HomeMy WebLinkAbout0503197114-71 MINUTE city of palo alto May 3, 1971 The Council of the City of Palo Alto met on this date at 7:30 p.m., in a regular meeting with Mayor Wheatley presiding. Present: Arnold, Beahrs, Be wald (arrived 7:35 p.m.), Clark, Comstock, Dias, Gall- gher, Norton (arrived 7: 35 p. m. ), Pearson, Wheatley Absent: Spaeth Minutes of April 19, 1971 Councilman Clark requested that the minutes be corrected on Page 61, second paragraph, to delete the words "and Councilrnan Clerk", since he did not in fact participate in the "Walk for Mankind". It was requested that the minutes be corrected on Page 67, under the item "Search of Stanford Daily", where the vote should be recorded as a majority voice vote and not "unanimously". The minutes of April 19 were approved as corrected. Architectural Design Review Formation of Ad Hoc Committee MOTION: Councilman Dias, 6n behalf of the Planning and Procedures Committee, moved the following regarding architectural design re - vi -eve: a. the formation of an ad hoc committee composed of two mem- bers of the Planning Commission, the Director of Planning, and two professionals in the design field from the'private sector, to be constituted for a period of six months to for- mulate environmental design review, standards and control iri. ccdures; and b. the ad hoc committee to conduct open meetings for the pur- pose of inviting participation and comments regarding: 1. the formation of such design review criteria, standards and procedures; and 2. proposals for the establishment of a permanent archi- tectural design review team 74 5/3/71 Councilman Dias confirmed that it was the Committee's intention that appointments to this ad hoc committee be made by the Mayor. See Page 80 The motion carried unanimously on a voice vote. MOTION: It was moved by Vice Mayor Gallagher, seconded by Comstock, that letters from Hare, Brewer & Kelley; Sabi:i O'Neal Mitchell; and any additional letters on the subject of the design review committee, be referred to the ad hoc committee which has just been formed. The motion carried unanimously on a voice vote. Youth Advisory Council R e nest Mayor Wheatley asked Boyd Haight, YAC Chairman, to address the Council. Boyd Haight, Chairman, YAC, requested Council support regarding the YAC's Summer Job Program for Disadvantaged Youth in Palo Alto and answered questions on the implementation of the program, timing, etc. MOTION: Councilman Comstock moved, seconded by Beahrs, to support the recommendation of YAC on the Summer Job Program for Disadvanta;;ed Youth. The motion carried unanirnously.on a voice vote. Mayor Wheatley commended the YAC for recent projects involving youth of the City, including the "Walk for Mankind" and participation in the Palo Alto Symphony concerts on May 1 and May 2. Retirement of Alec C: Smith (CMR:e05:1) MOTION: Vice Mayor Gallagher introduced the following resolution and moved, seconded by Comstock, its adoption: Resolution No. 4447 entitled "Resolution of the Council of the City of Palo Alto E_._ Alec Smith ...�v r-r�ur�s3stna Appreciation tT1 r, ate.., as Upon His Retirement" The motion carried unanimously on a voice vote. 1Dog Licensin Pragr (CMR:798:1) MOTION: Councilman Arnold moved, seconded by Comstock, adop- tion of the following ordinance: 75 5/3/71 Ordinance No. 2601 entitled "Ordinance of the Council of the City of Palo Alto Amending Variou& Sections in Chapter 6. 16 of the PAMC Concerning Licensing, Impounding, Keeping, and Transferring Possession of Dogs" (first reading 4/19/71) The ordinance was adopted on a unanimous voice vote. Interim Water Quality Iyianagement Plan (CMR:807:1) i See Page 80 City -Manager Morgan referred to his report (CMR:807:1) and the attachments, which included extracts from the South Bay Dischargers` consultant's (Consoer-Bechtel) report to the California Regic.nal Water Quality Control Board cn the Preliminary Interim Water Quality Management Plan of April 1971, as it relates to the South Bay Study. Mr. Morgan stated that an immense amount of material has beco.ne available on new and higher standards in terms of waste water and staff is in the process of disseminating it. The question of anticipated cost of the Tertiary Treatment Plant was