WHEREAS, said City Council d1d on the 31st day of' October, 1949, pa:.:ic 1 ts Reaolt:tion No. 1910 of Preliminary Determination to mn~e Lhc public improvements as therein more particularly des­ cribed, ;md d:!.•j t.herein fix the time and place when and where said Coimc11 would hear an~: and all persons interested therein; WHEREAS, the City CJ.erk of said City duly gave notice of the time nnd place of said hearing, in the time, form and manner provided b~r 1aw; wnEREAS, th1.s ls the time and place fixed in said resolu­ tion wh~n and where sa!d Council will hear said protests and objections; WHEREAS, written and oral protests and ob,jections neainst the proposed improvement~~, or against the district to be assessed for the costs and expenses thereof, or to the City Engineer's estimate of che costs and expenses thereof, or against the grades at whlch said work shall be done, or against the diagram or assessment, have been filed with the City Clerk or sald City at or before the time set for said hea~lng by persons in­ terested or who are owners of property whlch is subject to assess­ ment in said proceedings; and WHEREAS, said City Council has duly hea.rd and considered. each and all of said protests and objections and each and all persons desiring to be heard in connection with said matter was and were given ~, n opportunity to and did present their said protests and objections, and said matters were fully presented, heard and considered by said Co~ncil; and WHEREAS, it appears, and said Council so finds, that said prote3ts so filed were not filed by the ownera of more than one­ half of the area of the property to be assessed for said im­ provement. NOW, THEREFOR!';, IT IS RF.SOLVED and ORDERED, as follows: 1. Said protests trnd ob;)ections be, and the:1 and each and all of them a!'e hereby, overruled and denied. 2. In the acqu1s1t1on of the easement numbered P~rcel 23 from Sam Duca and Lydon J. Hanley, there shall be reserved to the owners of the property over which said easement is to be ac­ quired the right to use the surf ace of the property during the normal life of the existing building on said property. * * * * * * I hereby certify the foregoing to be a true copy of resolu­ tion adopted by the City Council of the City of Palo Alto, California, at a regular meeting thereof held on the 14th day or November, 1949, by the folloNing vote of the members thereof: ~i ·'~·'It_~.". •. ~',.'
