Present: Arnold, Beahrs, Berwald, Clark, Comstock (arrived 7:40 p. rn.. ), Gallagher, Pearson Absent: Dias, Gullixson, Spaeth, Wheatley A royal of Minutes of March 24, 1969 Councilman Pearson requested that the Minutes be corrected to indicate her "No" vote on page 379 on the motion as amended relating to parking proposals. There was no c')iection. The Minutes of March 24, 1969 were approved as corrected. Moratorium - Buildin{Q� Per mils four Convalescent Hospitals �Y�in-.w�.w..Y"�""' C •w1.'.n'i1110�1. 11Vi MOTION: Mayor Arnold introduced the following ordinance and moved, seconded by Pearson, its adoption: Ordinance No. 2494 entitled "Ordinance of the Council of the City of Palo Alto Suspending Issuance of Building Permits in Certain Zoning Districts Pending Planning Commission Study and Recommendations to the Council and Declaring an Emergency. MOTION: Councilman Pearson moved, seconded by Comstock, to uphold the recommendation of the Planning Commission sand deny the application of Ellsworth W. Peterson, Henrietta M. Peterson, Edward G. Vierra and Mitchell V1 Hunt for a change of district of property,- known as 689, 691 and 693 Arastradero Road from R -1:B-10 (Single Family Residence: Special Building Site District Regulations) to R -3-D (Neighborhood Apartment District: Design Control District Regulations) and/or such other district(s) as the Planning Commission may recommend. The motion carried unanimously by voice vote. ft 385 4/7/69 Colorado Avenue Metering Station � i �ar�aai.�s�asnv�^�s7 S MOTION: Councilman Beahrs moved, seconded by Berwald, to continue the Planning Commission report on the proposed expansion of Colorado Avenue Metering Station until the report of the Finance Committee is made. CHANGE OF MOTION: Upon advice of Director of Planning and Community Development Fourcroy that the Planning Commission report states only that the proposed expansion of the metering station is in conformity with the interest of the General Plan, Councilman Beahrs changed the motion to receive the report at this time. Mayor Arnold then restated the motion indicating it is to receive the report at this time. The motion carried unanimously by voice vote. Rescind - Clemo Avenue Project No. 66-7 MOTION: Councilman Clark introduced the following resolution and moved, seconded by Comstock, its adoption: Resolution No. 4226 entitled "A Resolution Rescinding Resolution Nos. 3921, 3922 and 3923, Ciento Avenue Project No. 66-7" The resolution was adopted unanimously by voice vote. Communications - Council Procedure MOTION: Councilman Berwald moved, seconded by Pearson, adoption of the following ordinance: Ordinance No. 2495 entitled "Ordinance of the. Council-of,the City of Palo Alto Amending Section 2.04:050 of the Adminis- trative Code Pertaining to Communications to the Council (first reading 3/24/69). The ordinance was adopted unanimously by voice vote. Pacific Gas AC Electric Company Rate Increa'e (CMR:177:9) MOTION: Councilman Beahrs introduced the following resolution and moved, seconded by Comstock, its adoption: Resolution No. 4227 entitled "Resolution of the Council of the City of Palo Alto Amending Schedules G-1 and G -1-Q of the City of Palo Alto Utilities Rate Schedule. " The resolution was adopted unanimously by voice vote. 386 4/7/69 Interim Flood Control Project - San Francis • uito Creek (CMR:178:9) Mayor Arnold advised that Councilman Gallagher will represent Palo Alto at the April 22, 1969 public hearing on the matter of the Proposed Interim Project for Flood Control on San Francis,. . quit() Creek. Use of San Antonio Over ass b Pedestrians and Bicyclists LMR: • • MOTION: Councilman Pearson introduced the following ordinance and moved, ed, seconded by Comstock, its approval for first reading: "Ordinance of the Cou:icil of the City of Palo Alto Amending Sections 10. 64. 180 and 10. 32. 040 of the Palo Alto Municipal Code to Permit Pedestrian and Bicycle Traffic on San Antonio Road Overpass' The ordinance was approvi-d unanimously by voice vote. Applicati'bn!for On -Sale General Alcoholic Beverage License 2118 St. Francis Drive (CMR:185:9) MOTION: Councilman Gallagher moved, seconded by Beahrs, that the staff be directed to prepare an official protest to the Alcoholic Beverage Commission with regard to none -issuance of license to "The Hideaway", 2118 St. Francis Drive, for signature by the Mayor. In response to question, City Attorney Hildebrand advised that his office prepares such protests which the Mayor may or may not sign. Mr. Hildebrand further advised that a representative of his office will then appear at the full scale hearing to present the City's protest against issuance of the license, but that -indiv- iduals may make protest direct to the ABC on their own behalf. City Manager Morgan and Mr. Hildebrand both advised that the recommended City protest would be based on zoning as outlined in the City Manager's report (CMR:185:9). The notion