The Council of the City of Palo Alto met on this date with Mayor Wheatley
presiding:
Present: Arnold (arrived 7:40 p.m.), Beahrs, Berwald
(arrived 7:45 p.m.), Clark, Comstock, Dias,
Gallagher, Norton, Pearson, Spaeth, Wheatley
Absent: None
Minutes of September 8, September 15, August 17, 1970
Jn the Minutes of September 8, Councilman Pearson asked that on page 402,
'"Meeting Dates on Standing Committees" the ordinance should read
"approved by a majority voice vote" and that her vote be recorded as a"no" vote.
Councilman Pearson asked that an addition be ,lade on page 402,
line 32, ", but that if the Willow Road Committee were to continue to
work on housing, the Willow Road Committee could address itself to
whether or not representatives of the affected area could be appointed
to the committee."
The Minutes of September 8 were approved with the correction and
addition.
The Minutes of September 15 were approved as written.
The Minutes of August 17 previously approved: it was noted that on page
387 "Housing -Demolition Permits" that Mrs. Jing Lyman spike on be-
half of the Mid -Peninsula Urban Coalition in favor of the proposed demo-
lition ordinance.'
Public Hearita -.Weed Abatement
Mayor Wheatley declared open the public hearing on Resolution No. 4378
declaring weeds to be a nuisance.
City Engineer Witbeck stated that notice of the public hearing has been
given in accordance with the provisions of the Palo Alto Municipal Code.
City Clerk Faris +. stated that no written ryrnteetz had been received.

Mrs. Edna Kinderman, 501 Forest, asked that the City remove the See rage
weeds on the lot at the corner of Cowper and Channing Streets. 429
Mayor Wheatley asked that staff please take note of Mrs. Kinderman's
request.
Mayor Wheatley -declared the public hearing closed.
MOTION: Councilman Spaeth introduced the following resolution
and shoved, seconded by Clark, its adoption:
Resolution No. 4378 entitled "Resolution of the Council of the
City of Palo Alto Ordering Weed Nuisance Abated."
The resolution was ad' pied unanimously by voice vote.

The Council agreed to consider items 6,. 13 and 15 out of order at
this time.
Discussicn followed concerning encouraging rock concerts; and park-
ing regni,•ements, traffic generationand crowd control at rock con-
certs. Staff advised that the cost of erecting a sound shell at El
Camino Park would be $3,200 and the cost of lighting of the Park
would be $35, 000.
Mr. Ewart A. Wetherill, Sound Consultant with Bolt Beranek and
Newman, Inc., in response to questions advised that there is no
absolute measurement .for sound or other background noises. The
matter of sound is highly subjective. The shell as recommended
would nor fully shield noises, nor provide the control wished since
a shell is designed to direct the sound toward the audience and is ___.
not intended to stop sound. Sound regulations -it -Lay reduce the level
of noise, but would not establish the difference between good and
bar) noise.
MOTION: Vice Mayor Gallagher moved, seconded by Beahrs, that
the report cn "Sound Amplification Regulations in Ciiy Parks; Sound
Shell and Lighting at El Camino Park" bereferred to the Public Works
Committee for study and recommendation to be brought back to the
C uncii.

MOTION: Mayor Wheatley moved, seconded by Pearson,' to hear
from the public although there is a motion before the floor.
POINT OF INFORMATION: Councilman Spaeth asked for a clarifi-
cation of the question before the Council..
Mayor Wheatley stated that the item before the floor is Item 6:
Report on Sound Amplification.
The motion to hear from the public passed unanimously.
Mr. Charles Pottol, 3909 Middlefield Road spoke on behalf of the
Ad Hoc Committee and commended the report of the City Manager
on sound ampliacation. He requested the Council to investigate all
types of shells available for sound control.
Robert Cu;:lenbine, 2875 Ramona Street, questioned the statement
of the sound consultant that sound shells make no difference. He
also stated that lighting sufficient for baseball games at night is
not necessary for concerts to be performed at Fl Camino Park.
Allay. Panitch, 785 Newell Road, requested Council not to spend
more time or money on studies on the question of the sound ordi-
nance since the ordinance had not been proven to be bad.
Richard Procunier, 2183 Bryant, spoke as a member of the Mid --
Peninsula Noise Abatement League and defined noise as an unwanted
sound. He suggested the Council might establish a noise level for
the whole City,
The motion to refer carried unanimously.
Mayor Wheatley announced that Items 13 and 15 would be taken to-
gether for discussion.
Charles Pottol, 3909 Middlefield Road, spoke on behalf of the Ad
Hoc Committee, affirming that rrnernjers of the group are not radi
cals but are concerned citizens trying to make the present system
of government work.
Dr. Halsted Holman, 747 Dolores Street, defended the rights of
young people in the community.
Allan Panitch, 765 Newell Road, Executive Board, South Peninsula
Jewish Center, Director, Santa Clara County Social Planning Council,
North County Advisory Group, speaking as an individual, spoke in
favor of the Ad Hoc Committee statement and urged tolerance rather _

Paul Grirnard, 935 Embarcadero, asked the Council not to amend
the ordinances to permit rock concerts or Be -Ins.
Curt Weil, 273 Rinconada, Chairman of the Concert Committee of the Palo Alto Jaycees "Autumnal" of September 12, read letters
from several citizens approving the concert and commending the
Jaycees,
Joseph Wynn, 861 Sharon Court, requested Council to consider rock
concerts as "attractive nuisances."

Gypsy Lawrence, 3925 Nelson Drive, spoke of young people having
"equal rights."
Robert Arnold, 460 Marlowe, expressed appreciation for the work
and the statement of the ad hoc committee.
(The Council recessed at 10:00 p. m. to an exeetative session
for a report from the City Attorney. The Council reconvened
at 10:15 p.m. )
Mayor Wheatley asked Paul Staley, Youth Advisory Council Chairman,
if the Youth Advisory Council had agreed with the Ad Hoe Committee
recommendation for a new youth communication group.
Mr. Staley advised that the YAC has not acted upon this matter.
MOTION: Comicilman Spaeth moved, seconded by Pearson, to
refer to the Planning and Procedures Committee and the Public
Works Committee, meeting jointly, to consider the question of
additional facilities for rock concerts, sound level at these various
facilities, and the appropriate time for these to be held,
The motion was approved by a majority voice vot
Councilman Norton asked the record to note a clarification of the
11:00 p, m. curfew! there is a 10:00 p.m. curfew for people under
18; the 11:00 p. ;y. curfew ir, not a curfew but refer to the hour at
which sound amplification must cease.
Adjournment
MOTION: Councilman Clark moved, duly seconded, to adjourn until
7:30 p.m. Tuesday, September 29. 1970.
The motion passed by majority voice vote.
