WHEREAS, on March 14, 1949, this Council adopted its
Resolution ot Preliminary Determ!.nation No. 1827 tor the acq·u1s1-
t1on and construction or certain pt·bl1c improvements more f'&:t•ticu
larly therein described and d1d .flx therein this date as the time
and place when and where Ml-' and all persons intereeted may ;11.ppear
and show cau21e, if any they have, why the City Council sho\.Ll1::l not
find and determine that the public convenience and necessity re
quire the acqu1s1 t1on s.nd improvements described and rtt!erre(:i to
in said resolution, without compliance with the Special AssErJement
Investigation, Limitation and MaJor1ty Protest ict ot 1931;
WHEREAS, notlce or the adoption of said preliminary re
solution and of said time and place of hearing waa given by the
City Clerk by publication and posting for the time and in th·1~
manner provided ln said resolution of preliminary determ1na.t:Lon
and Article I of the Palo Alto Improvement ?roceduI'e (;ode, a:s
appears from a.ff1davits on file w1t:h. the City ~l~!'k;
WHEREAS, written objections to the undertaking or :said
p:roceedings without first complylng with the prov1s1ona of sil1d
Investigation Act have been file<" with the C1 ty Clerk at or l)efore
the ttme fixed for thls hearing by persons interested, ownini~ or
having an int~rest in rec..1 property within the proposed asse:!5sment
di.strict, bearing their signatures, a description of t.he1r p:ro
perty, and a state!Tlent of the nature or their interest there:ln; and
WHEREAS, all personM interested have been g1ven an
opport:;.ni ty to be and were f\.llly heard, and said Counc j, 1 has duly
considered any a.nd all objections and prote3t8 made, and the said
proi)osed acqu!s1 t1on and 1mprovement8, and the public convEm'.lence
and necessity for making same •.
NOW, THEREFORE,, IT IS FOUND 1 DETERMINFJ) AND ORDF .• flEJ,, aa
follcws:
1. Tha.t the publlc convenience and necess1 ty requiire the
acqu1elt1on::i and improvement& described in said resolution o:r
pr~Hm1nary determ1natlon;
2. That any and all objections and protests made p1;ir
auant to said reaolut1on or prel1m1na~ determination be, an<1 the
same are hereby, overruled and denied;
3. That the acqu1 si t1ons and improvements de:scrU1e<! 1n
said resolution be made under and pursuant to the prov1s1oris or
the Palo Alto Improvement Procedure Code more particularly r~ferred
to 1n ea.:1.d !'"esolution, and. that the Spec1.al Asse5&ment InvEisi;1ga
t1on, I.1m1tat1on and MB.Jori ty Protest Act or 1931 shall not; apply
to said proceedings.
