HomeMy WebLinkAbout05251970J MINUTES city of palo alto 292 5/25/70 Civic Center Palo Alto, California May 25, 1970 The Council of the City of Palo Alto met on this date in an adjourned meeting from May 18, 1970 at 7:30 p.m. with Mayor Arnold pre- siding: Present: Arnold, Beahrs, Berwald, Clark, Cornstock, Dias, Gallagher, Norton (arrived 7:40 p.m.), Pearson Absent: Spaeth, Wheatley Youth/Community Relations Mayor Arncld reported to the Council that a meeting with members of the Youth Advisory Council was held on Wednesday, May 20, 1970 at Civic Cen ier to discuss Youth/Commaan ,?_relations as requested by ' the Council Pr - -«- z : e�ent-weez e. _ Mayor .Arnold, Vice Mayor Wheatley, City Manager Morgan, Assistant to the City Manager Charles Walker, Youth Advisory Council Chairman Steve Gayle, YAC members Mike Arnold and Charles Hall. YAC Task Force Chairman Dan Daiss was also present. A variety of viewpoints and suggestions were offered some of which are being implemented. The picture taking policy of the Palo Alto Police Department i3 tie- ing investigated and will be brotkr;ht back to Council. The Mayor will *.rief the Youth Advisory Council on agenda items before regular Council meetings. An examination of the provisions of the liability insurance carried by the City will be made to determiie feasibility of members of the Youth Advisory Council riding occasionally with the police in patrol cars on regular assignments. Closer liaison between the YAC and the City Council win be effecters. Discussion groups composed of parents, police and youth will be encouraged. Mayor Arnold asked if there were objections to taking Agenda Item 5 out of order to be considered at this time. There were no objections. improved Relationship between Yaun People and the Police MOTION: Councilman Dias moved, seconded by Clark, that the re- sponsibility for meeting with appointed Youth Advisory Council re- presentatives to establish modes of action and administrative pro- cedures for greatest expedition of Youth Advisory Council recom- mendations and providing background material for governmental practices as used by this Council be referred to the Planning and Procedures Ccmrnittee. The rnotion carried unanimously by voice vote. MOTION: Councilman Pearson moved to refer to the Planning and Procedures Committee for their recommendation the letter dated May 25, ,70 received by the City Council from the Youth Advisory Council proposing a joint City Council -Youth Advisory Council Com- mittee to investigate and advise the City Council on current pro- cedures of members of the Palo Alto Police Department. The motion failed for lack of a second. The motion was duly seconded and carried unanimously by voice vote. Amendment to Sign Ordinance. MOTION: Mayor Arnold introduced the following ordinance for second reading and moved, duly seconded, its adoption: Ordinance No. 2558 entitled "Ordinance of the Council of the City of Palo Alto Amending Chapter 16.20 of the PAMC Relating to Temporary Signs, Use of Vehicles for Advertising and Permit Fees" (first reading 5/4170) The ordinance was adopted by unanimous voice: vote. The amendment was carried by the following roll call vote: Aye5: Arnold. Berwald, Dias, Norton, Pearson Noes: Beahrs, Clark, Gallagher AMENDMENT: Councilman Berwald moved, seconded by Comstock, to amend the ordinance and delete from Section 1 the words "section 2.16.050" and also to delete the words "and deleting provisions con- cerning the voting of an ex officio member." The amendment was carried by unanimous voice vote. Mr. Porter, representative of the Palo Alto Civic League, advised the Council of the study the League had made of the Charter of the City of Palo Alto, which does provide both the Mayor and the City Manager with the power to vote as ex officio members. The Palo Alto Civic League recommends to the Council that this matter be re- ferred to the Planning and .?rocedures Committee. The ordinance as amended was approved for first reading by unani- mous voice vote. Merriam" The resolution was adopted unanimously by voice vote. Mechanical liccess Parking Facilities MOTION: Councilman Comstock introduced the following ordinance and moved, seconded by Beahrs, its approval for first reading: "Ordinance of the Council of the City of Palo Alto Adding Chapter 18. 87 to the Palo Alto Municipal Cede Concerning Mechanical Access Parking Facilities" The ordinance was approved for first reading by unanimous voice vote. Palo Alto Airport (CMR:526:0) MOTION: Councilman Comstock moved, seconded by Beahrs, to approve the revised development proposal of Palo Alto Aviation. The motion carried unanimously by voice vote. 13ob Perry, County Assistant Directcr of Public Works Committee in response to questions of Council advised that sidewalks are planned for the southerly side of the property. Vacation of Easement on Edgewood Drive (CMR:522:0) MOTION: Councilman Gallagher introduced the following resolution and rnoveu, seconded by Norton, its adoption: Resolution No. 4353 entitled "Resolution of the Council of the City of Palo Alto Ordering the Vacation of a Portion of an Easement for Public Utility Purposes (Crescent Park Sub- division)" The resolution was adopted unanimously by voice vote. Baylands Athletic Center Phase 11, Li htiig Project No. - - Report on Bids (CMR:527:O) Assistant City Manager Sipel advised the Council that all bids re- ceived were considerably uver the estimate. MOTION: Councilman Ga11a;-,her moved, seconded by Norton, to approve the recommendation of the City Manager to reject all bids received for the Baylands Athletic: Center Phase II, Lighting Project No. 66-18A, and utilize City forces to install the lighting in order to stay within the budget. The motion was approved unanimously by voice vote. See Page 303• 295 5/25/70 Foothills Consultant Public Hearings MOTION: Mayor Arnold moved, seconded by Comstock, to continue for one week the item re Foothills Consultant public hearings. The motion carried unanimously. Regional Wastewater Treatment Plant Name MOTION: Councilman Dias moved, seconded by Gallagher, to refer to the Public Facilities Naming Committee the suggestion that the Regional Wastewater Treatment Plant tiow under construction be :lamed for Harold L, The motion wo., approved unanimously by a voic:e vote. Council will listen more e,rneetiy to to youth of the City. C;iarles Noble : spoke of police harassment to young op1e. 3. Tim Caddis spoke of police harassment and com nented on the steady decline in the attitude of the Palo Alto Police. Janet Weiss, Stanford student, declared there in a group in the Palo Alto Police Department specifically set up to persecute and harass people of all ages in the community because of their political beliefs. 