Mayor Arnold convened the meeting at 10:25 p. m. after an announced executive session. Present: Absent., Arnold, Beahrs, Comstock, Cooley, Debs, Dia.s, r iint, Pearson, Rohrs, Sher, Worthington. Rus, Woodward. Price Fixin Scuts Mayor Arnold announced the Council agreed to accept the following downward price adjustments in settlement of claims filed in Feb- ruary 1962 in price-fixing suits against certain electric equipment manufacturers: $100, 000 from Westinghouse Corporation; $46,000 from the General Electric Cornpany; and $15,000 from McGraw- Ediaon, totaling $161,000. The City Attorney was directed to take the steps necessary to terminate the action against those companies. Salary Schedule Mayor Arnold announced that the Council had approved an increase of 3% in the salaries of the City Clerk and the City Controller effective January 1, 1966, which establishes the Controller's salary at $1,400 per month and the Clerk's salary at $686 per month. The minutes of January 10 were approved as distributed. a Change Mayor Arnold moved that the ' our,cil discuss item 10 at this time. Hearing no objection, it was so ordered. 10. Project 65-4 - Charleston Trunk Sewer Assistant to the City Manager Riley referred to the staff report dated January 20, 1966 reporting on thc- hids,received for the Charleston Trunk Sewer, Project 65-4, and recommended that the low bid be accepted. Councilman Beahrs moved that the Council accept the low bid of $537, 802. 60, that the contract be awarded to Murphy Brothers, Inc.; and he introd; ced Ordinance No. 2275 entitled "Ordinance of the Council of the City of Palo Alto Making Additional Appropri- ations in the Sewer Utility Fund - Charleston Trunk Sewer, Pro- ject 65.4" and moved its adoption. The motion was seconded by Dias. After Discussion, Vice Mayor Debs moved an amendment, which was duly seconded and carried on a majority voice vote, to change the fi ecal. year in sixth paragraph from "1966-67" to "1965-66." 112 1/24/66 Counci.irran Flint moved an amendment and it was duly seconded and carried unanimously, to add the following words at the end of the fourth paragraph: "that this appropriation supercedes the appropriation that was approved in the operating budget of the Sewer Utility of 1965-66 for this project. " The motion was passed and the ordinance as amended was 'adopted on the following roll call vote: Ayes: Arnold, ",deahrs, Comstock, Cooley, Debs, Dias, Pearson, Rohrs, Sher, Worthington. Noes: Flint. 1. Re�ort on Elderly Living in Census Tract 113 The Council had r'eceive4 copies of the final report prepared by the Community Council of Northern Santa Clara County on their "Study of Persons 65 Years of Age and Over Living in the Inner City of Palo Alto." Mr2. Queene Arnirian, as Chairman of the Citizens Advisory Com- mittee to study persons 65 years of age living in the inner city of Palo Alto, delivered additional copies of the final report and called attention to the recommendations on health, transportation, hous- ing and community s°rvices contained therein. After discussion, Vice Mayor Debs moved, seconded by Flint, and carried unanimously, that the report be referred to the Committee on Planning and Procedures. 2. Wildlife Preserve at the ga des The Committee on Public Works unanimously recommended that the Council approve the concept of the 'Wildlife p reserve proposal as recommended by the Citizens Advisory Committee on the Bay - lands and directed the staff to work with the Audub:n Society to de- termine preliminary cost and design of overwater boardwalks, observation platforms, an interpretive center and other components ',shown on the plan; and that land areas be designated as a wildlife preserve after resolving, if any, of the airport and yacht harbor 1,:,ases. Councilman Rolirs, speaking as chairman of the com- mittee, moved the committee's rectrmmendation. Councilman Flint moved an amendment, seconded by Debs, that the staff report to the Council by the second meeting in February. After discussion, the amendment was declared lost on a voice vote. The Main motion carried unanimously on a voice vote. 113 1/24/66 Councilman Pohrs moved, seconded by Comstock, that the .Council direct the staff to inspect the levees available for walkways and make recommendations for a plan on which they could be used. The motion was declared carried on a majority voice vote. Mr. Tom Harvey, speaking for the members of the Audubon So- ciety, indicated they would be happy to work with the staff as had been suggested. 3. Palo Alto Airport The Committee_ on Planning and Procedures unanimously returned the letter dated October 4, 1.965 from the California Council of Aviation Associations to the Council for their disposition. Coun- cilman Comstock moved, seconded by Debs and carried unani- mously, that the letter be filed. 4. Amendments to the Code Establishin TTruck Routes The Planning and Procedures Committee unanimously recommended t o .t h e Council . an ordinance changing the designation "limited truck route" to "local truck route"; that subsection (a) be amended on sheet 3 to show the multiple delivery zone extended to Oregon Avenue; and to incorporate the change recommended cn page 2 of the City Attorney's letter dated December 16, 1965. (See com- mittee minutes of January 17, 1966.) Co-ancilman Comstock introduced and moved acceptance for first reading of an ordinance entitled "Ordinance of the Council of the City of Palo Alto Amending Section 19. 