RESOLVED, by the Council ot the City of Palo Alto,
Cal1torn1a, that
WHEREAS~ on the 26th day ot July, 1948, this Council
adopted Resolution ot Intention Ko. 1721 to .alee acqu1a1t1ona
ot easements and tb.e acqu.1a1t1on or relocation or the improve
ments thereon for alley, pedestrian lane, street widening and
pole line purposee;
WHEREAS pureuant to said resolution ot intention and
on January 10, 1949, thta Council adopted Resolution No. 18o9
ordering acqu1s1t1ona, as mod1tied, and Resolution No. 1810
directing the tiling of eminent domain proceedinga;
W'rlEREAS, pursuant to said resolutions, proceedings in
eminent domain ccmmenced Octobe1· 27, 1948 in the Superior Court
or the State of California in and ror the County of Santa Clara,
were amended on January 31, 1949, tor said acqu1ait1ona aa modi
fied, and are now pending in said Court; an~

WHEREAS 1 upon reconsideration, this Council doea find
and determine that the public interest and neoeae1ty w1ll be beat
served by further modifying the atore8a1d proceedings by acquir
ing eaaementa hereinafter described for alley, pedestrian lane
and pole 11ne purpoues.
NOW, THF..REFORE, IT IS HEREBY PRELIMINARILY DETER~IMED,
a.a follow~:
1. That the publtc convenience and necessity require,
and it 1s the intention or thie Council to order the acquisition or eae~mente for said alley, pedestrian lane and pole line pur
poses, together with the aoqu1a1t1on and relocation or the im
provements thereon on the tollow1ng parcels of land situate in
the City of Palo Alto, County of Santa Clara, State of Cal1torn1a,
to-wit:

the incidental expenaee ot aa1~ proceedings tor aa1d acqu1a1-
t1ona has beon filed with the Cit~ Clerk and approved by the
City Council, to wh1ch reference 1• hereby made tor rurthor
particulars.
4. Said contemplated acqu1s1t1ona. :n the opinion ot
th1a Council, are or more than local or ordinary public benefit,
and the cost and expense of 88JIMt and the expeneea incidental
thereto, ehall be made chargea.ble upon the d1atr1ct benefited
thereby, wh!eh district 1• bounded on the Horthweat b7 Caabr1dge
Avenue, Northeast by Third Street and Park Boulevard, Southeast
by Sherman Avenue and Southwest by El C8.ll1.no Real.
The properties so benetited, and the boundaries thereof,
a.re more particularly shown on the map or aa1d aaaeaament district
on file in the office of the City Clerk or aa1d City, to which
reference is hereby made tor a more detailed description thereof.
5. All public str~eta, alleys and waya or other public
property in ue8 in the pertormanoe ot the public tunct1on shall
be omitted rrom the aeaeaament h•re1na.fter to be made to cover
the cost of said 1mp~ovement.
6. Notice is hereby given that aerial bond.a to repre
sent the unpaid assessments and bear interest at the rate of not
to exce~d five per cent (5;} per annwn, will be 1asued pursuant
to hrt 4, Bon.:! Plan C ot Article IV ot the Palo Alto Improveaent
Proc~dure Code, the last 1nstall~ent of which shall mature nine
(9) years rrom the second day or July next succeeding ten months
from their date.
7. Except aa herein otherwiae provided tor the 1sauance or bonds, all or the above proposed w~rk shall be done 1n pur
suance of the provisions or Article III or said Palo Alto I.Jnprov~
ment Procedure Code.
8. Notice is hereby given that Monda7 1 the 10th day ot
October, 1949, at the hour of 7:30 o'clock P. M., at the Council
Chambers of the City Council of said City ln the City Hall or
aa1d C1ty are hereby t1xed aa the time and place when and where
any and all persona interested may appear and show cauae, or any
they have, why the City Council should not !ind and determine that
the public convenience and necessity require the improvements
described and referred to in this resolution, without further comN
pliance with the Special Aseesament Investigation, Limitation and
Majority Protest Act of 1931, as provided 1n Art1cle I or said
Ordinance.
9. The Clerk or the City or Palo Alto shall give notice
or the adoption or this resolution by publishing a Notice or
Proposed Local Improvement once in the Palo Alto T1mea, a news
paper published and circulated 1n ea1d City, and by posting same
on or near the Council Chamber door of said Council, aa1d posting
and publication to be had at least ten days before said date or
hearing.
