Present: Arnold, Beahrs, Berwald, Comstock, Dias, Gallagher, Norton (arrived 7:40 p. tn.), Pearson, Spaeth, Wheatley Absent: Clark Approval of Minutes - October 6, 1969 Mayor Arnold stated that the Council Minutes of October 6, 1969 would be considered for approval at the next meeting (October 27) since they were not distributed to the Council. (69-S&D-6) The motion carried unanimously by voice vote. Mesa Avenue Manuela Court AMENDMENT: Councilman Pearson moved, seconded by Wheatley, to reverse the recommended names for the streets known , .s Road A and Road B. since it would be more appropriate to name Road A "Coyote Hill Road" and Road B "Deer Creek Road". The ,amendment carried unanimously by voice vote. The motior, as amended carried unanimously by voice vote. - Dr. Esther Clark, 960 Old Trace Road, Palo Alto, objected to the naming of the street known as "Clark Dive", "Old Adobe Road". Dr. Clark suggested the street could be named for her father, Arthur Clark, an architect associated with Stanford and former Planning Commissioner, or her brother, David Clark, also an architect, or called "Guadalupe" after the daughter of one of the early settlers on the property. Councilman Pearson advised that the suggested names would be added to those on the list of historical names maintained for use of the Public Facilities Naming Committee. (Councilman Norton arrived at 7:40 p.m.) MOTION: Councilman Berwald moved, seconded by Spaeth, to re- consider the item relating to naming of City streets. The motion failed an the following roll call vote: Ayes: Arnold, Berwald, Gallagher, Spaeth, Wheatley Noes: Beahrs, Comstock, Dias, Norton, Pearson City Attorney Hildebrand read a proposed ordinance adopting the new street names and suggested the Council give it first reading at this time. MOTION: Councilman Beahre introduced the following ordinance and moved, seconded by Pearson, its adoption: 99 -LO/20/69 "Ordinance of the Council of the City of Palo Alto Establishing the Names of the Following Streets: Coyote Hill Road, Deer Creek Road, Laura Lane, Forest Court, Embarcadero Road, __Elwell Court, Oak Hill Avenue, Mesa Avenue, Manuela Court, Manuela Way, Old Trace Road and Old Adobe Road" The ordinance was approved for first reading unanimously by voice vote. - Willow Road Ex ressway MOTION: Cceincitman Pearson introduced the following resolution and moved, seconded by Gallagher, its adoption: Resolution No. 4306 entitled "Resolution of the Council of the City of Palo Alto Endorsing Recommendation of Interjurisdictior:al Committee for Alignment of a Portion of Route 84, and Request- ing California Highway Commission to Reopen Route Location Studies" AMENDMENT: Councilman Comstock moved, seconded by Pearson, - to add to the next to last paragraph "as a road to be built to express- way stt ndards". The amendment carried by majority voice vote. The resolution as amended was adopted on the following roll call vote: Ayes: Arnold, Beahrs, Dias, Gallagher, Norton, Pearson, Spaeth, Wheatley Noes: Berwald, Comstock Baylands Inter retive Center (CMR:349:9) MOTION: Councilrrwn Wheatley moved, seconded by Gallagher, the adoption of the following ordinance: Ordinance No. 2534 entitled "Ordinance of the Council of the City of Palo Alto Approving and Adopting an Amended Plan for the Development of the Baylands Interpretive Center" (first reading 9/22/69) The ordinance was adopted unanimously by voice vote. Advertising, Employment and Compensation -Practices (CMR:353:9) Dr. Nancy J. Cross, 1902 Palo Alto Way, Menlo Park, referred to her letter of Oct er 100 10/20/69 20 written l ceoisyttae Co the City Manager's 1 report of October 16, 1969 regarding advertising, employment and compensation practices of the City with reference to lack of job dis- crimination related to sex. Dr. Cross challenged some of the state- ments contained in the repot t. Dwight F. Mitchell, 520 Lowell, Palo Alto, representative of the local chapter of the American Civil Liberties Union, requested clarification of portions of the report and advised that there are ACLU attorneys who would be glad to cooperacc with the City in assuring that there is no sex discrimination in the employment