132 of the Palo Alto Mu- nicipal Code Establishing Truck Routes by Changing the Designa- tion of Limited Truck Routes to Local Truck Routes and Changing Multiple Delivery Zone Sheet 3. " The motion was duly -seconded and passed unanimousl3:on a voice- vote. 5. The Planning ane Procedures Committee unanimously recommended to the Council an ordinance deleting Errbarcadero Road as a limited truck route, incorporating the changes recommended by the City Attorney in his letter dated December 16, 1965 to Sec- tion 3, subsection (d). Councilman Comstock introduced and moved acceptance for first reading of an ordinance entitled "Ordinance of the Council of the - City of Palo Alto Amending Section 19.132, of tho Palo Alto Mu- nicipal Code Establishing Truck Routes by Deleting a Portion of Embarcadero Road from the List of Limited Truck Routes. '-'. The motion was duly seconded and after a short discussion carried unanimougl'y on a voice vote. 114 1/24/66 6. The Planning and Procedures Committee recommended by a 2 to 1 vote to the an ordinance deleting Oregon Avenue as a limited truck route and establishing it as a truck route 24 hours a day from Alma Street to Bayshore Freeway fo_:. those trucks making pickups or, deliveries to or from the Midtown Multiple Delivery Zone. ' Councilman Comstock introduced and moved acceptance for first reacting of an ordinance entitled "Ordinance of the Council of the City of Palo Alto Amending Section 19. 132 of the Palo Alto Mu- nicipal Code Establishing Truck Routes by An -tending the De'signa- tion of Oregon Avenue as a Limited Truck Route. " Mayor Arnold referred to the letters which the Council had re- ceived nn the matter from DoVntow;n Palo Alto, Inc.; the chairman of the Santa Clara Valley Terrn. inal Managers; and the attorney for the Engineering & Grading Contractors Association. After dis•-ussion, the motion carried on the following roll call vote: Ayes: Arnold, Comstock, Debs, Flint, Pearson, Sher, 'Worthington. Noes: Beahrs, Cooley, Dias, Rohrs. Councilman Comstock moved, and it was duly seconded and carried unanimously, that the Council direct the staff to report on the apparent discrepancies in the grading ordinance and return the report to the Committee on Planning and Procedures for disposi- tior, 7. City Council -School Board Liaison Committee The Council had received a report from Councilman Dias dated January 20, 1966 which reported on the January meeting of -the School Board -City Council Liaison Committee, of which sh'e' is a raem er. The report was presented for information only and no action was required. 8. Council Procedure Vice Mayor Deba introduced Ordinance No. 2276 entitled "Ordi- nance of the Council of the City of Palo Alto Amending Sections 2. 105, 2. 109, 2. 122 and 2. 126 of the Pala Alto Municipal Code Relative to City Council Organization and Procedure, " which had been accepted for first reading January 10, 1966 and moved its adoption. Thu motion was seconded by Rohrs and carried unani- mously on a voice vote. 115 1/24/66 9. Chapter 40 - Palo Alto Improvement Procedure Code Vice Mayor Debs introduced Ordinance No. 2277 entitled Ordi- nance of the Council of the City of Palo Alto Adding Chapter 40 (Palo Alto Improvement Procedure Code) to the Palo Alto Munici- pal Code Providing Procedure in Relation to the Acquisition or Construction of Local Improvements and the Levy of Assessments and Issuance of Assessment Bonds Therefor and Repealing Ordi- nance No. 1928, Amendments Thereto and Ordinance No. 1986," which had been accepted for first reading January 10, 1966, and moved its adoption. The motion was seconded by Rohrs and carrii.d unanimously on a voice vote. 11. Claim for Damages - G. B. Perry The City Attorney reported or: a claim for damages filed by G. B. Perry of 758 Waverley Street in the sum of $29.06 for plumbing expenses incurred to correct a sewer stoppage. Upon investiga- tion, with the assistance of the Water -Gar. -Sewer Department, he concluded there had been no negligence on the part of the City, that the claim was not a proper charge against; the City, and he, there- fore, recommended the Council so find and reject the claim in its entirety. It was moved and duly seconded that the claim of G. B. Perry be denied in its entirety. Mr. G. B. Perry, 758 Waverley Street, outlined his continuing problems with tree roots in the sewer system. After discussion, the motion to deny the claim carried on a ma- jority voice vote, with Flint voting no. 12. Li uo•r License - 4232 El Canino Real The City Attorney reported on the application of Roberto M. and Albina C. Quintana for an on sale beer license for the premises at 4232 El Camino Real, otherwise known as The Los Toritos (delicatessen). Upon investigation, with the assistance of the Police Department, the City Attorney could find no legal basis for filing ;a protest and recomrnemded that the application be filed with- out protest. On motion made, duly seconded and carried unanimously, the Council approved the recommendation to file the letter without prote st. Motion to Adjourn Councilman Rohrs moved that the Council adjourn and that the re- maining items on the agenda be continued to the next regular meet- ing.
