The Council of the City of Palo Alto rnet on this date at 7;30 p.m._ in
a regular meeting with ME.yor Wheatley presiding:
Present: Arnold, Beahrs, Berwald, Clark, Dias, Caliagher

Councilman Pearson requested that pages 413 and 419 be corrected
to show Mrs. E. M. Kinrierrnan rather than Edna Kinderrnan. There

The Minutes of September 28 were approved as corrected.
The Minutes of September 29 were approved as written.

MOTION: Mayor Wheatley moved, seconded by Spaeth, to hear items
7, 8, 10, 11 and 12 in that order.
Discussion followed and Mayor Wheatley, with the consent of Council-
man Spaeth, withdrew his motion.

MOTION; Councilman Dias moved, seconded by Wheatley, that the
property be re -zoned to R-3-0.
AMENDMENT: Mayor Wheatley moved, seconded by Beahr&,- to
amend the motion to include R -3 -G -D.
The amendment carried by a majority voice vote.

Mary Gordon, Chairman; Planning Commission; noteel the Minutes or
the Planning Commission should be corrected to show that Mr. Sabin
of the Palo Alto Housing Corporation stated the Palo Alto Housing Cor-
poration did not favor the application but concurred in the denial of
the application.

Director of Planning and Community Development Fourcroy described
the difficulties faced by the developer, i.. e. , the Federal agencies re-
quire confirmed zoning while the City requires plans before taking
action. Mr. Fourcroy confirmed that if the developer wished to apply
for a P -C zoning he would have to present a new application before the
Planning Corranission.
MOTION: Mayor Wheatley moved, duly seconded, to hear from the
public although there is a motion before the floor.
The motion carried by unanimous voice vote.
Carol Yanofsky, 7Z5 Mayfield, Mid Peninsula •Citizens for Fair
Housing, spoke against the re -zoning application.
The motion for change of zone failed on the following roll call vote:
Ayes: Beahrs, Dias, Gallagher, Wheatley
Noes: Arnold, Berwald, Clark, Norton, Pearson, Spaeth
MOTION: Councilman Pearson moved, duly seconded, to uphold the
recommendation of the Planning Commission to deny the application
of P. U. Pellegriai for a change of zone at 1055 and 1061 Colorado
Avenue.
The motion carried by the following roll call vote:

The motion carried by unanimous voice vote.
Employee Suggestions Award Program (CMR:655:0)
Mayor Wheatley on behalf of the Council and the City of Palo Alto,
presented Officer J. A. Williams of the Police Department with a
check for $174 for his meritarius suggestion to the City for a new
warrant procedure, and a plaque commernorating.the occasion. Offi-
cer Williams accepted the presentations with an expression of appre-
ciation.
Annual Financial Audit 1969-70
MOTION: Councilman Beahrs moved, seconded by Spaeth, to refer to
the Finance Committee the annual financial audit of the fiscal year
1969-70.
The motion carried by unanimous voice vote.

A written report by the City Attorney re Clairns Against the City was
presented.
The report was received.
Livingston & Blayney Report #3
Councilman Pearson noted that:
1) In the Livingston& Blayney report on page 59 a reference
is made to the baylands area indicating these lands be con-
sidered for land banking
2) A letter from the League of Women Voters to the Council
referred to the baylands as a landbank alternative.

Councilman Pearson clarified that the Baylands (with the exception of
two parcels, the waste disposal plant and the s,eivice center) Is dedicated
park land and is not available for land banking purposes. See Page
446
Boyd Smith, 903 Stanford, Manager of Real Estate for Stanford Uni-
versity, stated that Stanford University had retained Livingston Er
Blayney to study all Stanford land development, with the report due
early in 1971. Mr. Smith presented Stanford University's request

that the Council defer action on Staniord North and Stanford South
until that report has been received and reviewed by the University.
Mr. Smith advised the Council that attorneys for the University feel
there are seriou{questions as to whether the City can require the
University to keep land in open benefit for the public without compen-
sation. However, upon review of the Livingston & Blayney report
negotiations for lease of the land in question might be in order.
Mayor Wheatley asked that the record show that he or his firm has
no contracts at the present time on this property but may in the future,
at which time he will so designate to the Council.
Vice Mayor Gallagher asked that the record note he is an employee
of Stanford University but has no interests of any kind in the property
involved.

