HomeMy WebLinkAboutRESO 1910\ that R E S 0 L U T I 0 N ----------N 0 • 1910 OF PRELI?i-..INARY DETERMINATION CA.LIFORNIA AVENUE DISTRICT ACQUISITION AND IMPROVEMENTS PROJECT NO. 48-9D RESOLVED, by the Council of the City of Palo Alto, Cal1forn1a, 267 WHEREAS, pursuant to Resolution or Intention No. 1721, adopted by this Council on July 26, 1948, and subsequently modified, the acqu1s1t1on or certain easements and the relocation of improvements thereon has been ordered; WHEREAS, on further cona1derat1on this Council does find and determine that the public interest and necees1ty will be best served by further modifying the af'oresa1d proceedings by consoli­ dating improvements or the alley~ with their acquisition. NOW, THEREFORE, IT IS HEREBY PRELIMINARILY DETERMINED that th~: public convenience and necessity require and 1 t 1s the intcn­ t11)n of this Council to order as follows: 1. That the following work be done and improvements be made in and for said City, to-wit: a. The improving of unnamed alleys proposed to be ac­ quired within the 'block~ hounded by Cambridge Avenue, Cnliforn1a·1 Avenue, Park Boulevnrd and El Camino Real, and California Avenue, Sherman Avenue, Third Street and El Camino Re~l, all as more particularly described in maps and diagrams on file in these proceedings, by grading, removal of' existing trees and structures, constructing storm water ~atch basins and drain pipe, and constructing crushed rock base pavement with asphalt1c concrete wearing surface between property lines. b. The improving of unnamed pedestrian lanes proposed to be acquired within the blocks bounded by Cambridge Avenue, Californ:l.a. Avi~nue, Second Street and El Camino Real, and California Avenue, Sherman Avenue, Third Street and El Camino Real, all as more part1cularly·descr1bed in maps and diagrams on file in these proceedings, by grading, removal or existing structures and constructing crushed rock base pavement with asphaltic concrete wearing surface between property lines. 2. All of said work and improvements are to be constructed at the places and in the part~cular locations, of the forms, sizes, a.nd dimensions and materials, and to the lines, grades, and eleva­ tions as shown and delineated, upon the plans, profiles and speci­ fications prepared therefor, and on file in the office of the City Engineer in the City Hall of said City, re:rerence to which is hereby made for full and detalled description of said proposed work and for further particulars. 3. There is hereby excepted from the above work that which is already done to line and grade, and marked excepted or shown not to be done on the plans, profiles and specifications. 4. The City Council does hereby adopt and establ~sh as official grades for said work and grades and elevations shown upon said plans, profiles and specifications. All such grades and elevations are in feet ar1d decimals thereof in reference to the offical base and datum plane of said City. ;;i..~ ' .. ,.,~, ........... ~ ............. ,~ .. - 268 5. .Ul of sa~.d worl< shall be done under the supervision of the City Engineer or the City of Palo Alto, and all or said work and materials ahall be done and 1.'urnished to his satisfaction. 6. A map or plat of the land8 and improvements necessary and conven1~r.t to be taken for such propoaed 1•provements has been filed with the City Clerk and the acqu1s1t1ons ordered by the City Council, to which reference is hereby made for further particulars. 7. A statement of the total estimat~~d cost of said improve­ ments, stating separately the estimated cost of each class of construction proposed, and of the incidental expenses of said proceed.ings and improvement hasl'.been filed w1 th the City Clerk and approved by the City Council, to which reference is hereby made for r~rther particulars. 8. Saij contemplated improvements, :'1.n the opinion of this Council, are of more than local or ordinary public benefit, and the costs and expenses of doing said work and expenses incidental thereto, shall be made chargeable upon the district benefj. ted thereby, which district 3hall consist of the consolidated and composite areas of all of the parcels or property fronting on sa1d work, and the exterior boundaries of said district are hereby de­ clared to 'be the coterminous boundaries of said composite and consolidated area. The property so benefited, and the boundaries thereof, are more particularly shown on the map of said assessment district on file in the office or the City Clerk or said City, to which reference is made· for more detailed description thereof. 9, All publ.tc streets, alleys, and ways in use in the per­ formance of public functions shall be omitted from the assessments hereafter to be made to cover the cost of said improvemEmt. 10. Notice is hereby given that serial bonds to represent the un~aid asses$menta to oear interest at the rate of not to exceed four per cent (4%) per annum shall be issued pursuant to Part 4, Bond Plan C of Article IV of the Palo Alto Improvement Procedure Code, the last installment of which shall mature nine years (9) from the second day of July next succeeding ten months from their date. 11. ~xcept as herein otherwise provided for the issuance of bonds, a:j of the above proposed work shall be done in pursuance of" the pr·.>visions of Article V in said Palo Al to ImpI•ovement Procedurt:. Code. 12. Said improvement proceedings are analogous ana similar 1n effect to those provided in California Statutes 1913 at page 421 et. seq., as amended, and said bond proc~edings are analogouG a~d 1n similar effect to those provided in Division 10 of the Ca11f()rn1a Streets and Highways Code, and, excepting as herein otherwise provided, these proceedings shall respectively be deemed to be taken pureuant thereto. 13. Notice .1s hereby given that Monday 'che 14th day of November, 1949, at the hour of 7:30 o'clock P.M., at the Council Chambers of City Council of aaid City in the City Hall of said City are hereby fixed the time, place when and where any and all persons interested may appear and show cause, if any they have, why the City Council should not find and determine th.:l.t the p~blic convenience and necessity require the improvements described and referred to in this Resolution, w:t. thout further compliance with the Special Aasesament Investigation, Llm1tation and Majority Protest Act of 1931, as provided in Article I of said ordinance. • _ _J ~ .. -~--><•• •-"H • ... ,., .. The Clerl( or the City of Palo Al to shall give notice or the adoption of this resolution by publ1sh1ng a notice of pro­ posed local improvement once :tn the Palo Alto Times, a daily news­ paper published and circulated in said City and by posting same o:n or near the Council Chamber door of said Council, said posting and publication to be had at least ten days before:iaid date of hearing. * * * * * * 269 I hereby certify the foregoing to be a true copy of resolution adopted by the City Council of the City of Palo Alto 1 California, at an adjourned regular meeting thereof held on the 31st day of October, 1949, by the following vote of the members thereof: AYES, and in favor thereof, Councilmen; Bentrott, Blois, Bolander, Bowden, Cashel, Cathcart, Freedman, Hill, Linder, Merner, Mitchell, Montrouil, Morten, Wickett.
