The Council of the City of Palo Alto met on this date at 7:30 p. m.
with Mayor Dias presiding.
Present: Arnold, Beah: s, Comstock, Cooley, Debs, Dias,
Flint, Pearson, Rohrs, Rue (arrived 7:45 p.m.),

The Minutes of February 13, 1967 were approved.
The Minutes of February 20, 1967 were approved.
Hearin -- Abandonment of Bandera Court

ment of a portion of Bandera Court in the City of Palo Alto may
per .nd show cause why a portion of Bandera C.;L rt should not be
abandoned. She requested that the record show tbt the City Clerk
ha;• filed an affidavit of publication of the notice c►f this hearing and
has on file an affidavit of posting of the notice of 'such hearing as
required by law.
City Engineer Witbcck referred to the City Manager's report of
February 1 outlining the area under discussion and reporting that
Los Altos Hills has no interest in the matter. He also reported

portion of Bandera Court to be abandoned.
MOTION: Councilman Flint introduced the following resolution and
moved, seconded by Arnold, its adoption:
Resolution No. 3965 entitled "Resolution of the Council of the
City of Palo Alto Ordering the Abandonment of a Portion of
B,undera Court and Reserving Certain Easements Therein."
The resolution was ad:,pted on the following roll call vote:
Ayes: Arnold, Peaurs, Comstock, Cooley, Debs, Dias,
Flint, Pearson, Rohrs, Sher, Worthington

Stanford Universit 'e Frenchman's Hill Subdivision
and Possible Clo 'ing of Stanford Avenue

Planning Officer Fourcroy advised that the Planning Commission
had approved Stanford's latest plan for the Frenchman's Hill Sub-
division although the City has no jurisdiction in the matter. He also
referred to his suggestion that Stanford Avenue might be closed to
improve traffic circulation from Palo Alto's point of view.
MOTION: Councilman Pearson moved, seconded by Flint, that the

next item relating to the possible closing of Stanford Avenue at the
same time,
The motion carried by majority voice vote.
Discussion followed concerning the possible result of closing Stan-
ford Avenue as suggested by Mr. Fourcroy and also other sugges-
tions regarding traffic circulation in the subdivision area. Planning
Commission Chairman Strornquist and Mr. Fourcroy replied to
Council questions concerning traffic and possible action of the Board
of Supervisors in connection with the subdivision plan.
Dixon Arnett, Director of Coznrnunity Relations, Stamford Univer-
sity, referred to his letter of February 20 which had been sent to
members of the Council explaining Stanford's position in the matter.
C. W. Gillard, 2120 Amherst, Palo Alto, spoke in favor of the
Council making a recommendation to the Board of Supervisors. Mr.
Gillard also replied to questions from members of the Council.
MOTIONS Councilman Comstock moved, seconded by Pearson,
that the Palo Alto City Council communicate to the Beard of Super-
visors their desire that the map on the subdivision be revised to
move the road from where it it presently contemplated to the loca-
tioel shoevn by'the dotted line bordering the school grounds.
AMENDMENT: Councilman Pearson moved, seconded by Debs,
that it be indicated to the Board of Supervisors that Palo Alto will
conduct a public hearing by the Planning Commission to determine
whether Stanford Avenue will be closed in the vicinity of .Amherst
Street.
The amendment carried by majority voice vote.
The motion as amended then failed on the following roll call vote:

MOTION: Councilman Sher 't` .ved, and it wee duly seconded, to
forward to the Board of Supervisors the recomzaendations of the
Planning Commission with regard to the Stanford University

Frenchman's Hill Subdivision and also advise the Board that the
Planning Commission will be holding a hearing regarding possible
closing of Stanford Avenue in the vicinity of Amherst Street.
The motion carried unanimously by voice vote.
First Presb erian Church - 1140 Co r Street