prac- tices of the City. Miss Donna Barnhill, 2730 Sacramento Street, San Francisco, Chairman of the Job Discrimination Committee of the National Orga- nization of Women, urged that the City not discriminate on the basis of sex in connection 'vith offering employment opportunities. Miss Diane Levine, 603 Middlefield Road, Palo Alto, referred to her letter of October 18 also written in response to the City Manager's report (CMR:353:9), challenged some of the statements included in the report and objected to certain omissions. Miss Susan Watkins, 376 Addison, Palo Alto, spoke in support cf the statements of Dr. Cross and Miss Levine contained in their letters to the Council in regard to the City Manager's report (CMR:353:9). MOTION: Councilman Dias moved, seconded by Beahrs, to accept the City Manager's report with thanks and that it be noted that on the basis of the information provided, no action is warranted. The motion carried unanimously by voice vote. Renovation of Present City Hall (CMR:351:9) MOTION: Councilman Gallagher moved, and it was duly seconded, that the Council authorize the Mayor to .execute a contract on its \behalf with Corwin Booth and Associated Architects for the conver- sion of the present City Hall into a community cultural center with previsions for both an arts center and a teenage center. Discussion followed concerning previous Council policy decisions in regard. to development of the present City Hall as an arts center only, the needs of teenagers and th' opportunities provided to therm at present by the City. MOTION: Councilman Wheatley moved, seconded by Spaeth, to con- tinue the matter for three weeks (November 10) for the purpose of See clarifying Council direction and for discussion among councilmen so Page that a firm conclusion can be made on the matter and modifications 114 avoided. On -Sale Beer License - 482 Universit Avenue (CMR:352:9) MOTION: Councilman Norton moved, seconded by Beahrs, to file the application for on -sale beer license for "The Shutters", 482 Univ- ersity Avenue, without action. The motion carried by majority voice vote. Computer Rental Agreement MOTION: Mayor Arnold moved seconded by Gallagher, that the Mayor be authorized to sign the five year computer rental agree- ment proposed by the City Controller. MOTION: Councilman Wheatley moved, seconded by Berwald, to refer the matter to the Finance Committee for review. Councilman. Spaeth advised that the Finance Committee will meet on October 21, and would he able to consider the proposed agreement as a first priority item at that time and bring the matter back to Council promptly in order to obtain any advantages for the City available through meeting certain deadlines. The motion carried by majority voice vote. Civic Center Council Chambers E•uipment MR: 323:9 MOTION: Councilman Gallagher moved, and it was duly seconded, that a toggle -type switch be adopted for use with the microphones to be selected for the Council Chambers in the new Civic Center with ,,he switch to be mounted on the individual, councilman's desk and that a light panel in connection with the microphones be included in front of the mayor's position. 'fhe motion carried unanimously by voice vote. MOTION: Councilman Gallagher moved, seconded by Pearson, that the Council adopt the lavaliere type microphone for use in the new Civic Center Council Chambers. The motion carried on the following roll call vote: Ayes: Arnold, Beahra, Berwald, Comstock, Gallagher, Pearson, Spaeth Noes: Dias, Norton, Wheatiey 102 10/20/69 John. Willits, 2185 Waverley Street, Palo Alto, urge' adoption of a voting indicator system and cited recent occasions when voice votes of various councilmen were inaudible to the audience. MOTION: Councilman Pearson move 1, seconded by Comstock, to adopt a voting machine system for the new Civic Center Council Chambers. The motion failed on the following roll call vote: Ayes: Arnold, Comstock, Pearson, Spaeth Noes: Beahrs, Berwald, Dias, Gallagher, Norton, Wheatley Tentative Subdivision Map - 4237 Mandela Avenue (Clv1R:354:9) MOTION: Councilman Norton moved, and it was duly seconded, to uphold the recommenda►_ion of the Planning Commission and approve