City of Palo Alto met on this date at 7:30 p. m. with Mayor Wheatley presiding. Present: Arnold, Beahrs, Berwald, Clark, Comstock (arrived 7;40 p. tn. ), Gallagher, Spaeth (arrived 7:45 p.m.), Wheatley Absent: Dias, Norton, Pearson Insurance Audit MOTION: Councilman ,Arnold moved, on behalf of the Finance Com- mittee, to approve a contract with Warren, McVeigh and Associates to conduct a comprehensive audit of the City's insurance program. The contract does not exceed $5,000 and will be executed by the City Manager. The motion carried by unanimous voice vote. Resolution Declarins Weeds to be a Nuisance MOTION: Councilman Clark introduced the following resolution and moved. seconded by Gallagher, its adoption: Resolution No. 4376 entitled "Resolution of the Council of the City of Palo Alto Declaring Weeds to be a Nuisance and Setting a Hearing.1e City Attorney Stone advised the Council that the City Attorney's office is looking at the entire weed abatement program from a legal stand- point in order to streamline the procedures, therefore obviating the -i ra t.0 repeat the same legal process annually., #�iP office will report findings to Council. Spray Corporation. 408 9114170 In answer to questions staff reported that chemicals non -harmful to the ecology would be used in the program. Staff also z eported that in cases where specialized equipment and expertise is needed it is some- times more economical to use the services of an outside contractor rather than use the services of city employees. The motion carried by unanimous voice vote. Trails and Paths Projramm (CMR:639:0 and 172:0) MOTION: Councilman Berwald moved, seconded by Clark, to approve the recommendation to include in the Trails and Paths Program the Gunn High School -Stanford Route in the 1971-1976 Ca?ital Improvement Fund, and retain the original routes 1-A and 2-A. (Councilman Spaeth arrived at 7:45 p. m.) In the discussion that followed it was pointed out that implementation of the program will be determined when the priorities of the Capital Improvement Fund are established. tt was noted that the Finance Committee will be holding a special meeting on Wednesday, September 16, to consider the priorities of the Capital Improvement Fluid. The motion carried by Unanimous vole 1 vote. Retirement Contract Amendments (C v^:R:572:0) MOTION: Councilman Comstock rnoved, seconded by Gallagher, to adopt the following Resolution of Intention to approve an amendment to the existing contract with the Public Employees Retirement System changing the 1959 Survivor Benefit and the 1968 Cost of Living increases for those city employees who retired prior to December 21, 1966: Resolution No. 4377 entitled "Resolution of the Council of the City of Palo Alto of Intention to Approve an Amendment to Con- tract Between the Board of Administration of the Public Employees' Retirement System and the City Council of the City of Palo .Alto" The motion carried by unanimous voice vote. The motion carried unanimously by voice vote. 409 9/14/70 1 1 Central Palo Alto Planning, Study Mayor Wheatley announced a meeting of the Planning and Procedures Committee to discuss the Central Palo Alto Planning Study on Tuesday, September 15, 1970 at 7:30 p.m: at the College Terrace Library. County -wide Transit District • MOTION: Councilrnan Comstock moved, duly seconded, 1) to direct the Attorney's office to draft a resolution of the Council supporting the proposition that will be on the November ballot concerning the transit district, and; 2) direct staff to prepare informational material concerning this proposition to be inserted in the utility mailer. The motion: carried unanimously by voice vote. Pending items - Council and Committees Councilman Be, Wald requested Council to consider at some future date the matter of information concerning pending items before the Council and Council. Committees. City Manager _--Morgan _reviewed some of the pending items before the Cou-c.il regarding sound ordinance, amplified music, ordinance re- garding demolition, Bryant Street Project, Foothills Study and Housing. He stated a report would be submitted to Council listing the pending items with estimated time schedule as to when these items will come to Council. Oral Communications 1. Crystal Gam.age, representative of Downtown Palo Alto, Inc., spoke of the concern of members of Downtown Palo Alto, Inc., over the matter of enforcement of boAding codes, and urged the Council to maintain strict enforcerner_t of these codes. She expressed the hope that the Criuntil *would conduct a full and complete investigation and, in particular, hear representatives of all points of view, before amending " repealing the existing ordinance restricting the number of unrelated occupants for a dwelling in an R -1 zone. 2. Walter Vendley, 4150 Arnaranta Court, spoke of the annoyance in the neighborhood of the JayCee-YAC sponsored rock concert held at Gunn High School on September 12. He asked the Council to give careful consideration to approval of such gatherings, their locations, and what appeared to him an excessive finan- cial outla- to the city to provide security services. 410 9/14/70 Cancellation of September 21 Council Meeting MOTION: Mayor Wheatley moved, duly seconded, to continue items scheduled for the a;enda of September 21, 1970 to September 28, 1970, and that the regularly s.eheduled meeting of September 21 be cancelled. Items to be continued are: YAC recommendations (1) relating to sound amplification, and; (2) hours during which arn.plified music can be played, and; (3) report from the City Attorney on an ordinance which would require that after a building is demolished construction be started within six months, said report to be returned to Council within 30 days.
