HomeMy WebLinkAbout05221967City Hall Palo Alto, California May 22, 1967 The Council of the City of Palo Alto met on this date at 7:30 p. m. with Mayor Dias presiding. Present: Arnold, Beahrs, Berwald, Clark, Comstock, Cooley, Debs, Dias, Gallagher, Pearson, Rohrs, Rue, Wheatley Absent; None Approval of Minutes assimms The Minutes of the Council rn eeting of Monday, May 8, 1967 were approved. He, -in$ - El Camino Real Widening Project No. 64-1 Mayor Bias opened the Heariag on the El Camino Real Widening Project No. 64 -1 and outlined the procedure to be followed. (NOTE: Present and seated with the City staff were: Kenneth 1. Jones, Bond Counsel; Elsner M. Berliner, Real Estate Appraiser; and Paul Schiller, Certified Shorthand Reporter. A full transcript of the entire Hearing was made for inclusion in the Pen ect No. 64-1 file.) City Clerk Klamm reported as to affidavits of publication, posting and mailing, and stated the map showing boundaries of the assess- ment district was filed at 2:28 p, m., April 6, 1967 in Book 2 of maps of assessment districts on pages 143 through 151. City Manager Morgan outlined the background of the project and the scope of the proposed improvements. City Engineer Witbeck gave a description of the project and the engineer's statement of benefits. Mr. Witbeck also read a statement concerning his qualifications and experience with similar projects. Bond Counsel Jones described the legal procedures and require- ments of the Hearing and the functions of the staff. Real Estate Appraiser Elmer M. Berliner outlined his qualifications and experience as an appraiser and read his report entitled "Study of Benefits Expectable, Project No. 64-1 El Camino Real Improvement, Revised to include the years 1965 and 1966" which was then submitted to the City Clerk to become part of the Project No. 647,1 file. 185 5/22/67 Mr. Jones then referred to wall charts prepared from information submitted by Mr. Berliner and depicting increased property values on El Camino Real as a result of other improvement projects. Mrx. Klamm read the written protests and letters in support of the proposed improvement project. (The Council recessed from 9:28 to 9:39 p. an. ) Mayor Dias stated that oral testimony and co^mients by any interested citizens would be heard. John Traynor, 30 Churchill Avenue, representing Traynor & Silver, stated that he would defer to the representative of the El Camino Real Property Owners Association of Palo Alto. William E. Attch.Amvit, ttnrney for Rickey's and Dinah's on El Camino Real., stated his clients objected to the property acqui- sition for on -street parking. A. Crist, Jr. , attorney for Ray Handley, owner of Dinah's, spoke in favor of the project in general, but opposed to the property acquisition to provide on -street parking. William S. Love, attorney for George Casten, spoke in opposition to the acquisition of property for sidewalks and`,sn-street parking. Elaine Therin, attorney for Clark Service Station, spoke in opposition to the acquisition of property for sidewalks and on - street parking. James Nute, President of the Pain Alto Chamber of Commerce, stated their Board of Directors has beery on record in favor of the project, including the 120 -foot street width, and 'upon reexam- ination of the situation wishes to reaffirm its position. Mr. Nute read the Chamber of Commerce recommendation. Richard D. Maltzman, attorney for El Camino, Real Property Owners Association of Palo Alto, stated he would make a complete presentation on behalf of the Association. He presented protests received late from Robert and Bettina Smith and Joe and Doris Chew. Mr. Maltzrnan distributed copies of a statement by Oj L. Olsen, civil engineer. O. L. Olsen, 6 Tevis Place, Palo Alto, then replied to questions by /,tr. Maaltzman as to details of his parking space report which was th.n, filed with the City Clerk. 186 52/67 Mr. Maltzrnan read his own prepared statement concerning assessed valuation of land,distributed copies to the Council and filed the statement with the City Clerk. Charles P. Bonini, Associate Professor of Statistics in the Graduate School of Business at Stanford University, stated his qualifications and experience and replied to questions from Mr. Maltzman regarding his review of Mr. Berliner's figures and referred to a wall chart of his "Comparison of Increases in Value of Land on El Camino in Palo Alto". Copies of the wall chart were distributed to the Council and filed with the City Clerk. David Ingraham, Jr. , Real Estate Consultant, Menlo Park, replied to questions from Mr. Maltzman regarding his qualifi- cations and experience and his review of tht, benefit study presented by Mr. Berlin_. Mr. Maltzman and his witnesses then replied to questions from members of the Council and the staff concerning details of their testimony. City Engineer Wh'itbeck stated that rough calculations of the property represented by the protests presented earlier appeared to be approximately 71.6% and would therefore seern to represent a majority protest of property owners in the proposed assess- ment A ai rier-t assess- ment � 1M M 4. MOTION: Councilman Beahrs moved, and it was duly seconded, to continue the Hearing and adjourn until June 5, 1967. Discussion followed as to the content'vf .he staff reply to Mr. Maltaman's presentation and any other information which might be provided by the staff. MOTION: Councilman Beahrs moved, seconded by Rohrs, that the four public hearings on the El Camino Widening Project No. 64-1 be continued to June 5, 1967_ The motion carried unanimously by voice vote. The Council adjourned at 12:48 a. m. r The Council cf the City of Palo Alto met on May 23, 1967 at i2:49 a. m. in a special meeta.ng to consider a resolution presented as an urgent matter by Bond Counsel Jones. No objections to the.•neeting were expressed by Council members. Present: All Council members were present. Bond Counsel Jones stated the urgency in regard to adoption of a resolut:ion to be considered at the continued hearings to he held on June 5, 1967. See Page 204 MOTION: Councilman Rohrs introduced the following resolution and moved, seconded by Beaters, its adoption: Resolution No. 4401 entitled "A Resolution of Preliminary -Determination and of Intention to Make Changes and Modifications El Camino Real Widening Project No. 64-1" The resolution was adopted by the following roll call vote: Ayes: Arnold, Beaters, 13erwald, -- Cooley, Dias,_Gallagher;-Pearson, Rohrs, Rya,._ Wheatley Noes: None Abstain: t)ebs Adiour rtrnent There being no further' business, the special meeting adjourned at 12:52 a. am.
