HomeMy WebLinkAbout03011971MINUTES city 01 palo alto 12 3/1/71 Civic Center Palo Alto, California March 1, 1971 The Council of the City of Palo Alto met on this date in an adjourned meeting from February 22, 1971. with Mayor Wheatley presiding. Present: Arnold, Beahrs, Berwald, Clark, Comstock, Dias, Gallagher, Nos ton (arrived 8:40 p.m.), Pearson, Spaeth, Wheatley Absent: None i rans ortation Demonstration Project Councilman Comstock, Palo Alto representative to the Transportation Policy Committee, reviewed that committee`s actions to recommend to the Board of Supervisors that the County proceed to secure the demonstration grant. He advised that the Board of Supervisors have decided not to do anything until their Chairman returns from Washington, D. C. City Manager Morgan advised that the San Jose City Council did authorize the filing of a joint application with the City of Palo Alto as a substitute for a county -wide application and noted more will be known a little later. San`rancis�uito Creek Diversion Project (CMR:7.49:1) a�r�rc�sni City Manager Morgan reviewed the report submitted to the Council and noted that the impact of the change in policy by the Corps of Engineers is $205.000. Discussion followed with City Engineer and City Attorney Stone re- sponding to questions regarding soils conditions, flooding and legal problems pertaining to Bayshore Freeway. MOTION: Councilman Berwalr: moved, seconded by Beahrs, that the Council authorize the staff to delete the uutfall portion (pipe froth Edgewood Drive into San. Francisquito Creek phis the discharge structure) from the currentcontract for the, construction of San Francisc{uito Diversion System, and amend the eursent contractfor the construction of storm drainage constructions in accordance with this change. In addition, to authorize the staff to undertake the en- gineering, design and development of specifications and a call for bids on a project that will provide for an outfail line which will cross under the Bayshore Freeway and enter San Francisnsiito r_ -,reek •?^...: etr earn -of the highway; Mayor Wheatley asked if there were any objections to hearing from the public. There were no objecticas, A. E. Mullin, General Contractor on the present project, expressed concern about completing his contract within the time l:snits speci- fied, discharge of waters collecting, and materials he has purchased. Mr. Witbeck advised that the City would expect in closing out Mr. Mullin's contract to pay for those materials and supply then in the ensuing contract. He stated drainage can be worked out on the job. The motion carried unanimously on a voice vote. Liquor License - Peking Restaurant 3691 El Camino Real (CMR : 748:: ) MOTION: Mayor Wheatley moved, seconded by Eeahrs, to file the application of the Peking Restaurant, 3691 El Camino Real, for a person -to -person transfer of an "On Sale Beer and Wine (Eating Place)" license. The motion carried unanimously on a voice vote. Enfranchisernent of Persons of the .A.se of 18 and Older City Attorney Stone referred to his report dated February 12, 1971 regarding the enfranchisement of persons of the age of 18 years or older in Palo Alta. municipal elections and read the conclusion set forth in his report that the City may not permit persons to vote at municipal elections who do not meet the age qualifications of the California Constitution, The report was received. Proposed Advisory Vote Municipal- Election Vietnam War MOTION: Co;incilrnan Comstock moved, seconded by Spaeth, that the following measure be placed on the ballot for the May 1 1 , 1971 Central Municipal Election: "We the citizens f Palo Alto, in unison with 73% of Americans recently polled, express our support of complete United States withdrawal from Southeast Asia by December 31, 1971 and ask that our President take appropriate action to accomplish this goal." In response to question, City Attorney Stone advised that the initiative portion of the Charter a11c 's the electorate to initiate ordinance 13 3/1/71 only. Any ordinance or resolution is subject to referencluin provided petition is filed within thirty days from final passage. However, the Council may put on the ballot any ordinance, resolution or question of policy. He stated the electorate could not put the matter in ques tion on the ballot by initiative. Mayor Wheatley asked if there were any objections to hearing from the public at this time. Spencer, 3969 Duncan Place Ted Salo, 3178 Ross Road Charles Paddock, 2979 Greer Road David Lampton, 2144 Howdoin Street Lillian Baniield, 3375 Kipling Street, spoke against putting a measure regarding the Vietnam War on the Municipal ballet, AMENDMENT: Vice ,-{may r Gallagh_r _moved, seconded by Arnold, an e.. -n :aument to add the words: "and similarly we urge the govern- ment of Hanoi to declare an immediate cease fire in Southeast Asia followed by the total withdrawal of all foreign military forces by December 31, 19?1. " Council discussion followed on the amendment and the main motion. (Council recessed from 10:10 to 10:24 p. rn, due to a disturbance in the Chambers.) AMENDMENT TO THE AMENDMENT: Councilman Berwald moved, seconded by Beahrs, to amend the amendment by deleting the words "Southeast Asia" and inserting the words "South Vietnam, Laos and Cambodia." The arnendment to the amendment failed on a majority voice vote. At this time Mayor Wheatley announced that if the audience did not quiet down the meeting would be adjourned with no action taken on the matter before the Council, CHANGE OF AMENDMENT: Vice Mayor Gallagher, with the consent of his second, changed the amendment to read: "and similarly we urge the government of Hanoi that there be total withdrawal c: af? foreign military forces in Southeast Asia by December 31, 1971," The amendment failed on the following z-oll call vote: Ayes: Arnold, Dias, Gallagher, Wheatley Noes: Beahrs, Berwald, Clark, Comstock, Norton, Pearson, Spaeth The motion failed on the following roll call vote: Ayes: - Comstock, Pearson, Spaeth Noes: Arnold, Beahrs, Berwald, Clark, Dias, Gallagher, Norton, Wheatley 2.k.litjournrrient The meeting adjourned to an Executive Session at 111:55 p: m. regard- ing personnel.