Planning Officer Fourcroy referred to the report of December 22
concerning a use permit application of the First Presbyterian
Church to allow use of the existing educational facilities for a day
school and the appeal from the decision of the Assistant Zoning
Administrator to approve the application.
Discussion followed concerning the total number of children who
rnight be using the facilities, the adequacy of the facilities to accom-
modate them and traffic problems which might result in the area if
a day school were permitted. Mr. Fourcroy replied to question
from members of the Council concerning details of the church plans.
William Sauasotte, 450 Kingsley Avenue, Palo Alto, spoke in oppo-
sition to any day school use permit being granted to the church. He
replied to questions from the Council.
John Porter, 547 Hillbar Lane, Palo Alto, spoke in favor of a day
school use permit being granted to the church. Mr. Porter replied
to questions from the C•'funcil concerning the plans of the church for
such a school.
MOTION: Councilman Cooley moved, seconded by Pearson, to
uphold -the Plannin; Commission's recommendation and deny the
use permit.
Councilman Worthington pointed out that the Planning Commission
had recommended granting a use permit although it was much more
limited than the one for which the church had applied and suggested'
the motion be changed if the intent was to deny the permit
Councilman Cooley, with the consent of his second, restated the
motion that the Council deny a use permit to the church for a day
school.
The motion then carried on the following roll call vote:
Ayes: Beahrs, Comstock, Cooley, Dias, Pearson, Rus,
Sher, Worthington
Noes: Arnold, Debs, Flint, Rohra
Appointment of A Cit Mana er
City Manager Morgan referred to his letter to the Council offering
the name of George Sipel as Assistant City Manager and requested
the Council approve his selection.
MOTION: Councilman Arnold moved, seconded by Beahrs, that
the Council confirm the appointment of George Sipel as Assistant
City Manager.
The motion carried by unanimous voice vote.

City Manager Morgan ref erred to his report o' March 2 and to the
petition received for the formation of an assessment district to
open and improve Laura Lane and recommended the matter be
referred to the Planning and Procedures Committee.
(Councilmen Arnold and Worthington left at 9:25 p. rn. )
MOTION: Councilman Flint moved, seconded by Pearson, to refer
the matter to the Planning and Procedures Committee.
The motion carried by unanimous voice vote.
Extension of Time Schedule

City Manager Morgan referred ff his report of March 2 regarding
the need for an extension of the time schedule relative to waste
disposal requirements.
MOTION: Councilman Pearson introduced the following resolution
an0 moved, seconded by Cornstock4 its adoption:
Resolution No. 3966 entitled "Resolution of the Council of the
City of Palo Alto DecUring Its Continuing Interest in and Re-
questing
Additional Time for the Study of the Possibility of
Consolidating the Sewage Treatment Facility of the City of Palo
Alto with Those of the Cities of Mountain View and Los Altos.
The resolution was adopted by the following rg11 call vote:

Non -Resident Appointment to
Human Relations Council
MOTION: Councilman Flint moved, seconded by Pearson, that
the City Attorney be directed to answer the question as to whether
ornot non-residents of Palo Alto can be appointer to the Haman
Relations Council.
AMENDMENT: Councilman Sher moved, and it was duly seconded,
to have the City Attorney advise the Human Relations Council as to
whether it is possible to appoint someone who resides outside of
Palo Alto.
(Councilmen Arnold and Worthington returned at 9:33 p. m. )
Discussion followed concerning to whom the report of the City
Attorney should be sent.
Councilman Sher then restated his amendment as follows: to re-
quest the Human Relations Council to advise the City Council as to
why they think it is desirable that someone be appointed to the
Human Relations Council who resides outside of Palo Alto.
Councilman Rohrs objected to the restated amendment, stating he
believed it should be a separate motion. Councilman Sher withdrew
his amendment.
AMENDMENT: Councilman Comstock moved, that a copy of the
City Attorney's opinion requested in Councilman Flint's motion
also be directed to the members of the Human Relations Council.
Councilman Flint agreed to incorpotate Council: -an Comstock's
amendment in his motion, but his second objected, and the motion
died for lack of a second.
Discussion foll=owed and Assistant City Attorney Hildebrand replied
to questions from Council members that the Fair Employment
Practices Commission had set up the Palo Alto Human Relations
Council and jurisdiction over appointment of members is theirs;
however they have been following Council recommendations,
(Councilman Debs left at 9:36 p.m.}

quest the Human Relations Council to advise the Council as to the
reason for suggestmg a non-resident be appointed to the Human
Relations Council.
The motion carried by majority voice vote.
Executive Session
Mayor Dias announced that the Council would hold an executive
session during the recess.
(The Council recessed from 9:40 to 10:10 p.m. - all
Councilmen present returned)
Following the executive session, Mayor Dias announced that the
Council had decided to delay decision on their recommendation to'
the FEPC regarding appointment to the Human Relations Council
pending receipt of a reply from the City Attorney's office.
Mayor Dias also announced that a progress report on the selection
of a City Attorney had been given to the Council by the Personnel
Liaison Committee, but that a decision would not be forthcoming
for approximately three weeks.
Stanford Plans re Indui3trial

