The Minutes of November 16 were approved as written, with the above addition. Councilman Dias requested that on page 477, Minutes of November 23, "Sale of Raw Milk", the record show she did not second the motion but that it was duly seconded, Manor Wheatley noted on pages 474 and 475, Gage -Babcock Fire Pro- tection Study, the motions were made on behalf of the Finance Com- mittee, no second being required, his second to the two motions were to be deleted accordingly, The Minutes of November 23 were approved as corrected. Youth Advisory Council aarirrr+r+r rr�orsM,riw�eaw�rr�see� MOTION: Councilman Dias, on behalf of the Planning and Procedures Committee, introduced the following resolution and moved its adoption: Resolution No. 4406 entitled "Resolution of the Council of the City of Palo Alta Amending Resolution 4334, Which Established a Youth Advisory Council, to Make Certain Changes in Organization and Procedures" Paul Staley, Chairman of the Youth Advisory Council, advised the City Council that the Youth Advisory Council had approved the resolution as pre.ented, and indicated be was preparing on behalf of the Youth Advi- sory Council an annual report to be presented to the Council. 480 12/14/70 AMENDMENT: Councilman Pearson moved, seconded by Spaeth; to T� amend the resolution by deleting Section 4(c) "Failure to Attend Meetings." The amendment failed by a majority voice vote. AMENDMENT: Councilman Pearson moved, seconded by Spaeth, to amend the motion to delete the last line of Section 5: "Each appoint- ment shall be confirmed by the Youth Advisory Council," The amendment failed by a majority voice vote. Central Palo Alto Study, (CMR:706:0, 686:0) (CMR:578:0, 322:0) MOTION: Councilman Dias moved, on behalf of the Planning and Procedures Committee, endorsernent of the concept for the Central Palo Alto Area Planning Study specifically the program that involves use of a consultant, and adoption of the Work Plan as presented and See Page amended at the November 17, i970 Committee Meeting. 494 MOTION: Councilman Ber ,Heald moved, duly seconded,'to hear from the public although there is a motion before the Council. The motion carried by unanimous voice vote. David Wright, 244 Oxford, spoke against the study indicating resi- dents felt it would be commercially oriented: Councilman Norton arrived at 7:50 p.m. MOTION: Councilman Spaeth moved, seconded by Beahrs, to refer the matter back to the Planning and Procedures Committee for at least one more meeting of that Committee. The motion was approved by a majority voice vote. (NOTE: A motion to refer takes precedence.) Municipal Service Center Phase II Master Plat MOTION: Councilman Clark moved, on behalf of the Public Works Comrnittee, (a) to accept the Master Plan as submitted with the understanding that the Master Plan be viewed only as a general guide and not as a precise plan or program commitment, and (b) authori- zation to negotiate a contract with Paul Huston to prepare plans and specifications for the Animal Shelter facility and the General site •nch + %irgsis G'CL TV &i&&, fencing', and toss ei3 an`s.sy. 481 12/14/70 AMENDMENT: Councilman Pearson moved, to amend the motion that the CATV Expansion and Animal Shelter Expansion be deleted. The amendment failed for lack of a second. Mayor Wheatley asked if there were objections to hearing from the public. There were -no objections. Charles Noble, 2676 Cowper Street, asked about the proposed time table for construction of the animal shelter. Mayor Wheatley asked if there were objections to voting separately on the two items. There were no objections. The motion to accept the Master Plan carried by the following roll call vote: Ayes: Arnold, Beahrs, Berwald, Clark, Comstock, Dias, Gallagher, Norton, Spaeth, Wheatley Noes: Pearson The motion to authorize staff to negotiate a contra.ct with Paul Huston to prepare plans and specifications carried by unanimous voice vote. Tentative Subdivision MaL, 4450 Weet Bayshore Road MOTION: Councilman Arnold moved, seconded by Berwald, to uphold the recommendatiol of the Planning Commission and approve the appli- cation for tentative condominium subdivision map - Alpha Land Com- pany located at 2450 West Bayshore Road. The motion carried by a majority voice vote. Santa Clara Courty Solid Waa�te Stud See Page Representative to the Planning Policy Committee of Santa Ceara 494 County, Vice Mayor Gallagher, reported on the proposed two-phase solid wa$te- study to be undertakers with aa�:.h city of the County con- tributing funds for Phase 1 of the study, Phase II to be financed by an anticipated grant from the U.S. Health, Education and Welfare See Page Office. 