The Council of the City of Palo Alto met on this date at 7:30 p. m.
with Mayor Arnold, presiding,
Present: Arnold, Beahrs, Berwald, Clark, Comstock (arrived
7:33 p. m. ), Gullixson (arrived 7:38 p. m. ), Pearson,
Wheatley
Absent: Dias, Gallagher, Spaeth
Approval of Minutes - April 21, 1969
The Minutes of the Council meeting of April 21, 1969 were approved
as distributed.
Hearir_s - Foothills Gas System Pro'ect1 68-82
Mayor Arnold opened the public hearing on the proposed Foothills
Gas System Project No_ 6Q-SZ, -advising that all required notice had
been given and that affidavits to that effect are on file in the Office
of the City Clerk.
Harold May, Chief Engineer, Water -Gas -Sewer Department,
presented the Engineer's Report describing the proposed Project
No. 68-82 and filed the Report with the City Clerk.
City Clerk Klamm reported that protests representing ten lots had
been received from the following: Margaret A. Hansen, 31.39 Alexis
Drive; Sylvia Hackscheid, 2957 Alexis Drive; Donald Kojane, 2987
6..lea..is Drive; Ted A. and Helen R. Arnold, 3124 Alexis Drive;
M. P. Connelly, 3105 Bandera Drive; George McCall, 2927 Alexis
Drive; William and -Elena Lilker, 2935 Alexis Drive; ;hornas and

W. H. Radcliffe, 2930 Alexis Drive, spoke in opposition to the
proposed Project.
There being tic one else present who wished to speak, Mayor Arnold
closed the public hearing.
Bond Counsel Jones and City Engineer Witbeck presented the percent-
age of protest report, stating results as follows:
By acreage - the ten lots represent approximately . 3% of the
total acreage of some 15,062. 71 acres,
By residential lot the ten lots represent about 18% of the total
58 residential lots in the particular area.

Discussion followed and Mr. Jones, Mr. May and Assistant City
Manager Sipel responded to questions about details of the proposed
Project.

MOTION: Mayor Arnold introduced the following resolution and
moved, seconded by Comstock, its adoption:
Resolution. No. 4248 entitled "Resolution Overruling Protests on
R$e solutio—r 'Tote on No. 4230"
The resolution was adopted on the following roll call vote:
Ayes: Arnold, Beahrs, Berwald, Clark, Comstock, Gullixson,
Pearson, Wheatley
Noes: None
MOTION: Mayor Arnold introduced the following resolution and
moved, seconded by Berwald, its adoption:
Resolution No. 4249 entitled "Resolution and Older Adopting
Engineer's Report, Confirming the Asses3merrt and Ordering the
Acquisition"
The resolution was adopted on the following roll call vote:
Ayes: Arnold, Beahrs, Berwald, Clark, Comstock, Gullixson,
Pearson, W heatley

Downtown Palo Alto Inc. Beautification Project

MOTION: Councilman Wheatley moved; on behalf of the Public Works
Committee, that the agreement for the beautification project proposal

it is not the intention of the City to contribute to future projects of
this nature or to the assessment district; that the City's contribution
to this project would amount to 40%_of the total cost; that this con-
tribution would not exceed $6, 000; and that said financial commitment
by Downtown Palo Alto Inc. will be in the amount of at least $9,200.
The motion carried unanimously by voice vote.
Animal Shelter and Control
Councilman Wheatley presented the report of the Public Works
Committee concerning disposition of the shelter and control activities
associated with the anirral shelter.

