The Council of the City of Palo Alto met on this date at 7:30 p. m.
with Mayor Arnold presiding.
Present: Arnold, Beahrs, Berwald, Clark, Comstock,
Guliixson, Pearson, Spaeth, Wheatley
Absent: Gallagher
Approval of Minutes - January. 27, 1969
Mayor Arnold asked that on page 339, line 19 of the Minutes regard-
ing low income housing be corrected to include the phrase "in or
near the Stanford Industrial Park" in the motion. There were no
objections.
Councilman Wheatley asked that in his second motion on page 334
that "and that improvements be made in the Mayfield pedestrian
underpass to accornn-iodate bicycles" be deleted and "and that improve-
ments be made in the Mayfield underpass for pedestrians. " be sub-
stituted. There were no objections.
Vice Mayor Dias asked that in the first paragraph on page 332 regard-
ing the convention center study that it be included that Palo Alto's
share of the proposed Stanford Research Institute study would be
$900.00. There were no objections.
Vice Mayor Dias asked that in the first paragraph on page 336 regard-
ing the naming of alleys thzt City Manager Morgan's statement that
addr ses are not permitted on alleys in accordance with Council
policy and street standards be included. There were no objections_
In response to question, Vice Mayor Dias was advised that the Council
has approved use of Votornatic equipment for the forthcoming May
general municipal election as indicated on page 333 of the Minutes.
The Minutes of the Council meeting of January 27; 1969 were then
approved as corrected and amended.
United Jewish Communit , 3573 .'iiddlefield jlatd
Mayor Arnold requested that the Council first hear from any members
of the public who wish to speak regarding the application of the United
Jewish Community Center to establish a center at 3573 Middlefield
Road.
Charles Gordon, attorney representing the United Jewish Community
Center, and the South Peninsula Jewish Community Center, spoke in
support of granting the application for a use permit for a Jewish Com-
munity Center at 3573 Middlefield Road, and asked that the Planning

Commission's recommended condition that maximum occupancy of
Seel Page Buildings A and B -E shall be 30 persons be amended to "30 persons
365 each or a total of 60 person". Mr. Gordon responded to question
from the Council concerning intended use of and maintenance of
landscaping at the site.
Discussion followed and City Attorney Hildebrand and Assistant
Planning Officer Barker responded to questions concerning recom-
mended conditions of use.
Nick Kuhn, 746 Christine Drive, Palo Alto, speaking for residents
of Christine Drive which faces the proposed community center
property, spoke in opposition to granting the use permit, and urged,
that if the permit is granted, then adequate provision be made for
suitable landscaping of the rear area.
MOTION: Councilman Berwald moved, seconded by Beahrs, to
uphold the Planning Commission and grant the appeal of the United
Jewish Community Center from the decision of the Assistant Zoning
Administrator to deny an application for a use permit for .a community
center at 3573 ;Middlefield Road, Zone District R- 1 :B -S (Single
Family Residence: Special Building Site District Regulations) with
the following conditions:
1. landscaping and screen planting shall be true -to -name,
first class nursery stock and shall be installed in accordance
with the approved plan prior to use or occupancy of the
premises. Screen shrubbery shall be not less than
5 -gallon -can -size and trees shall be not less than 15 -gallon -
can -size. Landscaping shall be permanently maintained
and replaced as necessary. Additional landscaping to pro-
vide screening protection to adjacent property shall include
increase of trees northwest of Building B -E, extending
shrubbery screening along the northwest property line up
to Building C, and Iscreening along the southeast fence line
extending from Building A t -o the proposed parking ____
Provision shall be made for irrigating all planted areas.
If a permanent, in place, watering system is not provided,
hose hibbs shall be located so that no portion of any planted
area is more than fifty feet from one or more hose bibbs;
2. the parking area and driveway sha:- be provided prior to
ewe and occupancy of the pre.nises and no occupancy or
use of the property whatsoever shall be permitted until
the applicant has established to the satisfaction of the
office of the City Attorney its right to use the adjoining
8 feet of the adjoining church property on the south (Bethel
Temple Pentecostal Church of God) so that the driveway
shall be 16 feet wide and until the full required 16 feet is
actually improved to City requirements;
3. that there be no access whatsoever to Christine Drive;
4 that ma.ximum occupancy of Buildings A and B -E shall be
30 persons;

5. that the use of Building B -E shall be limited to activities
that do not produce or involve music or noise;
6. that the use permit shall terminate upon the sale or other
alienation of the land by the applicant;
that the existing Bu.iid:ng B -E be repainted or stained,
including the roof, in an acceptable color;
8. that all buildings be altered as necessary to comply with
the Building Code and Occupancy requirements;
9. that all construction, development and use of the property
shall comply with all applicable Codes and Ordinances
including the Uniform Fire Code of the City of Palo Alto
and the State of California Administrative Code, Title 19,
Public Safety;
10. that the perrnittee shall not prevent any City peace or fire
prevention officer, building official or inspector charged
with the duty of enforcing the laws of their jurisdictions
from having free access to the premises at all reasonable
times;
11. that commencement of construction under this use permit
shall be deemed an agreement on the part of the owner,
their heirs, successors and assigns to coznply with all the
terms and conditions of this use permit,
AMENDMENT: Mayor Arnold mo°.ed, seconded by Comstock, to
add to condition No. 4 "each"; to delete condition No. 10 as that
condition should depend on the law as it applies to any use of the
building; to renumber condition No. 11 "condition No. 10"; and to
delete "or noise" from condition No. 5.
The amendment carried unanimously by voice vote.
AMENDMENT: Councilman Berwald moved, seconded by Comstock,
to add a condition No. 11 to provide for a sprinkler system in the
area between the rear fence and Christine Drive.
The amendment carried by majority voice vote.
AMENDMENT: Councilman Pearson moved that "which will inter-
fere with the neighbors" be added to condition No. 5.
The amendment failed for lack of a second.
AMENDMENT: Councilman Pearson moved that the roof of Build-
ing B -E be required to be covered with shingles.
The amendment failed for lack of a second.