the Tentative Subdivision Map submitted by Bakke and Strough for the division of property known as 4237 Manuela Avenue being a por- tion of Lot 6, Mesa Tract, Rancho La Purissima. Concepcion, sub- ject to the following conditions: 1. revision of the map as follows: a. deletion of the permanent curb and gutter along the _ northerly side of the street in order that an additional five feet of paving and curbs and gutters can be pro- vided with the development of the adjacent property for an ultimate thirty feet of paving between curbs, b. dedication of the five-foot wide strip shown on the reap as "5' P. U. E." as a part 01 the street right-of-way. c. provide an additional five-foot wide strip adjacent to the above as an easement for public utilities and planting. 2. granting the easements shown on the map and those recom- mended by the City Engineer. 3. installation of complete street improvements to City of Palo Aiio construction standards within -the proposed street right=— of-way. 4. drainage improvements required within the Foothill Express- way right-of-way must be approved by the County Engineer's Office and permits therefore secured in accordance with Santa Clara County procedures. 5. electric service to the existing dwelling roust be connected to the new underground distribution system prior to the sale c K. any lots. 103 10/20/69 See Pages 118 & 127 6. street name shall be subject to the approval of the Public Facilities Naming Committee. 7. a one -foot "reserved" non -access strip, as indicated on the Tentative Map, shall be dedicated along the north side of the street on the Final Map. 8. provision of a turn -around acceptable to the Fire Depart- ment and City Engineer. AMENDMENT: Councilman Pearson moved, and it was duly seconded, that any references to future paths and sidewalks would mean that they would be for pedestrians and equestrians as in the Old Trace Road area. AMENDMENT RESTATED: At the suggestion of Mayor Arnold, Councilman Pearson agreed to restate the amendment to delete the requirement for paved sidewalks. MOTION: Mayor Arnold moved, seconded by Gallagher, to hear from the audience although tI' ere is a motion before the Council: The motion carried unanimously by voice vote. Hamilton S"r,utts, 42G5 Manuela Avenue, Palo Alto, owner of the prop- erty on the north side of the proposed subdivision, asked that the applicant be required to move the road five feet south, thus providing a five foot buffer strip between Mr. Shutts' property and the road. Mrs. Hamilton Shutts, 4225 Manuela Avenue, Palo Alto, spoke in support of Mr. Shutts` statement. The amendment carried unanimously b;r voice vote. Vietnam War Douglas Mattern, Co -Chairman of the Mid Peninsula Vietnam Mora- torium Committee, presented a resolution directed to President Nixon in opposition to and concerning the ro---d.c: _ _. _ --- v �........... �a the Vietnam war and asked the Council to adopt it. MOTION: Councilman Comstock introduced the resolution presented by Mr. Mattern and moved, seconded by Pearson, its adoption. Discussion followed concerning various aspects of the war itself and whether or not it is appropriate for the Council to take action on a matter outside of municipal jurisdiction. 104 10/20/69 MOTION: Councilman Wheatley moved, seconded by Beahrs, to table the resolution. Mayor Arnold ruled that since unanimous consent is required for consideration of an itern out of order that the Council wilt pr.)ceed with the Agenda items in proper order. Traffic - Noise Abatement MOTION: Councilman Pearson moved, seconded by Gallagher, that the staff be directed to prepare a preliminary study of methods of noise attenuation (i. e. depressed roadways, sale of air rights for buildings, tunneling, type of pavement, etc.) which would be rele- vant- to the recommendations contained in the DeLeuw, Cather Com- prehensive Transportation Study and that the study be referred back to the Council. CLARIFICATION: Councilman Pearson explained that it is the intent of her motion to obtain a simple preliminary report of the principle ways of attenuating noise. The motion carried unanimously by voice vote. A -C Zoning - Antenna Location MOTION: Councilman i cr