The Council of the City of Palo Alto met on this date at 7:38 p.m.
with Mayor Dias presiding.
Present: Arnold, Beahrs, Berwald, Clark, Comstock
(arrived 7:40 p.m. ), Cooley, Dias, Gallagher,
Pearson, Spaeth (arrived 7:45 p.m.), Wheatley
Absent: None
Gas Tax Program - 1967 - 68 (CMR 68)
City Manager Morgan referred to his report of September 14, 1967
regarding the Section 2107 Gas Tax Program for 1967-68.
MOTION: Councilman Wheatley introduced the following ordinance
and moved, seconded by Cooley, its adoption:
Ordinance No. 2377 entitled "Ordinance of the Council of the
City of Palo Alto Amending the Budget for the Fiscal Year
196768 to Make an Additional Appropriation for Reconstruc-
tion of Select System of City Streets, Project No. 67-1."
The ordinance was adopted unanimously by voice vote.
MOTION: Councilman Wheatley introduced the following resolution
and moved, seconded by Cooley, its adoption:
Resolution No. 4034 entitled "Resolution of the Council of the
City of Palo Alto Adopting and Submitting a Budget for Expen-

The resolution was adopted unanimously by voice vote.

City Manager Morgan referred to his report of September 12, l%7
regarding the Oregon/Baysbore Pedestrian Overcrossing, Project
No. 64-9.
MOTION: Councilman Arnold moved, seconded by Pearson, that the
Council authorize an interfund loan from the Capital Improvement
Fund in the amount of $41,000 for a six-month period for the purpose
of carrying forward Project No. 64-9 through the planning and design
stages and to the initial stages of construction.
The mom carried unanimously by voice vote.
Notice re Local Buildin Regulations to

MOTION: Councilman Gallagher moved, seconded by Clark, to
notify the State Department of Housing and Community Develop-
ment that the approved building regulations in force in the City
of Palo Alto are equal to or greater than required by State law.
The motion carried unanimously by voice vote.
m rovement and Maintenance of Parking Lots (CMR 70)
City Manager Morgan referred to his report of September 13, 1967
regarding the status of Ordinance No. 2274 concerning paved park-
ing areas and barriers.
Discussion followed and Mr. Morgan and City Attorney Hildebrand
replied to questions concerning the provlerns encountered in en-
forcement of the ordinance, the compliance dates in regard to
paving and barriers, the background concerning adoption of the
ordinance and possible action the Council might take to relieve
hardship cases.
MOTION: Councilman Comstock introduced the following ordinance
and moved its approval for first reading:
"Ordinance of the Council of the City of Palo Ai;o Amending
Section 18.88. 110 of the Palo Alto Municipal Code to Postpone
Cornpiiaiice with Parking Lot Requirements."
AMENDMENT: Councilman Arnold moved, seconded by Beahrs,
that subsection (a) of Section 18.88.110 of the Palo Alto Municipal
Code be deleted and that the City Attorney be iasa_tructed to_redr ft =---
the ordinance for seconde __rad ing incorporating any char Ea re-
quie d -by the deletions.
The motion was duly seconded.
Following discussion of a point of order as to whether the amend-
ment was appropriately offered, Councilmen Arnold, with the con-
sent of his second, withdrew the amendment at this time.
MOTION CHANGE: At the request of Councilman Wheatley, Coun-
cilman Comstock, with consent of his second, changed the pro-
posed ordinance to read "until three months following completion:"
instead of "until the day following completion."

MOTION: Councilman Arnold moved that a section be added to the
ordinance that would delete the paving requirement from the Coe.!,
to read as follows: "Section Z. Subsection (a) of Section 18.88. 110
of the Palo Alto Municipal Code is hereby deleted."
The motion failed for lack of a second.
• MOTION: Councilman Cooley moved, seconded by Pearson, that
the categories numbered 3 through 7 in the City Manager's report
of September 15 regarding enforcement of the paving requirements
(CMR 70) be referred to the Planning and Procedures Committee
for prompt consideration and recommendation to Council of pos-
sible measures of correction.
("3. There are four properties where owners have
utilized a portion of their property for parking pending short-
term future building development. Requiring paving, barriers,
and fences, subjects them to a financial hardship, as these im-
provements must be removed prior to development.
"4. There are two parcels of property in the industrial
zone where heavy equipment such a►s tractors, trailers, semi -
trucks and various types of grading and excavating equipment
are stored. The movement of this equipment over a paved area
as required by the ordinance would destroy the surfacing.
"5. There are seven business property owners through-
out the City that claim the ordinance will create an undue hard-
ship to them, in thee; the existing customer parking spaces will
be substantially reduced by the placement of barriers.
"b. There are four non-profit organizations twat -pres-
ently have a hard surfaced red rock topping. This topping is
not in compliance with Ordinance 2274 and therefore must be
resurfaced, causing additional expense to its mercers,
"7. There are four lots► with a combined area for park-
ing of approximately 150 cars that were used for employee park-
in g;. However, due to the expense involved in paving, fencing,
and placement of barriers as required by ordinance, the owners
have chained off the property, thus creating an additional park-
ing load on City Streets.")
MOTION: Councilman Spaeth moved, and it was duly seconded,
to continue the matter until the third regular Council meeting.
Robert 3. Debs, 51455 Flowers Lane, Palo Alto, urged enforce-
ment of the barrier requirement in regard to categories 3 and 5
as 4 safety matter.

The motion to refer then failed by majority voice vote.
Alcoholic Beverage Control Licenses
MOTION: Councilman Cooley moved, seconded by Wheatley, to
ask the City Attorney to determine what measures could be taken
to control the number of liquor licenses issued to establishments
in Palo Alto, taking into consideration the number and date of
issuance of such licenses during the past five years and recom-
mending procedures for tighter control.
Discussion followed and City Attorney Hildebrand replied to ques-
tions concerning State control of such licenses and the present
limitations.
The motion carried by majority voice vote.
Procedural Code
Mayor Dias announced that the Planning and Procedures Committee
would consider the Procedural Code at its meeting of October 9
and urged councilmer to submit in writing any suggestions, recom-
mendations or comments concerning the Code to the Committee as
soon as possible. Mayor Dias noted that Chairman Beahrs had
indicated that a list of the procedural items to be considered would
be compiled and di tributed to those who had indicated interest.

MOTION: Councilman Berwald moved, seconded by Beaters, to
refer the application of Cornish ik Carey, acting as agents for the
Bank of America, for the partial abandonment of a public alleyway
bounded by University/Bryant/Lytton/Florence to the staff for a
report to the Council and to the Planning Commission with the re-
quest that the Planning Commission expedite the matter and return
it to the Council with recommendations it the earliest possible time.
The motion carried unanimously by voice vote.
Oral Communications
Mrs. Langhof, 1520 Middlefield Road, Palo Alto, requested
action be taken to relieve the noise at Middlefield Road and
£mbarcadero which. Is created when automobiles cross the

planks placed there today in connection with construction of
the new left turn signal.
In reply to question, City Manager Morgan indicated that the
planks cover a potentially hazardous hole required for under-
ground work in connection with the t - w left turnsignal, that
they will be removed in a day or two and that he would immedi-
ately attempt to relieve the noise problem.
