The Council of the City of Palo Alto met on this date at 7:30 p. m. in
an adjourned meeting from August 18, 1969.
Present: Arnold, Beahrs, Berwald, Clark, Comstock, Dias,
Gallagher, Pearson, Wheatley
Absent: Norton, Spaeth

MOTION: Councilman Wheatley moved, seconded by Comstock, that
the Planning and Procedures Committee be directed to review "D"
zoning with a view to obtaining improved controls through use of
architectural review committee or similar mechanism.
AMENDMENT: Councilman Berwald moved, seconded by Comstock,
to delete "similar" and substitute "other".
The amendment carried unanimously by voice vote.
The motion as amended carried unanimously by voice vote.
Nearon Building, 450 San Antonio Road
MOTION: Mayor Arnold moved, seconded by Beahra, to table the
item relating to the proposed Nearon Building, 450 San Antonio Road,
in the absence of Councilman Spaeth.
The motion carried by majority voice vote.
Zone Change - West Bayshore Frontage Road
and West Meadow Circle
MOTION: Ccuncilman Berwald moved, seconded by Pearson, to re-
quest the Planning Commission to consider a change of zone in the
West Bayahore Frontage Road and West Meadow Circle area from
L-M:S to L .M:S-D.
The motion carried unanimously by voice vote.
Zone Chan e - 700 Block of San Antonio Road
MOTION: Councilman Berwald moved, seconded by Comstock, that
Council request the Planning Commission to consider a' zone change
in the undeveloped area fronting on the 700 block of San Antonio Road
from M -1:S to L-M:S-D or other designation.

MOTION: Councilman Berwald moved, seconded by Comstock, that
Council request the staff to review the planting arrangements for
the median strip along El Camin. Real from Matadero to the southerly
boundaries of the City with the intent of improving and upgrading the
planting and report back to the Council about improving same.
The motion carried by majority voice vote.
Nearon Building, 450 San Antonio Road

MOTION? Mayor Arnold, moved, seconded by Beahrs, to lift frorn
the table the item relating to the Nearon Building at 450 San Antonio
Road.
The motion carried unanimously by voice vote.
Edward Hinshaw, attorney for Mr. Arthur Near,n, presented the
architect's drawing of the proposed site development and a colored
picture of_ the.nre,posed Mr. Hinshaw urged the Council
to approve the plans.
A. rynr. Howell, architect for the Nearon Building, replied to
questions from the Council regarding the proposed development of
the site.
MOTION: Councilman Dias moved, seconded by Beahrs, to uphold
the recommendation of the Planning Commission and approve the
Nearon project.
(NOTE: Planning Commission recommendation is as follows:
:-tsar-tape Site anti -Design Control Application of Arthur Nearon,
450 San Antonio Road, be approved sybject to the following
conditions:
1. that the planting strip at the rear be increased to ten
feet and an eight foot fence be installed;
2. that the trees be moved out to the center of the ten foot
planting strip; and
3. that directional arrows be removed leaving the direction
of traffic to the applicant's discretion. ")
The motion carried by majority voice vote.
El Camino Park Activities
MOTION: Councilman Gallagher moved, seconded by Wheatley, that
an emergency amendment be made to the park ordinance (Ordinance
No. 2484) to add a section terminating exclusive use permits at one
boil before sunset.

