Present Arnold, Beahrs, Cooley, Debs, Dias, Flint (arrived 7:46 p.m.) Pearson, Rohrs, Sher (arrived 7:38 p.11). ) Worthington (arrived 7:40 p.m.) Absent: Comstock, R us ,Approval of Mileate The Minutes of the Counc.1 meeting of April 10, 1967 were approved. Zonin Chan t e - 1700 Block of Embarcadero Road Councilman Pearson stated that since her husband's company is a property owner in the same tract she would not take part in the dis- cussion nor vote on the matter of a change of disrric.t application in the 1700 block of Embarcadero Read. Councilman Arnold then noted the absence of a quorum. MOTION: Councilman Arnold moved, ana it was duly seconded, to continue the zoning change request pending the appearance of a quor- The motion carried unanimously by voice vote. Old Trace Road Plan R Planning € fficer Fourcroy outlined the recommendation of the Plan- ning Commission and referred to wall maps of the Old Trace Road area. (Councilman Sher arrived at 7:38 p.m.) MOTION: Councilman. Pearson moved, seconded by Debs, to up- hold the recommendation of the Planning Commission and that these recommendations be used 2s the basis for setting up an assessment. district. (NOTE: Recomenendatiorus are: (a) the road width be 24 feet from curb to curb; (b) the road leading to the park pro- perty be 30 feet from curb to curb; (4) curb* to he eonerete; 162 4124167 (d) parking be allowed on only one side of the streets; (e) an additional 8 feet be provided on one side of these roads for rustic pathway suitable for pedestrian and bicycling pur- poses and that a 12 foot area be provided on the other side of the road to be used for equestrian traffic primarily; (ft a public pedestrian and bicycle pathway and equestrian right- of-way be provided from Manuela Court to the park property by providing connections between the Manuela Court cul-de- sac and the nearest cul-de-sac on Old Trace Road, and be- tween the other cui-de-sac on Old Trace Road and the road leading to the park property.) (Councilman Worthington arrived at 7:40 p.m.) Discussion followed and Planning Commissioner Brenner replied to questions concerning acceptability of the recorn nendations to the residents of the area. (Councilman Flint arrived at 7:46 p. ) AMENDMENT: Councilman Cooley moved, seconded by Ruhrs, that the street width be changed to 30 feet from curb to curb. Discussion followed as to the adequacy of the road if parking is per- mitted on one side of the street and one lane in each direction is re- quired for passing traffic. Planning Officer Fourcroy and City Manager Morgan replied to questions concerning street widths, acquisition necessary for eas sments at present and for future de- velopment and costs of paving. MOTION: Councilman Beahrs moved, seconded by Robrs, to .on- tinue the rnatter until the staff can come for -ward with figures on cornparative costs. City Manager Morgan noted that the-recens nrnen$atioilprese*rtj3__ fore the Ccuwcii diri not refer to all streets in the proposed assess- ment district, and it had been assumed !he streets would be stan- dard for the rent of the area. eMsctissio» followed and Mr. Fourcroy replied to questions concerning possible future development of lots. Mr. Morgan also replied concerning plans for street widths in the area. --ix was generally agreed that the study proposed in the motion to continue would .include comparisons of costs for normal street development, the earlier recommendations of the Planning and Procedures Committee and the recomxnendation rd. the Planning Comuaission, including the entire assessment district area. The motion carried by majority voice vote. MOTION: Councilman Pearson moved, seconded by Deba, that the rest of the Old Trace (toad proposed assessment district be referred to the Planning Cornrn i e s n for x eeommendaiion regard- ing street widths. Zonin Chan e - 1700 Block of Embarcadero Road See Page Councilman Pearson again announced that as a property owner in 170 the area she would not participate in the consideration and vote con- cerning the request for zoning change in the 1700 block of Embarca- dero Road. (Councilman Pearson left at 8:06 p.m.