Brett LaShelle, Land Resources Corp., stated technology is now
available to handle pollution problems, and i.ndicated that Council
action tends to provide the City with more jobs but does not provide
solutions to the problem of housing needs,

Paul , Land Resources Corp., explained the proposal for a
development by the Land Resources Corp. in detail using wall charts
for clarification, Details of the proposal involved dedication of 40°':
of the property held by the Land Resources Corp. to open space; a
proposal -to arrange open space "tree masses" along Arastradero
and Felt creeks, and the creation of "open space hark iers" between
residential developments which would include sorne low income units.
Harry Byer, property owner in the upper foothills, spoke of the mora-
torium created by the City's delay in making a decision on these lands
but pointed out there had been no ,moratorium on taxes.
(The Council adjourned to an Executive Session re land acquisition
from 9:40 p.:n. to 10:10 p.m.)
Mrs. Norman Kulgein, 711 .Gail{n, AAUW, spoke in favor of the recom-
mendation of the Livingston & Blayney report for open space.
Lowell Smith, 22 Doud Street, Los Altos, Loma Prieta Chapter:
Sierra Club, asked the Council to approve the recommendations of
the Livingston & Blayney report and withhold decision on the Stanford
North and Stanford South until the Livingston & Blayney report for
Stanford University is received.
Nanette Hanko, 3172 Emerson Street, Palo Alto Civic League, spoke
in favor of a regional park district for the foothills and advised that
the Civic League discourages any public vote until completion of the
Livingston & Blayney Report #4.
Mrs, Jeri Stewart, 4187 Coulornbe Drive, member of the Board of
Directors of the League of Women Voters, endorsed the recommenda-
tions of the Livingston & Blayney report,

Mrs. Dorothy Reed, 632 (lenbrook Drive, League of Women Voters,
urged the Council to approve the recommendations of the Livingston
& Blayney report and take immediate steps to preserve the open space.
John T. Montgomery, 950 University, said the Livingston & Blayney
report is based on the erroneous assumption that there are only two
options; development or open space. He stated this is not correct -
the City could and should use restrict --e zoning to stop development.
Mr. Montgomery cited the Owens Valtey zs an example of such zoning
action.
Joseph Cirleton, 2350 Ross Road, spoke in favor of the recommenda-
tions of the Livingston & Blayney report.
Dwain N. Fullerton, 4133 Park Blvd., Northern Santa Clara Regional
Group, Sierra Club, spoke in favor of the Livingston & Blayney report
and "rational and limited land use" and urged the Council to ask for
Report #4 and send to the voters an alternative for action as soon as
pos sible.
Fadlo Mousatern, 170 E, Charleston Road, spoke of a survey con-
ducted among 1 119 residents, 63� of whom indicated they would like
to see the foothills preserved and were willing to pay $2O each to
accomplish this.

stated this organization supported the Livingston R- Blayney report,
are in favor of a regional park district, and oppose an advisory vote
at this time.
Robert S. Jones, 530 E. Crescent Drive, asked the Council to be sure
people understand the problem fully before taking any action.
Herbert Grench, 2828 Sowch Court, representative for the Committee
for Green Foothills, urged the Council to proceed with Report #4, and
delay action on Stanford North and Stanford South until the Livingston:
& Blayney report for Stanford University is presented.
Lawrence Klein, 531 Hilbar Lane, member of the Planning Commis-
sion of Palo Alto but speaking as an individual citizen, urged support
for the recommendations of the Livingston & Blayney report.
William A. Proctor, 758 Greer Road, City Planner for the City and
County of San Francisco, spoke in favor of the Livingston & Blayney
report.
Harriet Mundy, 757 Tennyson, spoke in favor of the report and urged
the Council to "opt" for open space.
Mayor Wheatley read a petition signed by 33 students from Jordan
Junior High School urging support of the Livingston & Blayney report.

Mr. Livingston clarified Report #4 as being a general plan design,
and Report #5 a plan for effectuation.
Discussion followed confirming that Council will receivo front the
staff a report on the assignment from the Council of 10/5/70 before
taking further action.

Mayor Wheatley read a petition signed by 960 signers urging the
Council_ not to change the ordinance prohibiting four or more unre-
lated persons from occupying a residents in a:: R-1. zone.
Adjournment
MOTION: Councilman Pearson moved to adjourn the meeting to
October 19., 1970.
The motion carried by unanimous voice vote.
The meeting adjourned at 11:30 p.m. to October 19, 1970 at 7:30 p.m.