carried unanimously by voice vote. Oregon Avenue Landscaping (CMR:179:9) MOTION: Councilrrae Berwald moved, seconded by Beahrs, that the Council authorize the Mayor to direct a letter to the Santa Clara County Board of Supervisors requesting consideration of landscaping maintenance of Oregon Avenue Expressway in detail as provided for in the last paragraph of the City Manager's report (CMR:1?9:9) It seems that the best approach is for the City Council to appeal to the Board of Supervisors, asking that the County either take over the Oregon Avenue landscaping maintenance or contribute financially toward present maintenance in a degree commensurate with maintenance casts on other County expressway landscaping programs. The staff recommends that Council make such an appeal by authorizing the Mayor to direct a letter to the Board of Supervisors, requesting its consideration of this matter. The motion carried unanimously by voice vote. Pol Department Orjanization and Staffing (CMR:180:9) City Manager Morgan presented his report on an organization and staffing plan for the Police Department, stating that he is doing so at this time rather than i:icluding it in the 1969-70 budget in order to save the 60-90 days' time before July 1, 1969, MOTION: Councilman Comstock moved, :seconded by Berwald, that the Council approve the recommendation of the City Manager to establish the positions as described in the report (CMR:180:9) as follows: Coordinator of police c -,rnmunity relations (lieutenant); Coordinator of research and training; Personnel Officer (sergeant); Rotating watch commander (lieutenant). MOTION: Councilman Comstock introduced the following resolution and moved, seconded by Beahrs, its adoption: Resolution No. 4228 entitled "Resolution of the Council of the City of Palo Alto Amending Resolution No. 4126 Adopting a Compensation Plan by Adding a New Classification to the Salary Schedule." The resolution was adopted unanimously by voice vote. Foothills Gas S stem Extension Pro}ect No. 68-82 (CMR:183:9) MOTION: Councilman Pearson introduced the following resolutions and moved, seconded by Comstock, their adoption: Resolution No. 4229 entitled "Resolution Determining to Undertake Proceedings Pursuant to the Palo Alto Municipal Code for the Acquisition of Improvements Without Proceedings Under Division 4 of the Streets and Highways Code." Resolution No. 4230 entitled "Resolution of Intention to Acquire Improvements." Resolution No. 4231 entitled "Resolution of Preliminary Approval of Engineer's Report. " Resolution No. 4232 entitle: "Resolution Describing Proposed B-undaries of Assessment District, Directing Filing of Map and Directing Recordation of Notice of Assessment and Assessment Diagram." Resolution No. 4233 entitled "Resolution Appointing Time and. Place of Hearing Protests in Relation to Proposed Acquisitions and Directing Notice." and setting the Hearing for May 5, 1969. City Engineer Witbeck filed the Engineer's Report with the City Clerk and advised it is available for inspection in the Clerk's office. The resolutions carried unanimously by voice vote. "G" Bond Assessment Proceedings MOTION: Councilman Cta rk introduced the following ordinance and moved, seconded by Pearson, its approval for first reading: "Ordinance Amending the Palo Alto Municipal Code Relating to Special Assessment and Assessment Bond Procedure-:. " The ordinance was approved unanimously by voice vote. Downtown Libra /Recreation Center (CMR:184:9) MOTION Councilman Pearson moved, and it was duly seconded to delay consideration of the Downtown Library/Recreation Center -until-arrival of—WIIIYarr Busse, the -architect: _: The motion carried unanimously by voice vote. Freeway Vocation and Design '�:i 7 +i 771 MOTION: Mayor Arnold moved, seconded by Comstock, that the Council go on record in support of the Federal and State procedures adopted by the previous administration in Washington, D, C. urgingethe present administration to adopt, rather than change or rescind, the new Federal regulations which give city and county governments additional effective influence in freeway route and design decisions. Mayor Arnold indicated that if the motion carries, he will direct an official endorsement to the Secretary of Transportation and the Federal Highway Administrator. The motion carried unanimously by voice vote. Downtown Librar '/Recreation Center (CMR:184:9) MOTION: Councilman Pearson moved, seconded by Beahrs, to lift from the table the report concerning final plans for the Downtown Library/Rec reation Center. The motion carried unanimously by voice vote. In response to question concerning possible development of either a roof garden or a second floor and future need for an elevator, William Busse, architect for the building, advised a deep pit could be provided row. »Hair the skylight for a future elevator, or a cold joint could be made in that area for the sarne purpose, and that