The Council of the City of Palo Alto met on this date in a regular
meeting with Mayor Wheatley presiding:
Present: Arnold, Beahrs, Berwald, Clark (arrived 7:40 p.m.),
Comstock, (arrived 8:05 p.m.), Dias, Gallagher,
Pearson, Spaeth (arrived 7:50 p, m. ), Wheatley
Absent: Norton
Minutes of January 25, 1971
Councilman Dias requested that page 518, line ?8, "Planning Policy
C_ornmittee' be changed to read "Planning and Procedures Committe:-
See Page 1t
Councilman Dias also requested that on page 520, line 21, the follow-
ing words be added: "Councilman Dias reported the announcement -
of a dues increase for Palo Altn/aaerting the Council to the important
question of who pays and is participating in the coastline study."
Councilman Pearson requested that page 520, line 10, be recorded
as a majority vote and not a unanimous vote.
The Minutes we. -e approved as corrected.
Subdivision -
Country Club West
MOTION: Councilman Beahrs moved, seconded by Arnold, to up-
hold the recommendation of approval of the final subdivision of
Country Club West Unit No. 2 (30 lots), .adjacent to Palo Alto Golf
and Country Club. subject to conditions- contained in Staff Report of
January 22. 1971, an,1 an additional condition tnat the applicant con-
struct barriers at the ends of stubbed streets to prevent automobiles
from passing into adjacent properties.
The motion carried by a majority voice vote.
Councilman Pearson asked that her vote be recorded as a "No" vote.

"On Sale General" (Eating Place) License
The Shutter, 482 University Avenue
MOTION: Vice Mayor Gallagher moved, seconded by Pearson, to
file without action the application for an "On Sale General" (Eating
Place) License for The Shutter, 482 University Avenue.
The motion carried unanimously.
Trans ion Policy Committee
MOTION: Councilman Arnold moved, seconded by Beahrs, to table
the Transportation Policy Committee report.
The motion carried by unanimous voice vote. (See page 531, )
Downtown Palo Alto
MOTION: Mayor Wheatley moved, seconded by Arnold, that the
staff be directed to de.veIop cost information and a complete pro-
gram for Council review on opinion survey as outlined in Mayor
Wheatley's memo dated February 4, 1971.
AMENDMENT: Councilman Berwald moved, duly seconded, to
amend the motion that the Planning rommiSion review and comment
en the program prior to its being returned to the Council.
Mayor Wheatley asked if there were objections to hearing from the
public at this time.
There were no objections.

The amendment failed by the following roll call vote:
Ayes: Beahrs, Berwald, Pearson, Spaeth

The motion passed by majority voice vote.
Noise Abatement Devices
on Power Mowers
MOTION: Councilman Pearson moved, duly seconded, to continue
the i.tern regarding noise abatement devices on power mowers to the
next Council meeting.
The motion carried by a majority voice vote.

Upper k'oothills
Ballot Measure
Councilman Dias asked that the following corrections be made in
her letter dated February 5, 1971 that was sent to Council:
1) On the second line of paragraph 1 the word "placing" should
be "purchase."
2) Question No. 2 at the bottom of page 1 should read "Are you
in favor of land banking all presently undeveloped land in the
lower foothills through purchase by: ... "
MOTION: Councilman Dias moved, seconded by Berwald, to refer
to the Finance Committee and staff for the purpose of formulating
one or more advisory questions on the ballot in regard to open
space in the up;ei foothills and land banking of the lower foothills,
this report to be returned to the Council by February 22,
AMENDMENT: Councilman Berwald moved to amend the motion to
add after land banking the words "open space district."
POINT OF ORDER: Councilman Spaeth asked if it was not in con-
flict of interest for Mayor Wheatley to take part in this discussion.
City Attorney Stone stated tat a referral to staff is not a conflict
of interest.
ST:t'BSTITUTP MOTION Councilman Comstock, moved, seconded
by Spaeth, that the whole matter be referred to the Finance Com-
rnittee and that the Committee, after receipt of the Livingston and
Blayney report and consideration of aeailable alternatives, work
with the staff to return a reco rnendation to Council.
Vice Mayor Gallagher moved, duly seconded, to hear from the public.
The motion passed unanimously.
Joan Johnston, Board of Directors of the League of Women Voters,
813 Cedre Way, Stanford, stated they were happy that the citizens
would have an opportunity to vote on the foothills question and hoped
the ballot measure •rould be a binding and not an advisory vote.
Geri Steward, 4187 Coulornbe Drive, asked the Council to submit a
binding vote to the electorate.
The substitute motion failed by the following roll call vote:
Ayes: Comstock, Pearson, Spaeth
Noes: Arnold, Beahrs, Berwald, Clark, Dias, Gallagher,
Wheatley

AMENDMENT: Councilman Comstock moved, seconded by Pearson,
to amend the motion by adding the following words "and these matters
Le considered in conjunction with the review of the Livingston and
Blayney recommendations."
The amendment carried by a majority voice vote.
The motion as amended passed by a majority voice vote.
(The Council recessed from 9:08 to 9:30 in an executive ses-
sion regarding personnel.)
(Councilman Spaeth did not return after recess.)
Transportation Policy Committee
MOTION; Councilman Arnold moved, duly seconded, to lift the
Transportation Policy Committee item from the table.
The motion carried unanimously.
Councilman Comstock reported the details of the proposed plan to
obtain federal funding for a County Transportation Project.
Minutes of Ja.n 5, 1971
City Clerk F arish noted in her memo to Council dated February 8,
1971, that the Minutes of January 5, 1971 were distributed without
page no. 497 (a); that since these Minutes were approved January 18,
she asked the Council to approve the addition.
The addition to the Minutes of January 5, 1971 was approved as
written.
Comr uni Theatre:
Councilmann Arnold spoke in high praise of the current play at the
Community Theatre (The Price) and extended his congratulations
to Ralph Schram, the directors, and those concerned.
Nei hbora�ood Park -Monroe Area
Councilman Berwald spoke of a group of interested citizens who
would like• to have a neighborhood park near Monroe Avenue.

Oral Cornrnunications
Jean Hobs en, 656 Chan lihig Street, called upon the Council
to join in urging international investigation of the U. S. War crimes.