discussed and Mr. Morgan estimated this to be approximately $10 million for the third level treatment for Palo Alto. MOTION: Councilman i3erweld moved, seconded by Beahrs, that the Council authorize the Mayor to transmit to the Regional Water Quality Control Board a letter: 1. supporting the concept of an interim water quality manage- ment plant; 2. with modifications as suggested by the Consoer•Bechte:l Report and by the South I3ay Wastewater Dischargers' Technical Committee. Mayor Wheatley ruled that the motion would be voted upon in two parts, 1. and 2. above. Part 1 of the motion carried unanimously on a voice vote. Part 2 of the motion carried on a majority voice vote, with Council- man Pearson voting "No". Old Cor oration Yard Site Proiosed Lease (CMii:806:1) MOTION: Councilman Norton moved, seconded by Beahrs, that the subject of the proposed lease of the corporation yard property be referred to the Finance Committee for its early attention. The motion carried unanimoiaaly on a vndce vote. 76 5/3/71 Liquor Licenses - Use Permit ReTairement MOTION: Councilman. Dias introduced the following ordinance and moved, on behalf of the Planning and Pre.cedures Committee, its approval for first reading: "Ordinance of the Council of the City of Palo Alto Amending Various Sections of Title 18 (Zoning) of the PANIC to Specify Areas of the City in Which Sales of Alcoholic Beverages Under On -Sale License will be Permitted, Requiring a Use Permit Prior to Commencement of Such Sales, Setting Standards for the Issuance of Use Permits and Requiring Operators of all Existing On -Sale Licensed Premises to Obtain a Use Permit Whenever a License is Changed" In response to questions, City Attorney Stone confirmed thet there is a difference between an On -Sale General (Public Premises) and On -Sale General (Eating Place) license issued by the ABC. Applications come from people who are interested in ac- quiring a license crude available by the ABC. Licenses are granted by pulling names out of a hat if there are more applicants than avail- - able licenses. Responding to questions, Director of Planning and Community De- velopment Fourcroy discussed the standard of one license per 40,000 sq. ft. in a block and how this standard was arrived at, stating that the figure of one license per 40, 000 sq. ft. is a matter of discretion on the part of the Council. There will be a few instances where additional licenses could be granted, but the State controls the total number of licenses permitted in the City. City Attorney Stone stated that with respect to nonconformance of licenses, this is "grandfathered in" and if the transfer to another owner tares pL ce the City has the option of protesting the transfer on all grounds except the violation of the ordinance. However, the transfer of a non -conforming license does require a use permit, which may be denied on grounds other than the lot area restrictions. In r esporsae to a question, City Attorney Stone explained that there is a difference between a beer and wine license and a General On -Sale license as far as the State is concerned. However, in terms of the criteria necessary for the ordinance before the Council, there are no planning differences. (Second reading 5/17/71) Senior Citizens Request R egarrlin Librar Room MOTION: Councilman Comstock moved, seconded by Pearson, that the request by senior citizens for help in using the new library room be referred to the Finance Committee. The motion carried unanimously on a voice vcte. O en Space Dena ation: Land Below Foothills Park MOTION: Councilman Norton moved, seconded by Pearson, that the Mayor be authorized to write the Santa Clara County Board of Super- visors and Planning Commission requesting that steps be taken at the earliest possible date to amend the Santa Clara County General Plan to show lands below Foothills Palk with an appropriate open space designation to conform to the Palo Alto City Council's adopted policy. The motion carried unanimously on a voice vote. Cancellation of May 10 City Council Meeting MOTION: Mayor Wheatley moved, seconded by Gallagher, that the regular meeting of the City Council scheduled for May 10, 1971, be canc elled, The motion carried unanimously on a voice vote.
