hospital item before the Committee. Discussion followed concerning the content of the letter and also what might be the appropriate action_ for a member of the Council -to take in the event of receiving a complaint from a citizen of Palo Alto in connection with hospital service. The motion to refer the letters to the Finance Committee failed on the following roll call vote: Ayes: Flint, Sher, Worthington, Noes: Arnold, Cooley, Dias, Rohrs. Written Communications Letter from Palo Alto Chamber of Commerce regarding use of Phase I County Expressway Funds and Willow Road extension, Councilman Arnold moved, seconded by Rohrs, that the letter be filed. • The motion carried unanimously. Letter from Stanford University re proposal to acquire the City's interest in the Pa10 Alto -Stanford Hospital. Councilman Arnold moved, seconded by l=iOhr's;- to r efer_the letter to the Finance Com- mittee and staff be requested to prepare ca:rimcent los-use of the Committee. The motion carried unanimously. Oral Communications Mr. George Desposito, 607 Wellsbury Way, Palo Alto, spoke protesting the construction of a new service ;station at .3011 Middle- field Road and presented a petition to the Council on behalf of the neighborhood group opposing the construction of the service station. Mr. Gene Fisher, 665 Towle Way, Palo Alto, representing the developer of an apartment building in the area in the vicinity of 3011 Middlefield Road also spoke in opposition to the construction of a service station there. Councilman Dias moved, seconded by Cooley, to refer the petition to the. Planning Commission for inclusion in their study of rezoning is accordance with the General Plan.
