RESOLUTION NO, 4184
A RESOLUTION OF INTENTION TO AMEND SECTION 12.16.020
OF CHAPTER 12.16 OF TITLE 12 OF THE PALO ALTO
MUNICIPAL CODE BY ESTABLISHING UNDERGROUND UTILITY
DISTRICT NO . 11
RESOLVED, by the Co uncil of the City of Pal o Alto, Califor nia,
as fo llows:
1. That in its opinion the publi c necessity, health and safety
require and that it is the intention of said Council, pursuant to
Section 12.16. 040 of Chapter 12.16 of Titl e 12 of the P alo Alto M uni-
cipal Code, to a mend Section 12.16 .020 of said C od e by ord ering th e
e sta blishment of an underground utility district and to pr ohibit th e
construction in and requ ire the removal from said proposed district
of all po les a nd ove rhea d lines and associated overhead struct ur es
used or use ful in supplying electric, communicati on or similar or
asso cia ted services.
2. That the name of the proposed district is Unde rg ro und
Utility District No . 11 of the City of Pa lo Alto.
3. That the descr iption of the ar ea comprisin g said p roposed
district is as follows:

all as mo re par ticular ly delinea ted on tha t certain ma p entitled
"Undergro und Utility Distr ict No. 11", on file in the o ffice of the
City Clerk.
4. That fro m and after the effective date of the establish-
ment of said pro posed district no person or u tility shall er ect or
construct within said district any pole, o verhe ad lin e or associ-
ated overhead structure used or useful in supplying electr ic,
communica tion or similar ass ociated services.
5. That w ithin ninety (90) days from the date of the comple-
tio n and a cceptance ^f the proposed under gr ou nd fa cilities within
said district to be constructed, all poles and ov erhead lin es an d

That NOTICE IS HEREBY GIVEN that Monday, the 13th day of
, 1969, at the h our of 7:30 o'clock P .M., in the
r egula r meeting place of said Council, City Hall, P alo Alto,
California, ar e hereby fixed as the tim e and place wh en and whe re
sa id Coun cil shall hear all protests and receive evidence f or and
against the action herein proposed, and when a nd where said Co uncil
sha ll consider and fina lly determine whether the public n ecessity,
he alth and safety require the establishment of said district and the .
re moval of poles, o verhead wires and associated overhead st ructu res
and the under ground installation of w ires and f acilities f or supply-
ing electric, commun ication or similar associated se rvices in the
distr ict hereinabove described.
7. That at sa id hearing all per sons intere sted sh all be given
an oppo rtunity to be he ard. Said he aring may be continued f rom time
to time as ma y be dete rmined by said Council.
8. That at said hearing said Cou ncil will take ev idence and
con sider the question of whether such undergroundin g is in the
genera l public interest for one or mor e of the fo llo wing reasons:

heavy volume of pede strian and v ehicular traffic;

9. That the Cler k of this City shall give no tice of said
hearing by mailing co pies of this re so lution to a ll prope rty owners
within said propo sed distr ict as shown on the la st equalized tax

roll of the City, and to all utilities supplying electric, c ommuni-
cation or similar ur associated se rvices within said pr oposed
district, said mailing to be completed at least thirty (30) d ays
pr ior to the date of s aid hearing.