} Planning Officer Fourcroy outlined the recommendation of the Plan- ning Commission and referred to the plats or. the wall regarding the proposed construction of a Volkswagen auto ;agency. MOTION: Councilman Rohrs moved, seconded by Beahrs to change the zoning as recommended by they Planning Commission. 3. Cyril Johnson, of J. Cyril Johnson Investment Corporation and Palo Alto Town & Country Village, Inc. , went to ,he microphone at the request of the Council. Mr. Johnson replied to questions from the Council concerning details of the need for the : equested zoning change from L-M:D to P -C Gus Mozart, owner of the Volkswagen agency, 825 El Camino Real, replied to questions frorn the Council concerning his consideration of other possible locations for his auto agency and his need for a change of location at this tirne. MOTION: Councilman Debs moved that the matter be referred to the Planning and Procedures Committee with a report from the staff and Planning Commission of possible alternate sites for auto agency development including the old corporation yard, the area between the Town & Country Village and University Avenue on El Camino Real and any other sites the Planni.:g and Procedures Committee might desire to consider. Mayor Dias ruled the motion out of order at the present. time. John Porter, 547 Hilbar Lan,:,, representative of the Executive Board of United Palo Altana, spoke in favor of the Planning Commission recommendation. Discussion continued concerning the desirability of establishing an "auto row" in Palo Alto which would not interfere with recreation areas and would be acceptable to the agency owners so that sales tax revenue from the agencies might be retained. Councilman Sher noted that the ordinance implementing the Planning Commission recommends; i^.n+. should be moved up on the agenda and considered at the same time. Thefe were no objections. 164 4/24/67 The motion to uphold the Planning Commission recommendation carried on the following roll call vote: Ayes: Arnold, Beahrs, Cooley, Dias, Rohrs Noes: Debs, Flint, Sher; Worthington MOTION: Councilxnan Rohrs introduced the following ordinance and moved, seconded by Beahrs, its approval for first reading: "Ordinance lit the Council of the City of Palo Alto Amending Section 3.02 of Ordinance 1324, the Zoning Ordinance, Chang- ing the Zoning of Certain Property in the 1700 Block of Embarcadero Road from L-M:D to P'C." Discussion followed and Mr. Fourcroy replied to questions concerz- ing the proposed zoning change. Hawley Smith, 458 Lowell, Palo Alto, spoke in favor of the proposed ordinance and stated the auto agency owners required more econom- ical land than that available elsewhere in Palo Alto. J. Cyril Joh:.son spoke in favor of the ordinance. MOTION: Council.rnan Pearson moved, seconded by Dias, that a representative of the Council be present at the Park and Recreation Commission meeting on April 26, with the resoluti,-1 supporting a Skyline Parkway (Resolution No. 3971 adopted March 1967) and also our proposed ,bike ways and trail system in the Foothills, as far as it is prepared (see Resol°.ition 3874 adopted March 1966 and report of City Manager of July 20, 1966) Discussion followed concerning membership of the Trailways Committee. The motion carried unanimously by voice vote. A. lication for On -Sale Beer License 414 Emerson Acting City Attorney Hildebrand referred to his report of April 14 regarding the application for on -sale beer license received from Bonnie Clarence Sewell and Mah Took "Y" Not, 414 Emerson, MOTION: Councilman Beahrs moved, seconded by Arnold, to file the application without action. The motion carried by majority voice vote. 75th Anniversary of Palo Alto's Incororation - New Civic Center Committee MOTION: Councilman Arnold introduced the following resolution and moved, seconded by Cooley, its adoption: "Resolution of the Council of the City of Palo Alto Requesting the Appointment of a Civic Committee to Plater Appropriate 4erernonies and Events for Palo Alto's 75th Anniversary of Its Incorporation and the Opening of Its New Civic Center" Discussion followed concerning appointments to be made by coun- cilmen after the forthcoming election and in July. MOTION: Councilman Sher moved, seconded by Debs, to continue consideration of the matter until the first Council meeting after July 1, 1967. The motion to continue carried by majority voice vote. Inquiry re Election Code Councilman Debs requested ;he Council to peas his agenda 'stem re- garding an inquiry concerning the Election Code, stating he now had the information he required. 