Pellegrini spoke on behalf of his application for a change of district of property known as 1055 and 90.1 Colorado Avenue from R-1 to R-3 (Page 430). The motion c:arric•d a onanimous voice vote_ Councilman Dias asked that the record show that the Palo Alto Hous- ing Corporation did not take a posi;:iorO concerning Mr. Peliegrini's application (Page 430). There were no objections to the change. MOTION: Councilman Pearson moved that on page 430, line 16, after the word "application." the words be added "because there was no insurance of low income housing if the developer failed to get the federal funding nor any way to tie the rezoning proposal to low in- come housing." The motion died for lack of a second. Councilman Pearson requested that on Page 431, line 25, add after —the Word "consioereu the •.voras "as as cxarorle_of a land barite; and on line 27 after "baylands" add "as examples of a land bank" and on line 30 add after "and is" the words ''riot an example for land banking purposes." There were no objections. Councilman Pearson moved, seconded by Norton, that on page 432, Paul Rymer, be corrected to read "Pa'ii Reimer" and the fifth para- graph be changed to read as follow : -.F: "Paul Reimer reviewed a propn$a: for land .L7.3 C. development by the (rand Resources Corporation and adjacent land in detail using charts for clarification," and to add after the last line of the paragraph the following: "Upon questioning by Councilman Norton he stated there would he as high as 2C units per acre in the apartment area." The motion was approved by the following roll call vote: Ayes: Arnold, Norton, Pearson, Spaeth Noes: Dias, Wheatley Abstain: Beahrs, Berwald, Comstock, Gallagher Presentation of Golf Trophy James Saitta, Palo Alto Men's Club, presented the Annual Palo Alto Men's Club - City Council and Staff golf tournament trophy to Mayor W heatley, noting that the plate has been engraved to show that Council .end Staff were victorious this year. Mayor Wheatley thanked Mr. Saitta for the trophy, stating it would ')e displayed in the Council Chambers. Councilman Spaeth also thanked Mr. Saitta and the Palo Alto Men's Club on behalf of the City tearti for setting up the tournament and for their hospitality. Division of land Jansen y. ay MOTION: Councilman Beahrs moved, seconded by Wheatley, to up- hold the recommendation of the Planning Commission and approve the application of Hare, Brewer and Kelley in behalf of Stanford University for a Miscellaneous Division of Land located at 600 Hansen Way, subject to conditions. The motion carried by unanimous voice vote. Dyas (CMR:669:0) MOTION: Councilman Gallagher introduced the following resolution and rnoved, seconded by Beahrs, its approval for adoption: Resolution No. 4388 eutit:ed "Resolution of the Council of the City of Palo Alto Expressing Appreciation to Genevieve T. Dyas Upon Her Retirement" The resolution was adopted by unanimous voice vote. Zone Change - 1128- 11 38 Oregon Avenue and 2.450 Bayshore Road MOTION: Councilman Arnold introduced the following ordinance and moved, seconded by Beahrs, its approval for adoption: Ordinance No. 2585 entitled "Ordinance of the Council of the City of Pale Alto Amending Section 18.08. 040 of the Palo Alto Municipal Code to Cnange the Zoning of Certain Property Known as 1128-1138 Oregon Avenue and 2450 West Bayshore Road from R-1 and R -3-G to P -C Subject to Conditions" (first reading 10/19/70) The ordinance was adopted by the following roll call vote: 448 11/2/70 Ayes: Noes: Arnold, Beahrs, Berwaid, Dias, Gallagher, Norton, Spaeth, Wheatley Comstock, Pearson Public Employees Retirement System MOTION: Vice Mayor Gallagher introduced the following ordinance and moved, seconded by Dias, its adoption: Ordinance No. 2586 entitled "Ordinance of the Council of the City of Palo Alto Authorizing an Amendment to the Contract Between the City Council and the Board of Administration of the California Public Employees' Retirement System" (first reading 10/1.9/70) The ordinance was adopted by unanimous voice vote. IbKLI rkg:leg41141UsWigtilf Rinconada Parke. _ Project No. 68-35 (CMR:423:0) MOTION: Cou.ncilman Dias introduced the following ordinance and moved, seconded by Gallagher, its adoption: Ordinance No. 2587 entitled "Ordinance of the Council of the City of Palo Alto Amending the Budget for the Fiscal Year 1970-71 Adjusting the Appropriations in the Capital Improve- ment Fund" In answer to questions Mr. August E. Waegemann, Consultant, stated that the proposed rehabilitation would place ' the pool in the category of a new project, and the pool should have the same life expectancy (25 to 30 years) as a new pool. City Engineer Witbeck in response to questions advised that the Recreation Depertrnent 'has expressed a preference for overhead lighting because of better visibility, less maintenance problems and lower installation costs. The ordinance was adopted by the following roll call vote: Ayes: Arnold, Beahrs, Berwald, Comstock, Dias, Gallagher, Norton, Pearson, Spaeth, Wheatley Noes: Nome MOTION: Councilman Dias moved, seconded by Gallagher, to author- ize the Mayor to execute a contract with Max D. Schenk, Inc. , in the amount of $121,830 for the base bid project. The motion carried by unanimous voice vote. "On Sale General Eating Place" License - "Tiki" 3740 El Camino Real CMR:668:0) MOTION: Councilman Norton moved, seconded by Beahrs, to fire without protest the application for transfer of an existing "On Sale Eating Place" license at 3740 El Camino Real, "°Tiki." Subject