to k iaiuveci, and it was duly seconded, to continue the matter relating ti location of antennas in areas zoned A -C to the next Council meeting (10/27/69). The motion carried unanimously by voice vote. Downtown Library Block MOTI'_°N:-rut;..cilman Diaa moved, seconded by Beahrs, that the Council direct the staff to report back on: 105 10/20/69 1. concepts for the property to enhance further the Civic Center District; 2. the status of the properties involved; and 3. the approximate financial commitment for ultimate develop- ment of this portion of the Downtown -Library Community Center. The motion carried by majority voice vote. Councilman Pearson requested her "No" vote be recorded. Resolution re Judge Gerald S. Chargin Luis Nogales, 630 Los Robles, Palo Alto, urged adoption of a reso- lution condemning the remarks made by Superior Court Judge Gerald S. Chargin on September 2, 1969 and contained in a copy of the ''Statements of the Court" distributed to the Council members. Monte Perez, resident of Redwood City, and employee of Stanford University, urged the Council to do whatever possibie to remove Judge Chargin from the judicial bench and asked that the propoied resolution be adopted. Troy Barbee, 749 De Soto, Palo Alto, representing the Intergroup Fellowship of St. Mark's Episcopal Church, referred to his letter of October 17, 1969 to Council members urging the removal of Judge Chargin from the judicial bench, and asked that the proposed reso- lution be adopted and that the Council take whatever action is possible to have Judge Chargin suspended from office, pending a decision of the State Commission on judicial Qualifications on the matter re- garding Judge Chargin. Douglas Mattern, 2651 Ross Road, Palo Alto, urged censorship of Judge Chargin's remarks and asked the Council to do whatever is possible to have Judge Chargin removed from the judicial bench. Jack Ybarra, representative of the Confederacion de la Reza Unida, urged that the proposed resolution condemning Judge Chargin's remarks be adopted. Gifu-;., Palo Alto, advised that he is a resident and plans to vote in the next election. Misa Susan Cabrera, 704 Waverley Street, Palo Alto, urged con- demnation of the remarks of Judge Chargin. Bob Melosh, 829 Thornwood, Palo Alto, urged the Council to inter- vene in Judge Chargin's hearing befogs the State Commission on Judicial Qualifications by adoption of the proposed resolution enn. demning his remarks. 106 14/20/69 Steve Silas, student at Stanford University, urged the Council to con- demn the remarks made by Judge Chargin and to intervene in the hearing. MOTION: Councilman Comstock introduced the following resolution and moved, seconded by Pearson, its adoption: Resolution No. 4307 entitled "Resolution of the Council of the City of Palo Alto Condemning Certain Remarks of Judge Gerald S. Chargin" AMENDMENT: Mayor Arnold moved, seconded by Gallagher, to delete the paragraph requesting the State Commission on Judicial Qualifications to take action. The amendment failed by majority voice vote. SUBSTITUTE MOTION: Councilman Beahrs moved, and it was duly seconded, to delete all of the eight "whereas" clauses and otherwi.se permit the resolution to stand. Discussion followed deploring the remarks attributed to Judge Charge and concerning whether or not it is appropriate for the Council to take any action on a matter outside of municipal jurisdiction and on the propriety of intervening ir. an attempt to influence the judicial proceedings of the State Commission on Judicial Qualifications. AMENDMENT: Councilman Gallagher moved, seconded by Dias, that the paragraph requesting the State Commission on Judicial Qualifi- cations to take action be deleted. In response to question Mayor Arnold ruled that the amendment is in order, since it is being presented as an amendment to the substitute resolution at this tirne. CHALLENGE: Councilman Pearson challenged the ruling by Mayor Arnold. The amendment failed by majority voice vote. Oral Communications Jake Swartz, 730 Bryant Street, Palo Alto, asked if the item referred. to staff regarding the Downtown Library block would be returned to Council and was advised that such would be the case.