Gerald Dalrnadge, Director of Field Services, S. P. C. A. , stated
that the filing for deed for the land in Mountain View where the
animal shelter is to bz., -ocated was placed today.
MOTION: Councilman Wheatley moved, on behalf of the Public
Works Committee, that it: regard to the animal. shelter, staff be
directed to draw up an agreement for the transfer of animal care
to the Humane Society upon completion of its facility to be located
in Mountain View; that animal control be maintained by the City
under its present arrangement; further, that staff analyze the
experience of other cities witme + c Ci,iiuty during the next year
pertaining to County control and that they prepare a recommendation
to the Council in conjunction with the 1970-1971 Operating Budget
concerning this control program.
The motion carried unatr.nously by voice vote.
Public Works Committee Assi nrnents
Councilm an Wheatley reported that the Public Works Committee
is keeping abreast of County plans for parking structures and the
City - owned lot in the California Avenue area. Councilman
Wheatley also reported the Committee has the matter of sign plans
for the Baylar.ds under active consideration.

MOTION: Councilman Clark introduced the following resolution
and moved, seconded by Beahrs, its adoption:

MOTION: Councilman Beahrs moved,, seconded by Gullixson, to
approve the contract for the negotiation services in connection
with eminent domain proceedings in the Old Trace Road, et al,
Project No. 64.4 with Castellanos Associates and authorize the
Mayor to execute the agreement on behalf of the City.
The motion carried unanimously by voice vote.

Award of Bids - Civic Center Communications
Equipment (CMT205:9)
MOTION: Councilman Comstock moved, seconded by Beahrs, to
accept the bid of Spartan Engineering in the amount of $29, 517
covering cost of operating consoles and related ancillary equipment
for the Communications Center in the new Civic Center, and that
the Mayor be authorized to execute the contract on behalf of the City -
The motion carried unanimously by voice vote.

MOTION: Councilman Pearson moved, seconded by Clark, adoption
of the following ordinance:
Ordinance No. 2500 entitled "Ordinance of the Council of the
City of Palo Alto Amending Section 18. 88.1 10 of the Palo Alto
Municipal Code and Adding Section 18. 88. 110 to the Palo Alto
Municipal Code Regulating Improvement and Maintenance of
Certain Paved Areas" (first reading 4/7/69), (continued for
second reading from 4/11/69)
The ordinance wan adopted unanimously by voice vote.
Right to Fair and Impartial Hearing
Councilman Pearson read her letter of May 5, 1961 concerning her
objection to the advice given by City Attorney Hildebrand to Council.
candidates regarding the right to a fair and impartial hearing, with
particular reference to the pending zoning application in connection- —
with the_proposed Merlirat Resear: kFoi.0 ation Hospit -1.
Comment from Council members followed regarding the desirability
of candidates not taking an unalterable position on pending zoning
applications in advance of the hearing and presentation of testimony
in the event they should be required to make judgment as councilmen;
the need for Council to take action which will withstand challenge in
the courts; that Mr. Hildebrand discharged his duty well in advising
candidates that their campaign statements may affect their ability
to take part in a fair and impartial hearing, should they be elected;
and reference was made to a relevant case (Saks le Company vs City
of Beverly Hills) cited by Mr. Hildebrand in his letter of May 1, 1969
on the subject.
May Fete
Councilman Comstock commended the City staff and, in particular,
the Department of Community Services for the fine May Fete production
on May 3, 1969 and urged councilmen to visit the Youth Art Exhibit.

Municipal Legal Studies Center
Councilman Wheatley brought to the attention of the Council material
he had received from the Municipal Legal Studies Center of Dallas,
Texas. Mayor Arnold requested that City Clerk Klamm obtain
copies of the information for the entire Council.
Finance Committee Meetings
Councilman Berwald announced that the Finance Committee will
meet at 7:30 p, m. on Tuesday, May 20 and Tuesday, May 27 for
further consideration of the 196 9.70 Operating Budget and the
Capital Improvement Program.
Cancellation of Council Meetin of Ma 12, 1969
MOTION: Mayor Arnold moved, saconded by Clark, to cancel the
Council meeting scheduled for Monday, May 12, 1969.
The motion carried unanimously by voice vote.
PublicWorksCommittee Ajenda - May 15, 1969
Councilman. Wheatley announced that in addition to the subject of low
income housing, the proposed anchorage of a ship at the Yacht Harbor
will be considered at the Thursday, May 15, 1969 sheeting of the
Public Works Committee.
