HomeMy WebLinkAbout02011971Li„ioutt‘i MJNUTES city of Palo alto Civic Center Palo Alto, California February 1, 1971 The Council of the City of Palo Alto met on this date in a regular meeting of February 1, 1971 with Mayor Wheatley presiding: Present: Arnold, Beahrs, Berwald, Clark, Comstock, Dias, Gallagher, Norton, Pearson, Spaeth, Wheatley Absent: None Mayor Wheatley welcomed a group of cadet Girl Scouts to the Council Meeting. Minutes of ,January 18, 1971 The Minutes of January 18, 1971 were approved as written. Canvass of Votes Mayor Wheatley appointed_ Councilmen Berwald and Norton to conduct the canvass of returns. and Councilmen Arnold -and Clark to canvass the absentee ballots. Mayor. Wheatley announced the whc:le number of votes cast in the Special Election h lid on January 26, 1971 was 16,841. The whole number of votes cast for the proposition was 6, 572. The whole num- ber of vate3 cast against the proposition was 10, 269. MOTION: Councilman Berwald introduced the following resolution and moved, duly seconded, its adoption: Resolution No. 4422 entitled 'ill esolution of the Council of the City of Palo Alto Declaring the Results of the Special Referendum Election Held on January 26, 197 I in the City of Palo Alto." The resolution was adopted by unanimous voice vote. General Muaici al Election - Ma 11 1971 MOTION: Councilman Arnold introduced the following resolution and ;moved, seconded by Beahrs, its approval for adoption. Resolution No, 4423 entitled "Resolution of the Council of the City of Palo Alto Requesting the Board of Supervisors of the County of Santa Clara to Permit the Registrar of Voters to Assist the City Clerk in the Conduct of the General Municipal Election and Any Special Election to be Held on May 11, 19/1." The resolution was adopted by unar.;mous voice vote. Reeppo®rt of Transportatic nn Yo gic Committee Representative MOTION: Councilman Comstock moved, duly seconded, to continue the report from the Council Representative of the Transportation Policy Committee for one week. The motion carried by unanimous voice vote. S2ecial Municipal Election - January 2o, 1971 Mayor Wheatley asked if there were objections to hearing from the public at this time, There were no objections. Janice Trick ett, 626 Wellsbury Way, spoke of the results of the election which she felt indicated a vote of "no confidence." Bryant Street Project MOTION: Councilman Arnold introduced the following resolution and moved, seconded by Norton, its approval for adoption: Resolution No. 4424 entitled "A Resolution Terminating Pro- ceedings -- University Avenue District -- Bryant Street Off - Street Parking Project -- Assessment District No. 70-93" The resolution was adopted by unanimous voice vote. MOTION: Councilman Arnold introduced the following resolution and moved, seconded by Clark, its approval for adoption: Resolution No. 4425 entitled "A Resolution Retaining Jurisdic- tion to Act -- University Avenue District -- Street Lighting Assessment District -- Project No. 70-94" (The date for said action to be taken at the Council Meeting to be held on March 1, 1971.) The resolution was adopted by majority voice vote: 522 2/1/71 MOTION: Councilman Clark introduced the following resolution and moved, seconded by Gallagher, its approval for adoption: Resolution No. 4426 entitled "A Resolution Retaining Jurisdic- tion to Act -- University Avenue District -- Beautification Assessment District -- Project No. 70-95" (Said action to be taken at the Counc:1 meeting to by held on March 1, 1971.). The resolutfi n, was adopted by unanimous voice vote. MOTION: Councilman Dias introduced the following resolution and moved., seconded by Clark, its approval for adoption: Resolution No. 4427 entitled "A Resolution Terminating Street Vacation Proceedings Bryaet Street Project" The resolution was adopted by unanimous voice vote. Downtown Beautification MOTION: Councilman Pearson moved, seconded by Comstock, that See Book 21 the Planning and Procedures Committee be assigned the task of Page 1 determining the system to he used to enable the City of Palo Alto to sponsor a comoetition_feree unified plan for Downtown Palo Alto. The motion carried by the following roll call vote: Ayes: Arnold, Comstock, Dias, Gallagher, Norton, Pearson, Spaeth Noes: fieahrs, Be' Wald, Clark, Wheatley Enfranchisement of 18 Year Olds MOTION: Vice Mayor Gallagher introduced the following resolution and moved, seconded by Comstock, its approval for adoption: Resolution No. 4423 entitled "Resolution of the Council of the City of Palo Alto Urging the Enactment of Legislation Which Would Enfranchise Otherwise Qualified Persons of the Age of X18 Years and Older in the State of California in all State and Local Election s AMENDMENT: Councilman Comstock moved to amend the resolution by adding Governor Ronald R eagan's name to those receiving a cer- tified copy of the resolution in Section 3, The amendment carried by a majority voice vote. The resolution as amended was adopted by unanimous voice vote, 523 2/1/71 "On Sale General (P'ublic PreTrusesL Rancho Inn ._.�. 