See Page 278 Present: Arnold, Beahrs, Berwald (arrived 7:35 p.m.), Clark, Comstock (arrived 7:40 p.m.), Dias, Gallagher, Norton (arrived 7:45 p.m.), Spaeth (arrived 7:40 p.m.), Wheatley Absent: None Re urt re un Control City Attorney Hildebrand reported that cities no longer possess the authority ity to legislate in this area, the control resting with the State. The report was received. A lication for Alcohol Bevera Congo-i.zcense - l5 ��niversi City Attorney Hildebrand advised the Co'zncil that the application of Alice H. and Royal W. Kelsey, Jr. , dba the "Poppycock", for an "On Sale Beer" license had been withdrawn. The report was received. Requested Ch<^.nge in 1967 Uniform Building Code MOTION: Mayor Arnold moved, duly seconded, that the requested change in the 1967 edition of the Uniform Building Code regarding development of sloping parcels of land be referred to the Public Works Committee. The motion was carried unanimously by vcice vote. The amendment passed unanimously. Motion as amended passed unanimously. 272 5/4/70 Commendation Resolution MOTION: Councilman Spaeth moved, seconded by Beahrs, to zdopt the following resolution of comrnenda!ion: Resolution No. 4349 entitled "Resolution of the Council of Cie City of Palo Alto Cornmending Mayor Edward S. Arnold, Council- man Frances K. Dias, City- Manager George E. Morgan and Staff For Their Efforts in the Dedication of the Civic Center" AMENDMENT: Councilman Berwald moved, duly seconded, that the resolution be signed by the Vice Mayor. The amendment was approved unanimously. The motion as amended was approved unanirnou;aly. Crowd Control Monitors MOTION: Councilman Gallagher introduced the following ordinance for second reading and moved, seconded by Rpa.hrs, its adoption: 273 5/4/70 Ordinance No. ?,555 entitled "Ordinance of the Council of the City of Palo Alto Amending Section 22.04.070(b) of the Palo Alto Municipal Code to Provide for Crowd Control Monitors at Public Gatherings" (first reading 4/20/70) The ordinance was adopted unanimously by voice vote. Regulation of loud sneakers MOTION: Councilman Gallagher. introduced the following ordinance for second reading and moved, seconded by Norton, its adoption: Ordinance No. 2556 entitled "Ordinance of the Council of the City of Palo Alto Amending Section 9.14. 010 of the Palo Alto Municipal Code Regulating the Use of Loudspeakers" (first reading 4/20/70) The ordinance was adopted unanimously by voice vote. Gas Rate Increase - Pacific Ga.s & Electric Comi,any (CIviR;512:0) MOTION: -Gen nciirnan Comstock introduced the following resolution and moved, seconded by Spaeth, its adoption: See Page 278 Resolution No. 4350 entitled "Resolution of the Council of the City of Palo Alto Amending Schedule G-1 of the City of Palo Alto Utilities Rates and Charges" The resolution was adopted unanimously by a voice vote. Council requested the City Manager to notify utility users in advance of the increase.' Water Rates Adjustment (CM.R:511;0) MOTION: Councilman Spaeth moved, seconded by Wheatley, the review of need for water rate adjustment be referred to the Finance Committee for study. The Motion carried unanimously by voice vote. Improvement Plans - Mitchell Park Communi �Centeit Building MOTION; Councilxna.zi Wheatley introduced the following ordinance and moved, seconded by Norton, its adoption: 274 5/4/70 Ordinance No. 2557 entitled "Ordinance of the Council of the City of Palo Alto Amending the Budget for the Fiscal Year 1969-70 to Make an Additional Appropriation for the Mitchell Park Com- munit r Center Building Project No. 66-15-A" The motion was approved unanimously by voice vote. (Vice Mayor Wheatley left the Council Chambers at 8:30 p.m.) Bryant Street Pr ect - Proposed Consultant Services (CMR:515:0) MOTION: Councilman Beahrs Ya oved, a.rd it was duly seconded, that Council approve Staff recommendation #'or the City -to eriga-ge the services of Optimum Systems, Inc. to perform the desired services, at a cost not to exceed $4, 500 with the provision that the work he accomplished by June 5, 1970. Considerabi,discussion followe:i and