167 4/24/67 Joint Committee on Interim Flood Control - lbMealo'k and Palo Alto MOTION: Councilman Flint moved, seconded by Pearson, that the Mayor be authorized to contact Menlo Park re establishment of a joint committee to consider interim flood control measures for San francisquito Creek. The committee shall consider but not be limit- ed in its consideration to the following matters: 1. rriijdification or recd:iatruction of bridges 2. removal of channel obstructions 3. control of revetments 4. erosion control 5. possible formation of a special flood control district for San Francisquito Creek to include portions of both counties Discussion followed concerning the possible contribution to improve- ment of San Francis;luito Creek regarding interim flood control ac- tion which might be made by a joint committee a°epresenting Menlo Park and Palo Alto. John B. Lornax, 854 Miranda Green, Palo Alto, spoke in favor of the motion ond requested that the proposed joint committee also study possible acquisition of land needed for easements on private property along the creek and alternate plans it the event a negative recommendation is received from the Corps of Engineers. The motion carried unanimously by voice vote. Appointment of Mayors Comsrmittee �wnwef� Councilman Flint his letter of April -I'd -1-96-7 regarding the appointment of a Mayor's Committee. It was explained that the committee under discussion was not a Council committee, would not receive any assistance from the staff and was appointed as a result of a request from the Comber of Cornmerc: to the i.tayor personally. MOTION: Councilman Flint moved that the committee formed by the Chamber of Commerce be appointed outside of the City Council. The motion failed for lack of a second; Public Works Committee Councilman Rohrs announced that the meeting of the PublicrVorks Committee scheduled for May 2. 1967 is cancelled. I.68 4/24/67 ,71 Cancellation - Council Meetin of.Ms.y 1, 1967 MOTION: Councilman Rohrs moved, and it was duly seconded, to cancel the Council meeting scheduled for May 1, 1967. The motion carried by majority voice vote. Save San Francisco Ba A. isociation Mayor Dias annoeu-iced that a film by the Save San Francisco Bay Association would be shown al April 27. 1967 at Gunn High School in the evening. 1 Santa Clara Coun Local Aencv Formation Cornraission Mayor Dias announced that nominations would be made by the Mayors Committee of the Inter -City Council to fill the vacancy created on the Santa Clara County Local Agency Fo. nation Commission created by the expiration of the term of Charles de Freitas. She added that suggestions as to possible candidates should be made to her as soon as possible. Oral Communications Cal Larsen, 3343 St. Michael's Court, Palo Also, stated he regrets the Council overruled the Planning Commission recommendation regarding rezoning of the 1700 block of Enib.rrcadero Road to allow an auto agency. He suggested possible reconsideration of the vote by the Council. MTS. Ruth Ellen Andersen, 4240 Suzanne, Palo Alto, stated that r she favored the k'1 ning Corr fission -r corrimendation to permit as auto agency in the 1700 block of Embareadero Road a -it-woad-- — have provided convenient garage service and also receation of the type enjoyed by her family. Roy Sabrell, Town & Country Village, Inc. , Palo Alto, one of the owners of the property proposed for the auto agency, thanked the members of the Council who had supported the Planning Commission recommendation. Mr. Sabrell made a verbal formal offer to sell to the City the land in question for recreation purposes.. The Minutes of April 17 were then approved as corrected. Councilman Pearson requested that on page 164 of the Minutes of April 24, 1967 regarding the proposed zoning change in the 1700 block of Embarcadero Road that the Minutes be corrected to indi- cate that her husband's company rather than herself is the property owner in the area. The Minutes of April 24 were then approved as corrected. Map Requirement Planning officer Fourcroy outlined the Planning Commission recom- mendation regarding map requirements.
