STORM SEWDS PROJECl' NO • .\9-t> RESOLVED, by the City Council of the C1ty of PalQ Alto, ca11rorn1a,, th&t VHEREAS, said Cit7 Council did on the 12th day or September, 1949, adopt its Resolution or Intention No. 1883 to order certain improvements to be me.de in sai~ City, under and pursuant to Arti­ cle V or Ordinance No. 844 or said City ,, adopted January 13, 194-lJ entitled "Palo Alto Improvement Procedure Code", and to issue bonds pursuant to Part 4~ Bond Plan C of Article rv or said Ordi­ nance No. 844, ref,erence to which re3olut1on or 1ntent1on is here­ by made for a particular description of the improvement to be made, the boundaries or thd assessment district, and the bonds to be 1asued; WHERE.AS, said resolution or intention has been duly published twice ln the Palo Alto Times, a newspaper ot general circulation printed and published in said City, wherein all persons interested, having any objections to the proposed improvements or against the distr:J.ct to be assessed for the coets and expenses thereor 1 or to the engineer's estimate or the costs and expenses thereof, or against the grades at which said work shall be done, or against the d1ag1•am or assessment, were notified or the time and place or the hearing a., contained 1n said resolution or intention and 1n- v1 ted to appear before said Council and show cause why ea1d pro­ posed improvem~nts should not be carried out in accordance w1th aa1d resolution of 1utent1on, which resolution or intention was duly published w1·thin the time and 1n the manner provided 1n said Improvement Procedure Code, A.nd as directed by said resolution or 1ntentj.on, as appears rrom t~ af.f1dav1t of publication on file in the office or the City Clerk or said City; WHEREAS, at th6 time and place t"ixed for said hearing pretests or objections were made or presented to the propose_d..._.1-m--~ provemente, or to the district to be assessed, or to the grades at which •aid work was to be done, or to the bonds to be issued to pay the costs and expenees thereof, or to the engineer's esti­ mate or the coats and e:icpenaes thereof, or against the d1agra~ or assessment, and all persona intereated dee1r1ng to be heard were given an opportunity to be heard, and all matters and things per­ taining to said propoeed improvements were duly heard and conside­ ered by said Council, and said protests overruled, and said City Council has acquired jur1adiot1on to order said improvementa and the con-, f1rmat1on of said assessment to pay the eosts and expenses thereof. NOV, THEREJPORE, eaid City Council does hereby FIND, DETERMINE and ORDER, as follows: l. That the plans and spec:U"icatione for et'reet improvements under sa1<1 Resolution of In.tention, as preliminarily approved by said City Council on August 8, 1949, be and they are hereby final­ ly adopted and approved as the plans and spec1r1cations to which said work and improvement shall be done as called tor in said resolution of intention. 2v That the engineer's estimate or the itemized and total estimated cost and expenses ror said improvements, as prelimin­ arily apprpved b7 said City Council on August 8, 1949, be and it is finally adopted and approved as the eng1neer•s total and detdiled estimate or the costs and expenses or said improvement. .... l i i l I i r } ' I j ' ! ], !. That the public interest and. convenience require, and. said City CoWlcil doea hereby order the improvements to be made as described in and 1n accordance with said. reaolut1on or 1nten­ tj.on, on file 1n the otf'1oe of the Ci t7 Clerk or eaid C1 ty, rere;r­ ence to which 1a hereby lll!lde for a more particular description ot said improvements and also tor further particulars, pursuant to the rrov1siona of Article V of said Improvement Procedure Code. 4. The Cj. ty or Palo Al to will cont:t1bute 1n caah $92. 37 aa its ehare of the cost and expense of said work to be done within the assessment area of the St. Francis Terrace Park. 5. That the map or the assessment district, as preliminar­ ily approved by the City Council on August 8, 1949 1 be and the same is hereby finally adopted and approved as the map or the assessment district, and the boundary of ea1d assessme11t district ao shown thereon is hereby determined and established to te the boundary of the assessment district to pay for the costs and ex­penses or said improvement. 6. l'ha.t the aaseeement and diagram for the coat and expenaea or the street improvements described in said resolution of inten­ tion, as preliminarily approved by said City Council on August 8, 1949, be and the same is hereby ratified, approved and confirmed as the assesament and diagram to pay the costs and expenses or said improvement. 7. That the City Clerk of said City shall deliver said dia­ gram and assessment to the Superintendent or Streets ot said City, together with a certified copy or th1e resolution thereto attached, and said SuPer1ntendent or Streets shall thereupon record such assessment and diagram 1n his otriee in a suitable book to be kept for that purpose and append thereto his certificate or the date of such recording, andt such record shall be the assessment roll to pay for the costs and expenses of said improvements. 8. Immediately upon such recor1at1on said Superintendent of Streets shall give notice thereof by two publications in the Palo Alto Times, a newspaper pr1ntediand published in aaid City, which notice shall set torth, among other things, that all sums assessed therein are due and payable at h1a office immediately, and that payment thereof 1a to be made to him within thirty days after the date or recording said assessment, which date shall be stated in said notice, and such other matters as are required by Section 7 of Article V ot said Improvement Procedure Code. * * * * * * * .. I hereby certify the f oreg011lg to be a true copy or resolu- tion adopted by the City Council or the City of Palo Alto, California, at an adjourned regular meeting thereof held on t~e 31st day or October, 1949, by the following vote ot the meut:.ers thereof: AYES, and in favoX' thereof, Councilmen: Bentrott, BloisJI Bolander, Bowden, Cash.el, Cathcart, Freedman, Hill, Linder, Merner, Mitchell, Montrou11, Morten, Wickett.