AMENDMENT: Councilman Clark moved, eecondedby Dias, that
an amortization period for the Building B -E be set for a limit of
ten years maximum at which time the building would have to be
removed.
The amendment failed oa 1.he following roll call vote:

Noes: Arnold., Beahrs, Berwald, Comstock, Gullixson,
Pearson, Spaeth
AMENDMENT: Councilman Wheatley moved, seconded by Comstock,
to add another condition that shake or comparable roof be added to
Building B -E within a two year period.
CLARIFICATION: Councilman Wheatley stated that "comparable
roof" is intended to mean a residence -type roof.
The amendment carried on the following roll call vote:
Ayes: Beahrs, Berwald, Dias, Gullixson, Pearson, Spaeth,
Wheatley
Noes: Arnold, Clark, Comstock
The motion as amended carried unanimously by voice vote.

Skyline National Parkway
MOTION: Councilman Spaeth introduced the following re solution
and Moved, seconded by Pearson, its adoption:
Resolution No. 4208 entitled "Resolution of the Council of
the C1ty of Palo Alto Urging Adoption of 14. R. 1149 Presently
Pending in the United States House of Representatives, Which
Legislation Would Authorize a Skyline National Parkway Along
the Crest of the Santa Cruz Mountains"
The resolution was adopted unanimously by voice vote.
(Councilman Corn stock returned at 9:33 p. m.)
Narning of Public Facilities
MOTION: Councilman Clark moved, on behalf of the Public Facilities
Naming Committee, that the Council officially adopt the following
names for the new public facilities:
1. Foothills Park Nature Interpretive Center

2. Baylands Nature Interpretive Center
3. Mitchell Park Community Center
4. Josephine O'Hara Exhibit Room (Junior 2kAugeuen)
5. Lucy Stern Community Center
The motion carried unanimously by voice vote.
Human Relations Commission
MOTION: Councilman Berwald moved, seconded by Spaeth, the
adoption of the following ordinance:
Ordinance No. 2485 entitled "Ordinance of the Council of
the City of Palo Alto Adding Chapter 2. 22 to the Palo Alto
Municipal Code to Be Designated "Human Relations Commission"

The ordinance was adopted unanimously by voice vote.

MOTION: Councilman Wheatley moved, seconded by Pearson,
the adoption of the following ordinance:
Ordinance No. 2486 entitled "Ordinance Amending Section
12. 16. 020 of Chapter 12.16 of Title 12 of the Palo Alto
Municipal Code by Establishing Underground Utility District
No. 1 1 , Project 68-83" (first reading 1127/69)
The ordinance was adopted unanimously by voic vote.

Underground Utility Districts Nos. 9 and 10, Project 67-3"
The ordinance was approved for first reading unanimously by voice
vote.

Flashing and Moving Signs
MOTION: Councilman Clark introduced the following ordinance
and moved, seconded by Dias, its approval for first reading:
"Ordinance of the Council of the City of Palo Alto Amending
Chapter 16. 20 of the Palo Alto Municipal Code (Signs) Pro-
hibiting Flashing and Moving Signs"
AMENDMENT: Councilman Comstock moved, seconded by Clark,
to amend SECTION 2, Chapter 16. 20. 105 to del&ce "except that
those signs which revolve or rotate at less than ten (iu) revolutions
per minute shall be allowed."
The amendment carried on the foliowing roll call vote:

MOTION: Councilman Wheatley moved, and it was duly seconded,
to accept the low hid of Steiny and Mitchell Company in the amount
of $19, 996.00 for a standard traffc__ signal installation at Stanford__
-
Avenue at Hanover/Escondido and that the Mayor be authorized to
sign the contract on behalf of the City.
The motion carried unanimously by voice vote.
On -Sale General Alcoholic Beverage License -
MOTION: Councilman Beahrs moved, seconded by Comstock, to
file without action the app'icaticn of Cal Hof Brau, 321 California
Avenue, for an On -Sale General Beverage License.
The motion carried unanimously by voice vote.
Medical Use Zones
MOTION: Mayor Arnold moved, seconded by Pearson, that the
Planning Commission be directed to review the subject of medical

uses permitted in the R -3:P and R-4 zone districts with the objective
of avoiding undue concentratic:n of such uses.
Councilman Spaeth neither participated in the discussion nor voted
on the motion.
The motion carried unanimously by voice vote, Councilman Spaeth
abstaining.

There being no further business, the Council adjourned at 9:45 p. m,