MOTION: Councilman Comstock moved, seconded by Pearson, to
hear from the audience although there is a motion before the Council.
The motioncarried unanimously by voice vote.
Nathaniel Gardner, 2042 Barbara Drive, Palo Alto, urged Council
action to eliminate the kind of undesirable activities which took
place in connection with the "Peace Festival" at El Camino Park on
Labor Day (September 1, 1969).
Brian Barhaugh, 330 Cowper Street, Palo Alto, member of Free
People's Free Music Company, spoke in support of the proposed
emergency amendment to the park ordinance. Mr. Barhaugh replied
to questions from the Council concerning the intent of has group in
ccnducting the "Peace Festival" and his views on the events which
occurred at the affair and subsequent to it.
Tirn Gaddus, 943 Bryant Street, Palo Alto, member of Free People's
Free Music Company, spoke in support of the proposed emergency
amendment to the park ordinance and replied to questions from the
Council concerning the "Peace Festival" conducted by his group.
Discussion followed concerning the events which occurred in con-
nection with the "Peace Festival" held in El Camino Park, and Assis-
tant City Manager Sipel stated that a factual accounting of events
which took place prior to and during the Labor Day activity would
be forthcoming from his office as soon as possible, (See CMR:318:9
issued September 5, 1969).
SUBSTITUTE MOTION: Councilman Gallagher moved, seconded by
Beahrs, to direct the City Attorney to prepare as an emergency
ordinance an amendment to the park ordinance (Ordinance- No. 2484)
to add a section terminating_ exclusive use permits at one hour before
sunset.
Mrs. Lee Herzenberg, 876 Cedro Way, Stanford, a member of Free
People's Free Music CornparIy, spoke in support of the proposed
amendment to the park ordinance.
Howard Besser, 1831 Hamilton, Palo Alto, member of Free People'e
Free Music Company, spoke in support of the proposed amendment
to the park ordinance,
Steve Gayle, 872 Seale Avenue, Palo Alto, member of Free People's
Free Music. Company, spoke in support of the proposed amendment
to the park ordinance. _
The motion carried unanimously by voice vote.
MOTION: Councilman Gallagher IMZi VCd; seconded by Beahrs, that
the Council direct the Mayor to appoint a committee of councilmen
to investigate circumstances of the recent "Be In" at El Camino Park
and the Lytton Plaza events with a view toward recommending a
corrective'course of action by the City.

MOTION: Councilman Pearson moved, seconded by Comstock, to
hear from the audience although there is a motion before the Council.
CHANGE OF MOTION: Councilman Pearson, with the consent of
her second; changed her motion to hear only from Brain Barhaugh.
The motion as changed failed by majority voice vote.
The motion to appoint a committee then failed or. the following roll
call vote:
Ayes: Beahrs, Dias, Gallagher, Wheatley
Noes: Arnold, Berwald, Clark, Comstock, Pearson
Oral Communications
Thomas W. Ford, representing the developers of "Palo Alto
Square", requested a continuance concerning that item on the
Agenda of the regular Council meeting of September 2 until the
regular meeting of September 8. 1969.
MOTION: Councilman Comstock moved, seconded by Pearson,
to bring up the item relating to "Palo Alto Square" out of order
from the Agenda of September 2, 1969, at this tirne.
The motion carried unanimously by voice vote.
MOTION: Councilman Comstock moved, seconded by Pearson,
to continue the itern relating to "Palo Alto Square" until Sep-
tember 8, 1969.
The motion carried unanimously by voice vote.
Resident, Waverley Street, Palo Alto, suggested there are -dif-
ferent views of morality as to what is appropriate behavior in a
public park.
Brian Barhaugh, 330 Cowper Street, Palo Alto, stated i.A would
like to encourage corn munication between young people u.nd
adults in the community.
Ron Jarnes, 705 Ellsworth Place, Palo Alto, spoke in support
of better communications within the Palo Alto community.
Jerry Reed, 375 Parkside, President of the Greenmeadow Asso-
ciation, suggested the sponsor of any event in a public park should
be responsible for any activities which take place at the event.
Mrs. Lee Herzenberg, 876'iedro Way, Stanford, would like
comparative information for this year with the Lytton Plaza ac-
tivities versus last year regarding juvenile crime on Saturday
nights.

Howard Besser, 1831 Hamilton Avenue, Palo Alto, asked the
Council to consider whether the unfortunate events occurring
after the "Be In" were products of the "Be In".
(Councilmen Dias and Wheatley left at 10:20 p. m.)
Resident, Waverley Street, Palo Alto, spoke in favor of very
large "Be In" -type activities.
Steve Gayle, 872 Seale Avenue, Palo Alto, spoke in support of
improved communication between youth and the City Council.
Adjournment
There being no further business, the Council adjourned at 10:25 p. m.
The Council of the City of Palo Alto met on this date in a regular
rneeting at 10:40 p. m. with Mayor Arnold presiding.

