Approval of Minutes - April 28 and May 5, 1969 The Council Minutes of April 28 and May 5, 1969 were approved as distributed. Canvass of Votes -_Genera! Municieal Election May,13 3 1969 Mayor Arnold read the report of May 19, 1969 of City Clerk Klamrn stating that in connection with the general municipal election held on Mav l . ' 969 at which the "Votomatic" punchcard voting system was used, the following documents are submitted for the Council's use in rnaking their canvass: CERTIFICATE OF THE ACCURACY CERTIFICATION BOARD - signed by James A. Hawkinson, Data Processing and Systems Supervisor for the City of Palo Alto, and Ray T. Bennett, Pro- gramming Director for Santa Clara County. RESULTS OF EACH OF THE 41 CONSOLIDATED PRECIZNCTS AND THE CUMULATIVE TOTALS Mayor Arnold appointed Councilmen Pearson and Clark to act as a canvassing beard to examine the documents. (The Council recessed from 7:35 to 7:47 p. rn. for the purpose of making the canvass.) MOTION: Councilman Pearson introduced the following resolution and mo7ed, seconded by Clark, its adoption: Resolution No. 4251 entitled "Resolution of the Council of the City of Palo Alto Declaring the Results of the General Municipal Election Held en May 13, 1969"! with the following figures to be included to indicate the official vote for each candidate and each measure: "(b) The whole number of votes cast in the C}4y at said general municipal election, including votes cant upon absentee ballots was 10,414. _(e)- __ __The total num ber a vote s given and cast at said general municipal election, including votes cast upon absentee ballots, was as follows for the candidates for City Council: John V. Foothills Environmental Design Study MOTION: Councilman Ciark moved, on behalf of the Planning and Procedures Committee, that the. City authorize a contract with the firm of Livingston and Blayney in the amount of $114,000 as Master Consultant for the Foothills Environmental Design Study and the Mayor be authorized to execute the contract on behalf of the City. cuesic-fdUow'e_d-and__City_Menager Morgan, Director o P'ianning and Community Development Fourcroy and Assistant Planning Officer Barker replied to questions concerning the scope of the proposed study and the stages at which the consultant would be reporting back to the Council. AMENDMENT: Councilrnan Bezwald moved, seconded by Wheatley, to amend the contract to include in it or in the exhibit a precise de- lineation of the minimum area to be covered by the study. AMENDMENT OUT OF ORDER: Upon advice of City Manager Morgan that the map of the foothiile previously approved by the Council has been incorporated into the proposed contract, Mayor Arnold ruled the amendment out of order. The motion carried unanimously by voice vote. 419 5/19/69 MOTION: Councilman Wheatley introduced an ordinance amending the 1968-1969 Budget to implement the Foothills Environmental Design Study to provide that an appropriation in the General Fund - Outside Services Account of the Planning Department be increased by the amount of $114,000 and that the Ac.:ount "Transfer to Capital Improvement Fund" be correspondingly decreased and moved, seconded by Berwald, its adoption. (NOTE: the ordinance will be known as Ordinance No. 2501) The ordinance was adopted unanimously by voice vote. Site and. Design Application - 450 San Antonio Road MOTION: Councilman Wheatley moved, seconded by Beahrs, that the Planning Commission recommendation of approval of the appli- cation for Site and Design Control Approval at 450 San Antonio Road subject to certain conditions be continued for one week (May 26, 1969) for the purpose of having the applicant present to respond to questions concerning details of his plan. The motion carried unanimously by voice vote. Miscellaneous Division of Land - 565 Newell Road Mayor Arnold stated he had received requests from persons in the audience who wished to speak concerning the Planning Commission recommendation of approval of the application of Ames, Brophy SE Cranston for Miscellaneous Division of Land. 5f--'i Newell Road, subject to certain conditions. Frederick Michaud, 1505 Hamilton, spoke in opposition to the Planning Commission recommendation and filed a copy of his statement with the City Clerk. ohe P; _Hamra-,_ 6 Phillips Road, speaking for himself and as Vice President of the University and Crescent Park Association, spoke in opposition to the Planning Commission recommendation. Norman Helwig, representative of Ames, Brophy & Cranston, spoke in support of the Planning Cornrnistion recommendation. Discussion followed and Planning Commission Chairman Norton and Director of Planning and Correltiunity Development Fourcroy responded to questions concerning the Planning Commission recommendation, the considerations involved in making the recommendation. the re- quirements for rear .lot subdivisions, the number of such subdivisions in recent years, the minimum square footage lot size required in the zone in questionandthe amount of square footage over that minimum of the lots in the proposed subdivision. MOTION: Councilman Gallagher moved, seconded by Comstock. the recommendation of the Planning Commission be disapproved and the application be denied. ;.... 420 - 5/19/69 MOTION: Councilman Spaeth moved, seconded by Gullixson, that the matter be re -referred to the Planning Commission. 