to Conditions" 449 11/2/70 The resolution was adopted by unanimous voice vote. „ftjiti-Tzus4 Litigation Plumbing Fixtures City Attorney Stone presented a writtenreporton the anti-trust litigation in connection with plumbing fixtures. The report was received. Foothills En sironmental Design Study Livingston & Blayney Report #3 (CMR:673:O) Fire Chief Korff reported on fire conditions in the foothills. City Manager Morgan asked that on page 7 of his report to the Council re Livingston and Blayney Study, line 9 the fourth word "comfortably" be deleted. Mayor Wheatley stated that he nor his f <rm have any contracts on the land in question at the present tirne but that they may have in the future at which time he will Aso designate to the Council. Vice__Maynr-cat!ag_h_er stated that he is an employee of Stanford who owni part of the land in question -but _that "e as no interest in said land. Discussion followed with City Manager Morgan stating the suggestions of the Staff for Livingston and Blayney had been proposed as an attempt to get the maximum choices before the Council. Study (continued) lefOTXON: Councilman Berwald moved, seconded by Comstock, that the Council accept and adopt the recommendations of the Livingston & Blayney report on the lands above the Foothill Park, soecifie.ally to adopt the content,: of preserving this -land for permanent open space through the establishment of a regionalpark and open space district, and direct :staff to carry out the implementation, AMENDMENT: Councilman Spaeth moved, seconded by Gallagher, to amend the motion to include "and that effectuation studies and recommendation of number five op page 2 of the Livingston & Blayney letter of October 27, 1970 be irnp1emented by Livingston & Blayney with the appropriate assistance and support of the City Manager's Office, 450 11/2/70 The amendment carried by unanimous voice vote. The motion as amended carried by unanimous voice vote. At this tirne Mayor Wheatley turned the chair over to Vice Mayor Gallagher. Discussion followed regarding the creation of a regional park dis- trict and the consultant's recommendations for lands below the park with Mr: Livingston responding to questions from Council. MOTION: Council.m.an Pearson moved, seconded by Norton, that the City Council accept the recommendations of the Livingston & Blayney report for all lands below the park, except Stanford North and Stanford South, and as set forth on pages 57 to 60 of Report #3, including the acquisition of 403 acres as a -n addition to Foothills Park, and the balance of approximately 635 acres for land bank to be held as open space and to be leased, held or sold or otherwise used as the City Council may from time to time direct. AMENDMENT: Councilman Spaeth moved, seconded by Pearson, to amend the motion that the following be added: "arid that effectuation studies and recommendation of number four, on page 2 of the Living- ston & Blayney letter of October 27, 1970 be implemented by Livingston & Blayney with the appropriate assistance and support of the City Manager's office, MOTION: Councilman Arnold moved, seconded by Beahrs, to con- tinue this item for one week, The motion to continue was approved by the following roll calla vote: Ayes: Arnold, Beahrs, Berwald, Dias , Gallagher, Spaeth Noes: Comstock, Norton, Pearson Abstain: Wheatley Wills Road E�rrsressway - Le al 13elationshi s nd Procgsjj es Concerning Dedicated Park Land MOTION: Councilman Pearson moved, duly seconded, that staff be directed to investigate the relationships and procedures required if the p sed Willow Road Expressway taken part of the El Camino Park. The motion carried by majority voice vote. Lauds - Timothy Hopkins, l 9(37 MOTION: Councilman Pearson moved, seconded by Comstock, to direct the City Attorney to undertake,a title scr.rch and tcetermination 451 11/Z/70 of the location of the land dedicated for park purposes to the City by Timothy Hopkins in 1907 and that the City Attorney bring back to Council methods for putting that land into the park dedication ordi- nance. City Attorney Stone advised the matter would be more appropriate directed to the City staff. (Mayor Wheatley left the Council Chambers at 11:15 p.m.) MOTION: Councilman Dias moved, seconded by Beahrs, to table the motion. Noes; Arnold, Berwald, Comstock, Pearson, Spaeth The main motion them carried on the following roll call vote: Ayes: Arnold, Berwald, Comstock, Norton, Pearson, Spaeth foes: Beahrs, Dias, G=allagher____ Wallow Road Expressway - Biking, HT ini Trails and Pedestrian Crossin MOTION: Councilman Pearson moved, seconded by Comstock, that staff be directed to begin studies on the land in that area near the proposed Willow Expressway that could be used as park land and biking and hiking trails and staff determine where pedestrian cross- ings of the proposed Willow Expressway should be located and return such study to Council. The motion carried by unanimous voice vote. Oral Communications 1. Robert Mark, 806 Escondido Village, Stanford, reported that the Livingston & Blayney Report #3 was out of print and there were many peopie who desired to purchase it. City Manager Morgan was asked to find out the cost of reprinting the report for sale to citizens. 2. John Hargis, 152 Emerson Street, told the Council he would appreciate discussing the issue of the Willow Road Expreaeway with individual rnernbers of the Council. 452 1112170 Adjournment MOTION: Councilman Comstock moved, duly seconded, to adjourn the meeting at 11:45 p.m. The motion passed unanimously.