3901 El Camino Real (CMR:736:1) License -- El MOTION: C ou.nciirnan Arnold moved, duly seconded, that the applica- tion for an exchange of an existing "On Sale General (Eating Place).' alcoholic beverage license for an "On Sale General (Public Premises)" license from El Rancho Inn 3901 El Camino Real, be filed without protest. The motion carried by unanimous voice vote. "On Sale General Eati.n Piacej" License - Rudolfo's 4020 El Cainino Real (CAM:735:1) MOTION: Maier Wheatley moved. seconded by Gallagher, to file without action the application to drop one of the four partners from an existing "On Sale General (Eating Place)" .License for Rudolfo`s, 4080 El Canino Real. The motion carried by unanimous voice vote. Non -Returnable Bottles MOTION: CouncilmanClark introduced the following resolution and moved, seconded by Beahrs, its approval for adoption: Resolution No. 4429 entitled "Resolution of the City Council of the City of Palo Alto Urging the League of California Cities and the County Supervisors' Association of California to Seek Action to Alleviate the Problem of Litter and Waste Disposal Created by the Sale of Beverages in Disposable Non -Returnable Containers. AMENDMENT: Councilman Comstock moved, seconded by Pearson, to amend the resolution by adding Section (d) "consideration of reso- lution which would result in the eventual prohibition of the sale and distribution of non -returnable containers." The amendment carried by unanimous voice vote. The resolution as amended was adopted by unanimous voice vote. Councilman Clark acknowledged the letter received from Peter Standish of Ecology Action addressed to the Council and regarding disposable container e. 5Z4 2/1/71 Ordinance Relating to Four or More Unrelated Persons Sharing a Single Fami�Drelling Unit in an R-1 Zone MOTION: Councilman Spaeth moved, seconded by Pearson, that the following matter be referred to the Planning and Procedures Com- mittee: "That the Committee, with the assistance of the City Attorney and staff: (a) Consider the merits and recommend a response to the petition dated December 14, 1970 containing 1,766 signa- tures; (b) Study the laws, including their ;cur poxes, to which the petition refers and which were litigated; Render its opinion as to the efficacy and /or desirability of existing legislation and, it indicated, suggest alterna- tives or amendments thereto." MOTION: Vice Mayor Gallagher rnoved, duly seconded, to hear from the public at this time. The motion carried by voice vote. Dan Feshback, 626 Wellsbury, spoke of the harrassrnent of communes in the City. Roberta Cane, 626 Webster, spoke of a vacant house on Forest and Webster which had been allowed to become a dangerous hazard and asked the City to have it demolished. Mrs. Cane was advised the City had issued notice for demolition and there was a :natter of a legal time limit, before the City could take further action. Ellen Wilson, 1036 Colorado, spoke of the need for low -moderate income homes. John Rogers. 626 Wellsbury, spoke of his friends effort* to defeat the Superbiock because they wanted to see homes, not office buildings. Janice Trickett, 626 Wellsbury Way, spoke of diacrimination in housing, such as discriminating against people living in communes, and stated she felt all discrimination was against the law. Robert Johnson, 1636 Channing, spoke against any repeal of the ordinance. 525 2/1/71 Phil Trountstine stated he had left his commune home because of per- secution but did not intend to leave Palo Alto, Norton Tooby, 347 Alma, attorney for plaintiffs against the ordinance stated the First District Court has ruled against the plaintiffs but they are preparing an appeal. The motion to refer failed on the following roll call vote: Ayes: Berwald, Clark, Comstock, Pearson, Spaeth Noes; Arnold, Beahrs, Dias, Gallagher, Norton, Wheatley Federal Aviation Agent traffic Patterns MOTION: Councilman Pearson introduced the following resolution as an emergency item and moved, seconded by Comstock, its appro- val for adoption: Resolution No. 4430 entitled "A Resolution of the Council of the City of Palo Alto Requesting the Holding of a Public hearing, By the Federal Aviation Agency, Prior to any Change in Regu- lation of Routes for Cornnnercial Aircraft Flights in the San Francisco Bay Area," Mayor Wheatley asked if there were objections to hearing from the public. There were no objections. See Book ?i Laurence Slote , 3749 Starr King Circle, stated he had been advi* ed Page 1 that 137 additional flights over Palo Alto were part of a proposed plan which had been under testing since December 29, 1970, and final decisions were to be made shortly by the FAA confirming the flights world be over Palo Alto. The resolution was adopted by the following roll call vote: Ayes: Arnold, Clark, Comstock, Norton, Pearson, Spaeth Noes: Beahrs, Berwald, Dias, Gallagher, Wheatley Oral Communications 1. Jim McBride, 433 Hamilton, protested the new traffic laning on Hamilton, University and Lytton. 2. Mrs. E. M. Kinderman, 725 Cowper, stated she would send her information to the Council in some other way rather than speaking under Oral Communications. 526 2/1/71 3. Dan Feshback, 626 Wellesley, spoke of many cornxnunes in Palo Alto not being investigated. 4. Ellen Wilson, 1036 Colorado, stated young people are ignored by the Council. 5. S. Shapiro, no address given, spoke in favor of the communes. 6. Crystal Gama.ge, 1668 Charming, member of a subcommittee of the Human Relations Commission, stated she saw no one in the audience who had attended the many meetings held by the Human Relations Commission concerning communes and this ordinance. 7. Dr. Anny Doyle, 3759 Nathan Way, stated she had attended the meetings referred to by Mrs. Gamage. Adjournment Mgs"3ON, Councilman Arnold moved, seconded by Gallagher, to adjourn.