provisan for a plunger could also be made at this tine. Mr. Busse adv:eed that cost for preparation plus design could be expected to be about $5,000 now with a total anticipated cost for the entire system about $15,000 or more later. (Councilman Berwald left at 9:00 p. m.) MOTION: Mayor Arnold moved, seconded by Beahrs, to approve the final plans for the Downtown Library/Recreation Center and authorize the initiation of bidding procedure at this time. AMENDMENT: Councilman Pearson n-.oved, seconded by Comstock, to provide an add alternate for the possibility of a future elevator. CLARIFICATION: City 'Manager Morgan requested that it he understood in including an add alternate for the possibility of a future elevator that reference be made to the $5, 000 estimate by the architect. The amendment carried unanimously by voice vote. The ;*notion as amended carried unanimously by voice vote. Southe t n Pacific Agency Station City Attorney Hildebrand referred to his report of April 3, 1969 advising that Southern Paci' `intends to close its Palo Alto station at 6:30 p. m. daily rather than the present 10:00 p.m. Mr. Hildebrand indicated the purpose of his report is simply for information on a service which may be of interest to commuters, and no action is required or recommended. Paved Areas - Service Station Site and Desi n Control Virgil McNab, Western Oil and Gas Companies, urged that the barrier requirement in Section 2, 18. 88. 120(a) in the proposed ordinance relating to paved areas be eliminated. Mr. McNab replied to questions concerning desirability of such barriers. -390 4/7/69 (Councilman Berwald returned at 9:14 p.m.) MOTION: Councilman Comstock introduced the following ordinance and moved, seconded by Beahrs, its approval for first reading including "(f)" contained in the report of the City Attorney of March 28, 1969: (f) . 'P -C'. and -D' Districts. Subsection (c) pertaining to plan review and approval procedures for paved areas shall not apply in any F' -C district or any district which is com- bined with a '-D' district. In any P -C district applicant shall follow the procedures set forth in Chapters 18.68 and 18. 98. In any district subject to the regulations of Chapter 18. 82(d) (`-17' Districts), applicant shall follow the procedures set forth in Section 18. 82. 010. The Planning Commission and the City Council shall be guided in those procedures by the standards of this section regarding paved. areas." "Ordinance of the Council of the City of Palo Alto Amending Section 18. 88. 110 of the Palo Alto Municipal Code and Adding Section 18. 88. 120 to the Palo Alto Municipal Code Regulating Improvement and Maintenance of Certain Paved Areas. " Councilman Berwald advised he will not vote on either of the proposed ordinances relating to service stations and paved areas. The ordinance was approved unanimously by voice vote, Councilman Berl. ald abstaining. MOTION: Councilman Comstock introduced the following ordinance and moved, seconded by Gallagher, its approval for first reading: 'Ordinance of the Council of the City of Palo_. Alto Amending Title 18 of the Palo Alto Municipal -Code to Require Site and Design Control for Gasoline Service Station." The ordinance was approved unanimously by voice vote, Councilman Berwald abstaining. Juvenile Delin uenc Prevention Project - Navy hip (ri iR:17 :9) MOTION: Coun,:ilrnan Gallagher moved, seconded by Beahrs, to accept the recommendation of the City Manager that the report received from W. A. Eldredge on the use of a former Navy ship in a juvenile delinquency prevention project be referred to staff for study with their report to go to the Public Works Committee for subsequent action by Council. The motion carried unanimously by voice vote. 39 4/7/69 Oral Communications Walter Stromquist, 3418 Thomas, Palo Alto, P1annng Commission member, representing the American listitute of Architects of Santa Clara County called attention to their bcokiet entitled "The Case for Open Space" which had been distributed to the Council. Roland Finston, 856 Thornwood, Palo Alto, stated that • some darnage had been done to cars parked with perrnission in a school lot while their drivers were bussed to San Francisco to participate in a demonstration, although police had been notified arid special protection requested. In response to question, City Manager Morgan advised that in the event a special request for surveillance is made, police patrols are informed and will patrol the area; if continuous special policing is required, the City will cooperate in obtaining it, usually through the police reserve, as is most common for City and school affairs, but that a beat officer may not be assigned for the private use of a private group. Mr. Morgan suggested that anyone requiring unusual or special protection or having a complaint regarding surveillance should first pursue the subject with someone of command rank in the Police Department.