494 The report was received. 1 482 12/14/70 Accessory Cornmercial Service Uses in the R-4 District with a Use Permit MOTION: Councilman Beahrs introduced the following ordinance and moved, seconded by Comstock, its approval: Ordinance No. 2590 entitled "Ordinance of the Council of the City Palo Alto Amending Section 18. 26. 030 of the Palo Alto Municipal Code to Allow Certain Accessory Commercial Service Uses in the R-4 District with a Use Permit=" (first reading 11/23/70) The ordinance was adopted by the following roll call vote: Ayes: . Police Data Processin Contract (CMR:701:0) MOTION: Councilman Berwald moved, seconded by Comstock, to approve an agreement with Consolidated Information Company for a police data processing study (not to exceed $2,100 for Phase I and $13,000 for Phase II) for a total expenditure not to exceed $15, 100, and the Mayor be authorized to execute the contract on behalf of the Council. MOTION: Councilman Berwald moved, duly seconded, to hear from the public although there is a motion before the Council.. The motion carried by unanimous voice vote, Dan Feshback, 626 Wellsbury, asked that the study for the police data processing system be rr►ade by a citizens group. MOTION: Councilman Pearson moved that the study be referred to the Finance Committee. The motion died for lack of a second. The motion to approve an agreement with Consolidated Information Company carried by unanimous voice vote. Traffic Si nal and Safe Li htin ion • rovements Bid Report (CAR: • 96:0) MOTION: Councilman Comstock moved, seconded by Wheatley, to accept the low bid from the Central Valley Electric, Inc. for traffic signal and safety lighting improvements at eight intersections and authorise the Mayor to execute a contract on behalf of the Council. The motion carried by unanimous voice vote. ( The Council recessed from 9:15 to 9:30 p.m.) Accessory Commercial Service Uses in R-4 District with a Use Perrnit Councilman Berwald requested that his "No" vote on Ordinance No. 2590 be changed to a "Yes" vote. ( NOTE: See _page 483.) There were no objections. Buildin Code: Demolition Permit Mayor Wheatley asked if there were objections to taking this matter out of order at this time. Sean Hobson, 656 Channing, representative of the Palo Alto Tenant's Union, presented a statement to the Council objecting to the demoli- tion of low cost housing. Rose Fonseca, 648 Channing, spoke against deraolition of houses in the area of Addison School, Bob C'allenbine, 2875 Ramona, spoke in favor of low cost housing. There was a disruption in the Chambers at this time and Mayor Wheatley requested City Attorney ,Stone to advise those present of the legal aspects of the situation. City Attorney Stone stated "The meeting at the present time is being disrupted and the Council may recess. Those disrupting the meeting___ are guilty of a misdemeanor and it they continue to disrupt the meeting the Mayor is empowered to order their arrest." Order was restored in the Chambers. The ordinance re demolition permits was adopted by the following roll calm vote: Ayes: Arnold, Beahrs, Berwald, Comstock, Gallagher, Nortm, Pearson, Wheatley Noes: Dias The ordinance was approved by a 4/S vote. " Discussion followed concerning the area to be defined for the open space boundaries. AMENDMENT: Councilman Dias moved, seconded by Beahra, to arnend Amendment No. 2 to the Agreement to include on page 3, item 1, paragraph (d) the words "within the sphere of influence of Palo Alto." The amendment carried by unanimous voice vote. AMENDMENT: Councilman Dias moved, seconded by Berwald, to amend Amendment No. 2 to the Agreement to include a new section (f) under 1. Effectuation Studies and Recommendations, which would further direct Livingston and Blayney to pursue other alternatives to public acquisitions as contained in sections (d) and (e) for the pre- servation