City Manager Morgan responded to questions from the Council concerning the directives to be given to the consultants, the specifications involved, the scope of the study (i. e, whether to consider items such as traffic flow, ecological pro- blems, community relocat ng) and the impact on the community of the project. City Manager Morgan advised the Council that the Staff were £o11 ix i s --_- directions as specifically stated in Item 8, page 249, Minutes of April 13 which read as follows "That all financial, legal and property tax aspects of the project from the City's standpoint be submitted to an independent economic analyst to be recommended by staff and approved by the City Council for study and analysis and for review of the Cornish and Carey proposal as to fairness and feasibility from the standpoint of the City's interest." The motion was unanimously approved by voice vote. Application for "On Sale Beer Eating Place" License, 135 University Avenue (CMR:510:0) MOTION: Councilman Berwald moved, seco::ded by Clark, that due to the history of the problem at this location the City protest the App!icatirsn of R«mair Enterprises, Inc. for an On -Sale Beer Eating Place License, "Mom's," at 135 University Avenue. (Vice Mayor Wheatley returned at 9:30 p.m.) 0 MOTION: Mayor Arnold moved, duly seconded, that the applicants be heard even though there is a motion before the Council. The motion was approved unanimously. 275 5/4/70 Jam.es Rurnmonds, 104 D. Escondido Street, Stanford Village, and Peter Mair, 4159 Park Boulevard are the applicants involved. Mr. Rummords asked the Council to consider the background, ability, and plans of the new owner -operators stressing the importance of the difference between the previous operation and the proposed management, clientele, and entertainment to be offered. Cited as an example is the planned use of acoustic instruments (defined as instruments played without amplification). See Page 278 The motion to protest the application was defeated by a roll call vote as follows: Ayes: Comstock, Pearsorr Noes: Arnold, Beahrs, Berwald, Clark, Dias, Gallagher, Norton, Spaeth, Wheatley Amendments to the Sign Ordinance Councilman Dias reviewed the difference between advertising signs and construction signs. (Section 16. 20. 190 of the PAly C;). MOTION: Councilman Dias introduced the following ordinance and -rnove'i, seconded by Gallagher, its approval for first reading: "Ordinance of the Council of the City of Palo Alto Amending Chapter 16. 20 of the PAMC Relating to Temporary Signs, Use of Vehicles for Advertising, and Permit Fees" - The ordinance was approved for first reading by unanimous voice vote. Change in Timing of Planning Commission Pointments MOTION: Mayor Arnold moved, seconded by Gallagher, that Staff be directed to draft an ordinance which would change the tinning of Planning Commission appointments, and that the draft be returned to Council for approval. The motion was carried unanimously, b j —voice vote. Alarming and Defamatory Pamphlets Vice Mayor Wheatley read from a pamphlet distributed in Palo Alto which caused anxiety and concern to older citizens in the area. He requested advice from the Staff as to possible action to stop such pamphlets. City Attorney Hildebrand advised that no action is feasible under the guarantee of free speech. Discussion followed, but no action taken. 276 5/4/70 Cancellation of Meeting Mayor Arnold moved, duly seconded, that the regular meeting of the Council to be held on May llth be cancelled. The motion carried unanimously by voice vote. Oral Comrnunications 1. Mr. Steve Gayle, 87Z Seale Avenue, expressed disappointment at Council action with regard to the decision not to protest the alcoholic license for 135 University Avenue, Mr. Gayle felt equal .riteria had not been applied to all applicants. Resignation of John E. Austin Mayor Arnold announced the resignation of J:,hn E. Austin from the Planning Commission. Mayor Arnold, on behalf of the Council, spoke with appreciation for the time and energies Mr. Austin had expended. The resignation was accepted with regret.