MOTION: Councilman Dias moved, seconded by Arnold, that in the
Minutes of August 11 the entire last sentence of t'ie paragraph re-
lating to discussion of the change of district, 3717 Middlefield Road,
on page 36 be deleted and that all of the first paragraph on page 37
following "Planning Comm i s Sion" be deleted.
The motion carried unanimously by voice vote.
MOTION: Councilman Dias moved, seconded by Wheatley, that on
page 39 of the Minutes in relation to the variance application of
Herbert G. Susrnann, 2330 Taseo Street, that it be established in
the Minutes that the stricture for which the variance was being re-
quested had already been constructed.
The motion carried unanimously by voice vote.
The Minutes of August 11, 1969 were then approved with additions
and deletions.
Mayer Arnold asked that at the request of Mrs. Ruth Berman whose
comment is shown on page 51 of the Minutes of August 18, "rental
area" be corrected to "rental housing".

Vice Mayor Wheatley requested that on page 51 also in the second
paragraph that "closing" be corrected to "crossing".
There were no objections.
The Minutes of August 18, 1969 were then approved as corrected.
Weed Abatement (CMR:310:9)
MOTION: Mayor Arnold moved, anvt it was duly seconded, to bring
up out of order at this time the proposed resolution relating to weed
abatement.
The motion carried unanimously by voice vote.
M.OT:JN: Councilman Pearson introduced the following resolution
and moved, seconded by Bea.hrs, its adoption, setting October 4,
1969 as the date of hearing:
Resolution No. 4298 entitled "Resolution of the Council of the
City of Palo Alto Declaring Weeds to Be a Nuisance and Setting
a Hearing".
The resolution was adopted unanimously by voice vote.
Miscellaneous Streets Im rovernent

MOTION: ' Councilman Gallagher moved, seconded by Arnold, to
bring up out of order at this time the proposed resolution relating
to Miscellaneous Streets Improvement Project No, 67-3.
The motion carried unanimously by voice vote.
MOTION: Mayor Arnold introduced the following resolution and
moved, seconded by Dias, its adoption:
Resolution No. 4299 entitled "Resolution Amending Resolution
No. 4211 Entitled A Resolution of the Council of the City of Palo
Alto Finding and Determining that the Public Interest and Neces-
sity Require the Acquisition of Certain Land Located in the City
of Palo Alto, County of Santa Clara, State of California, and
Directing the Filing of Eminent Domain Proceedings".
The resolution was adopted unanimously by voice vote.
Referendum Petition re Ordinance No. 2515
Councilman Clark advised that he will neither participate in the dis-
cussion nor vote concerning the referendum petition relating to Ordi-
nance No. 2515,

Mayor Arnold read a letter from the Palo Alto Medical Research
Foundation regarding the referendum petition and requesting the
Council to set the referendum election for June 2, 1970 so that it
can be consolidated with the State Primary Election, to be held on
that date.
MOTION: Councilman Pearson moved, seconded by Comstock, that
_the Councl rescind its action of July 14, 1969 in adopting Ordinance
No. 2515 which rezones the area bounded by Bryant, Waverley,
Charming and Addison from R-2 and R-4 to P -C and thereby permits
the PAM RF Hospital to be constructed on that site.
The motion failed on the following roll call vote:

MOTION: Mayor Arnold nno•:ed, seconded by Beahrs, that a special
referendurn election be set to coincide with the State Primary Elec-
tion and that the special referendum election be consolidated with
the State Election on June 2, 1970.
(NOTE: Resolution No. 4300 entitled "Resolution of the Council
of the City of Palo Alto Calling A Special Referendum Electron
for June 2, 1970 and Requesting the Board of Supervisors of
the County of Santa Clara to Consolidate Said Special Election
With the Direct Primary Election")

Alma Street Advance Street Sins
MOTION: Councilman Dias moved, on behalf of the Planning and
Procedures Committee, to approve Concept B, Signs 1 through 6
as set forth in the City Manager's Report of May 18, 1967 regarding
Advance Street Name Signs on Alma Street (overhead, double face
advance street signs).

Procedures Committee, to return the tidelands matter to the Council
with no need for action, and staff be asked to keep the Council abreast