MOTION: Councilman Cooley moved, seconded by iieahrs, to re-
quest the staff to provide information on possible Stamford plans to''
develop an industrial park in the Ladera area.
Discussion followed as to whether the subject might be appropriately
referred to the City -Stanford Liaison Committee proposed at the
February 27 Council meeting.
SUBSTITUTE MOTION: Councilman. Arnold moved, and it was
duly seconded, that the Mayor be authorized to address a letter * ► '_-.
Stanford asking that they reapply the Council with information as to
any plans they may have for an industrial park in the Ladera area.
Rolf Peter, 190 Southwood Drive, Palo Alto, stated that—hPbelieved--
the area in question to be lira moratorium.

San Francisquito Creek Channel ',trains_

MOTION: Councilman an Flint roved, seconded by Pearson, that the
Council favor a combination flood control and streamside park
treatment of San Francisquito Creek and that rip -rap or Gabian
stone lining be employed rather than .a smooth concret e lining.
s-ouncilman Rohrs requested the motion be split and Mayor Dias so
ruled.
Discussion followed as to the possibility of confusion arising in
directions to the Special Committee on San Francisquito Creek and
the rights of property owners along the Creek. City Manager Mor-
gan replied to questions concerning the status of flood control plans
for the Creek.

Councilman Flint withdrew his entire motion and restated it as
follows, with the consent of his second: that the Council favor a
flood control treatment of San Francisquito Creek which gives due
consideration to aesthetics and that rip -rap or Ge bian stone lining
be employed rather than a smooth concrete lining.
AMENDMENT: Councilman Cooley moved, seconded by Rohrs,
to delete all the words after aesthetics.
AMENDMENT TO AMENDMENT: Councilman Rohrs moved,

The amendment failed by majority voice vote,
John B. Lomax, 854 Miranda Green, Palo Alto, spoke of guide-
lines for the Santa Clara County Flood Control Dietrict.
SUBSTITUTE MUTICN: Councilman .Arnold moved, seconded by
Beahrs, that the Council go on record with the appropriate agencies
with regard to San Francisquito Creek and without prejudicing our
previous stand favoring Ladero Darn, failing that, it ranks the
following priorities: (1) adequate flood control with proper: channel
lining; (Z) aesthetics; and (3) cost. At the request of Councilman
Rus, Councilman Arnold changed his rw.otion to indicate the second
priority would be hydraulics, with aesthetics, third and cost, fourth.
Discussion followed concerning a long range flood control plan.

MOTION: Councilman Cooley moved, and it was duly seconded,
to adjourn.
AMENDMENT: Councilman Cornatock moved, seconded by Pear-
son, to adjourn to March 13, 1967. Councilman Cooley agreed to
include the date in his motion.
The motion failed by majority voice vote.
Flood Control District
MOTION: Councilman Deb a moved, seconded by Beahrs, that
the Mayor be authorized to address a letter to the Flood Control
District asking for the reasons, or a copy of their minutes, why
the project undergrounding a creek at Stanford takes priority over
the flood gates for Matadero, Dry Creek and the Adobe Basin.
in reply to question, City Manager Morgan explained that the pri-
ority was given as a result of previous Council action. Discussion
followed as to whether consideration was being given to the total
situation as it involves Palo Alto's flood control.

MOTION: Councilman Sher moved, and it was duly seconded,
that the City Council of Palo Alto advise the Board o'Supervisors
of Santa Clara County that in connection with the item concerning
a housing authority which appears on their March 13, 1967 Agenda,
the Council reaffirms its articat of September 13, 1966 urging the
estrtblishment of a Santa Clara County Housing Authority.
Mrs. Elinor Heath, 889 Embarcadero Road, Palo Alto, urged
the Council to reaffirm position in regard to a Santa Clara
Housing Authority.
The motion carried by majority voice vote.