5. Art Busse, political activist, described harassment, car damage and physical intimidation by masked .police L.' unmarked cars. Mrs. Robert Christiansen spoke of the remarkable re- stoaint the police have shown under severe provocation. Requested Council to investigate alleged complaints against the police, and defend them if charges are un- founded. 7. John Keilch, Stanford student, spoke of the "Red Squad" in Palo Alto Police Department and urged the Council to eliminate the "vigilante" tactics being used. 8. John Milwitt, 117 University Avenue, asked why Rev. Verdi had been bodily ejected from the Civic Center. 9. John Scott stated that most of "us" are "Communists" and asked for a public hearing on the Palo Alto Police Department. 10. Mrs. Lola Cassidy spoke of the guidance and help of local poiiccrpn extended to her two sons and expressed her appreciation of the local police. Richard Whitfield directed his questions to the Mayor and asked what he, the Mayor, was going to do about the police zituation. MOTION: Councilman Berwald moved, seconded by Comstock, to refer the proposed agreement for consultant services to the South Bay Water Dischargers to the Finance Committee for recommenda- tion. See Page 303 AMENDMENT: Councilman Comstock moved, duly seconded, to amend the motion to withhold approval of the agreement until con- firmation that neighboring dischargers are participating is received. The amendment was defeated by the following roll call vote. Ayes: Berwald, Comstock, Gallagher, Norton Noes: Arnold, Clark, Dias, Pearson The motion to refer the agreement to the Finance Committee was de- feated by the following roll call vote: (six votes required) Ayes: Arnold, Clark, Dias, Gallagher Pearson Noes: Berwald, Comstock, Norton MOTION: Mayor Arnold moved, duly seconded to reconsider th;: motion of referral. The motion was approved by the following roll call vote: Ayes: :Arnold, Berwald, Clark, Comstock, Via, Gallagher Noes: Norton, Pearson, Dias MOTION: Mayor Arnold moved, seconded by Gallagher, to approve the contract contingent upon the Finance Committee supplying an answer of approval by Tuesday evening, May 26, 1970. The motion failed on the following roil call vote: (six votes required) Ayes: Arnold, Berwald, Clark, Gallagher, I•earsori Noes: Comstock, Dias, Norton MOTION: Councilman Dias, seconded by Gallagher, moved the pro- posed agreement be approved and the Mayor authorizedto sign it contingent to City staff being assured by the City Managers of the. neiiihboring communities that they would be participating in the agreement contract. - The motion was approved by the following roll call vote: Ayes: Arnold, Clark, Dias, Gallagher, Norton., -Pearson Noes: Berwald, Comstock 298 5025070 Regional Water Quality Control Board - Interim Improvements to Meet Requirements (CMR:533:0) MOTION: Mayor Arnold moved, seconded by Berwald, to approve the proposed interim improvements and direct the staff to present this position to the Regional Board meeting on May 28, 1970. The motion was approved unanimously by voice vote. MOTION: Councilman Pearson moved, duly seconded,' that the new sewer rate schedule be brought back to Council for approval. The motion vas approved unanimously by ::vise .vote. MO7"ION: Councilman Dias moved, seconded by Comstock, that acceleration of the construction of the new Regional Water Quality Control Plant not be pursued at this tirne. The motion was approved w aninzousty by a voice vote. Yacht Harbor P!an Projosed Amendment Mayor Arnold asked if there were objections to considering Agenda Itern 6 out of order at this time. There were no objections. MC}TION: Cnfznc►!man Gallagher moved, seconded by Berwald, to refer to the Public Works Committee for recommendation the request from the County of Santa Clara for the Yacht Club and the Sea Scouts to remain in their present location and not be relocated as proposed under the Master Plan. The motion was approved unanimously by a voice vote. Middlefield Road and East Meadow Drive Tmprovernente (CMR:532:O) Councilman Berwald introduced the following resolution and moved, seconded by Comstock, its adoption: Resolution No. 4354 entitled: "Resolution of the Council of the City of Palo Alto Amending Resolution 2971 Prohibiting Parking Along A Certain Portionof Middlefield Roach' The resolution was adopted unanimously by voice vote. Councilman Berwald moved, seconded by Comstock, to authorize the Mayor to execute an amendment to the contract with Sabin O'Neal Mitchell, Architects, authorizing the expenditure of $1,800 foi- the prepa; action of plans, specifications and bidding docu- ments for alternates as approved by the City Council in the alteration of the Ruth Stern Wing of the Community Center, 299 5/25/70 The motion was approved unanimously by voice vote. Oral Communications 1. Michael Slomer of Fischer & Porter Co. , spoke of a possible $27,000 refund to the City by using Fischer & Porter instrumentation in construction of the new sewage treatrnent plant. Councilman Comstock suggested staff prepare a report for the next meeting on Mr. Storner's presentation and also directed that the matter be placed on the agenda of the next meeting.