1 MOTION: Councilman Wheatley moved, seconded by Pearson, to continue the matter for three weeks and ask the staff to provide information regarding lot divisions. The motion to continue failed on the following roll call vote: Ayes: Clark, Gallagher, Gullixsort, Pearson, Wheatley Noes: Arnold, Beahrs, Berwald, Comstock, Dias, Spaeth, Discussion continued and Mr. Norton and Mr. Fourcroy replied to questions concerning present requirements for rear lot subdivisions, the number of such applications which may have been granted by the Council because of technicalities, and the total number of such subdivisions in recent years. MOTION: Councilman Spaeth moved, seconded by Gullixson, to re- consider the motion to continue the matter. Under round Utilit District No. 7, race oa eta , raject ,. 64-4 MOTION: Councilman Pearson moved, seconded by Arnold, the adoption of the following ordinance: Ordinance No. 2502 entitled "Ordinance Amending Section 12. 16.020 of Chapter 12.16 of Title 12 of the Palo Alto Municipal Cade by Establishing Underground Utility District No. 7, Old Trace Road et al, Project No. 64-4`° (first reading 4/28/69) The ordinance was adopted unanimously by voice vote. Mutual Fire Protection_ Aid A reennent (CMR:213:9) vommeriam MOTION: Councilman leahrs moved, seconded by Wheatley, that the Mutual Fire Protection Aid Agreement with the California Divi lion of Forestry be renewed and that the Mayor be authorized to ex-ecute the agreement and the resolution. The motion carried unanimously by voice vote. _Easement - Country Club Rancho (CMR:218:9) MOTION: Councilman Wheatley introduced the following resolution and moved, seconded by Spaeth, its adoption: Resolution No. 424 entitled "Resolution of the Council of the City of Palo Alto Declaring Its intention to Order the Vacation of an Easement and Setting a Public Hearing Thereon" The resolution was adopted unanimously by voice vote. Application for On Sale Beer and Wine License - MOTION: Councilman Gullixson moved, seconded by Beahre, to file without action the application for On Sale Beer and Wine License of Peking Restaurant, 3691 LI Camino Real. The motion carried unanimously by voice vote. 422 5/19/69 Application for On Sale Beer License - 4 0nnvers y Avenue (LMR:117:9) MOTION: Councilman Gullixson moved, seconded by Pearson, to file without action the application foe On Sale Beer License of "Take a Break", 483 University Avenue, The motion carried on the following roll call vote: Ayes: Arnold, Clark, Comstock, Dias, Gallagher, Gullixson, Pearson, Spaeth Noes: Beahrs, Berwald, Wheatley Stanford Industrial Park Activity Mayer Arnold observed that there has been a great deal of trouble resulting from demonstrations occuring in Stanford Industrial Park and stated that the problem has been encountered with skill and firrn- ness by the Palo Alto Police Departmentt, Mayor Arnold requested that City Manager Morgan relay the commendation of the entire Council to the Police Department for their handling of a very difficult situation. Mr. Morgan advised that commendation should also be given to the other jurisdictions in Santa Clara and Santa Cruz Counties who provided prompt assistance and to members of the Young Americans for Freedom for their cooperation with police and assistance to those employed in the Industrial. Lit uor License Control MOTION: Councilman Gallagher moved, and it was duly seconded to continue for four weeks (June 16) the Planning Commission recom- mendation regarding control of liquor licenses. The motion carried unanimously by voice vote. A r�eement - Pacific Telekhone and Telegraph Company, ro3ect Wa. bsi-i MOTION: Councilman Berwald moved, seconded by Comstock, to continue consideration of the proposed agreement with the Pacific 423 5/19/69 Telephone and Telegraph Company concerning Miscellaneous Streets Project, No. 67-3 as requested by City Manager Morgan. The motion carried unanimously by voice vote. Human Relations Commission MOTION: Councilman Spaeth moved, seconded by Arnold, to continue the item relating to the Human Relations Commission for four weeks (June 16). The motion carried unanimously by voice vote. Federal Legislation - Local Bonds MOTION: Mayor Arnold moved, seconded by Spaeth that Bond Counsel Jones be directed to draft an appropriate resolution for Council consideration at next Monday's (May 26) meeting to deal with the subject of federal legislation affecting tax exempt status of local bonds. The motion carried unanimously by voice vote. Stanfo- d Student Activity MOTION: Councilman Wheatley moved, and it was duly seconded, that the Mayor write a letter to Stanford expressing the Council's concern over the use of Stanford as a base of operations for breaking of the law. trespassing, ,i.nlawful assembly, obstruction of streets and destruction of property and request that Stanford break its silence on the subject. CHANCE OF MOTION: At the suggestion of Mayor Arnold, Councilman Wheatley changed his motion to have the proposed letter addressed to the Stanford. Board of Trustees. Discussion followed regarding the content of too. proposed letter, and the desirability of advising Stanford of the Council's concern and willing- ness to cooperate and offer suppert to assist in resolving the present problem. SUBSTITUTE MOTION: Councilman Spaeth moved, seconded by Clark, that the Mayor, in the normal course of his responsibilities, be asked to reflect the concern of the Council in the way, and at the time, he deerns appropriate. The substitute motion carried by majority voice vote. City Government Night City Manager Morgan advised that students from Cubberley High School would participate in Student Government Night beginning 6:45 p.m. , on Monday, May 26, 1969. 424 5/19/69 Councilman Berwald commended the staff for their participAtion in the "Job Fair" youth employment program held in East Palo Alto recently. Oral Communications Keith Ferguson, 1082 Cardinal Way, urged the Council to advise the community, the police department, Stanford, the nation and the world that Palo Alto will not 1.alerate the kind of student violence exhibited recently in Stanford Industrial Park.