of the properties as open space. The amendment carried by unanimous voice vote. SUBSTITUTE MOTION: Counc=lenar. Spaeth moved, seconded by Comstock, that the staff transmit the amendments, negotiate them, and complete those phases of the contract which a' -e not hi diespite at the earliest possible date, preserving those items that cannot be agreed upon for future Council action; the objective to be that of getting Mr. Livingston underway at the earliest possible date. See Page 494 CLARIFICATION OF SUBSTITUTE MOTION: Approval of the amended contract No. 2 with the amendments node this evening to be► presented to Livingston and Blayne) and, if acceptable, the contract as amended be executed, with the provision if the amendments made this evening are not acceptable to Livingston and Blayney, staff to negotiate and report back to Council for a possible further amendment to the contract. Panning and Community Development Director Fourcroy clarified that the intent of I(b), and i (c), in the agreement "Stanford University► Land Use Policy/Plan Study„ is a reference to the study Mr. Livingston le doing for Stanford University and is not necessarily now, nor will be, the land use plans of Stanford University. MOTION; Councilman Berwald moved, duly seconded, to hear from the public. The motion carried by unanimous voice vote. 487 12/14/70 1'llJill1G1.6L LT-....kc, 31?2 Emerson, representative of the Palo Alto Civic League, spoke in favor of having the entire 500 acres of Stanford Land be studied in the Livingston and Blayney report. MOTION: Councilman Berwald moved, seconded by Comstock, that staff explore with Livingston and Blayney the matter of provision of open space and access corridors through Stanford lands to the lands below the park and that the consultant give the Council recommenda.- dons on the means of achieving that goal. The motion carried by a majority voice vote. Willow Road Ex.ressway - Location of Land P dicated for Park Purposes MOTION: Councilman Pearson moved, duly seconded, that staff prepare an ordinance to formally dedicate as a city park the strip of land along San Francisquito Creek conveyed by Timothy and Mary Hopkins in 1907 to the City of Palo Alto for a public park. The motion carried unanimously, Change of District - 690 San Antonio Road MOTION: - Councilman_ c3eahrs introduced the following ordinance and moved, seconded by Arnold, its approval for first reading: "Ord:nance of the Council of the City of Palo Alto Arnendi g Section 18. 0&040 of the Palo Alto Municipal Code Changing the Zoning of Certain Property Known as 690 San Antonio Avenue from P -C and L-M:S-D to P -C" MOTION: Mayor Wheatley moved, duly seconded, to hear from the public although there is a motion before the floor. The motion to approve the ordinance for first reading carried by unanimous voice vote, Transportation Policy Committee MOTION: Councilman Comstock moved, seconded iy Gallagher, to continue this item until the next Council meeting. The motion carried by unanimous voice vote. Sale of Raw Milk (CMR:691:0) Phil Parenti, 250 California Avenue, spoke in favor of permitting the sale of raw milk in Palo Alto. 488 12/14/70 MOTION: Councilman Comstock moved, duly seconded, to direct staff to prepare a revision of the present ordinance to delete the prohibition of the sale of raw milk in Palo Alto. The motion failed by a majority voice vote. Coyote Hill Land Division Mayor Wheatley left the Chamber at 11:35 p. m. Councilman Arnold presided for the discussion and action on the Coyote Hill Land Division. Vice Mayor Gallagher asked that the following statement be made a part of the official record of the meeting. There were no objections. VICE MAYOR GALLAGHER - There is an agenda item requesting ratification of the Coyote Hill Subdivision as requested by Stanford University. Our City Attorney - both prior and present - has advised me that I did not and I do not have a conflict of interest with respect to this matter as a result of being employed by Stanford University. Notwithstanding the fact that a complaint ailegii g conflict of interest has been brought by he committee for Green Foothills and others, concerning this matter, my position has been and remains consistent. I have not and I do not have a conflict of interest and I am not required to abstain from participation in this matter. However, in order to alleviate any further legal problems for the City and in order to aid in the speedy disposition of the pending= litigation, I will not participate in discussion of or voting on this subject. I emphasize that the reason for doing this is not because of a conflict of interest - because I have none - but in order to aid the City in terminating the litigation and to put this matter See Page behind us once and for all. 495 MOTION: Councilman Arnold moved, seconded by Beahrs, that the Council refer the issue of the ratification of the Coyote Hill Subdivision to the Planning Cornniission for advice and recommendation. only and that the Planning Comrrtission be requested to return the recommendation rn d__Fabrnarv. The Planning Commission 490 1Z/14/70 has no legal dudcs or rights to act under these provisions of law. However, the Council is directing the Planning Commission to review those issues oniy relevant to the areas of subdivision approval per- mitted under subdivision laws in order that a full and public airing of those issues relevant to subdivisions be accomplished. The Plan- ning Commission will be acting only pursuant to request of Council on the relevant issues. If ratification does take place it can be ac- complished only by the Council. Councilman Dias requested that City Attorney Stoned remarks be made a part of the official record of the Minutes. There was no objection, and it was so ordered. Councilman Pearson requested that her "No" vote be recorded as a "Yes" vote. (NOTE: See Page 490.) There were no objections. The motion, therefore, carried by unanimous voice vote. Mayor Wheatley asked if there were objections to hearing frorr. the public. There were no objections. John Rodgers, 626 Weilsbury, protested that the Beautification Pro- See Page ject brochure illustrations did not contain any indication of the two 495 towers to be built. Mr. Rodgers was advised by Council that the _ Beautification Project is for University Avenue and a separate project from the Bryant Street Project. Council Referrals to Staff In answer to questions from Council, City Manager Morgan suggested Council consult staff for specific information regarding referrals. Council Poticy and Rules of Procedure 1 MOTION: Councilman Berwald moved, seconded by Galhgher, to continue this matter until January 18th. The motion carried by unanimous voice vote. 491 12/ 14/70 Solid Waste Disposal MOTION: Councilman Berwald rr_cved to direct staff to confer with Ecology Action and others as they desire and give the Council a report as to the possibility of either coordinating this service with the City Service or providing some space its the baylands for this recycling operation, or aaateming it as part of the City's contribution to improving the environment and improving the completeness of our refuse disposal service. Lane Carpenter, representative of Ecology Action, 162 University Avenue, said the present project of Ecology Action is a very effective educational tool, but nut a money making business. SUBSTITUTE MOTION: Councilman Norton moved, seconded by Berwald, that staff be asked to report on the City's power to limit the location and or number of places where alcoholic beverages are served in the downtown area by zoning, use permit or other regu- lation. The motion was approved by unanimous voice vote. Allan McPherson, 376 Diablo Court, representative of the Mid -Pen- insula Citizens for Fair Housing, spoke in favor of the motion. AMENDMENT: Councilman Berwald moved, duly seconded, the matter be referred to the Palo Alto Housing Corporation for their recommendations. The amendment carried by a majority voice vote. Emily Renzel, 836 Addison Avenue, spoke in favor of exploring the various possibilities of re -cycling waste, and against "block busting" techniques for removing older homes. Council Meetings Vice Mayor Gallagher announced the cancellation of the regularly scheduled 3rneetings of December 21, 1970 and December 28, 1970. MOTION: Councilman Arnold moved, duly seconded, that the regularly scheduled Council meeting of January 4th be held on Tuesday, January 5, 1971. The motion carried by unanimous voice vote.
