A RESOLUTION OF PRELIMINARY DETERMINATION AND OF INTENTION
TO ACQUIRE AND CONSTRUCT IMPRO VEMENTS
STANFORD INDUSTRIAL PARK
UNDERGROUND UTILITIES CONVERSION
PROJECT NO. 68-83
RESOLVED, by the Coun cil of the City of Palo Alto, Califor ni a,
as follows:
1. That it does hereby p relimina rily d etermine that th e public
in te rest, conv enie nce and necessit y require, and that it int ends to
o rder work to be don e, a cquisitions and imp rovements to be m ade, as
follows, to wit:
a) 60-xv Underground System
The conversion of the ex isting 6u-KV overhead elect ric powe r
loop syste m of the City of Palo Alto along Page Mill Road from
E1 Ca mino Real to the nor thw esterly ext!-.asi on'of Hillview
Aven ue, thence so utheaster ly and northeast erly b ack to
El Cam ino Re al, to undergroun d locations along Lambert Avenue,
Hansen Way and Hanov er Street fr om El Camino R eal to Hill view
Avenu e by the co nstruction of a 60-xV loop at undergr ound
loca tions alon g the la st-mentioned rou te.
b) Ex isting Transmission Facilities
The acquisitio n of_the right of service and use in existing
electrical distribution conduits and facilities a lo ng Page Mill
Road fr om near El Camino Real to the Fo othill Expressway; in
the nor thwesterly e xtension of Hillv iew Avenue from Page Mill
Road to and a lo ng Hillview Avenue., to the Foothill Expressway,
to gether with an extension northeaster ly fro m the curve. in
Hillvier Avenue to approxilately th e southeasterly extension
of Peter Co utts Ro ad; along the ope n ditch in the southeasterly
exten sion of Dartmouth Street from a po int northwesterly of
Page Mill Roa d to Hanove r Stree t; in an existing ease ment
from Page Mill Road to near Fir e Sta tion No . 2; in Hans en Wa y
fr om Page Mill Road to the Southern Pacific Railroa d; alo ng
the Southern Pacific Railroad right-o f-way from E1 Casino Re al
to the substa tion near Hansen Way; and in easements to be
acquir ed ne ar E1 Camino Real from Page Mill Road to the
Souther n Pa cific Ra ilro ad right-o f-way; and the co mple tion of
the conve rsion to underground serv ice by installin g a ll neces-
sary cables and wiring in said conduits.
c) Proposed Distribution Facilities
The co nv er sion of the overhead electric pow er fac ilitie s of the
City of Palo Alto to un der groun d location s by constructing ne w
undergr ound duct systems and installing ne ce ssary cables an d
wirin g along Hansen Way fr om El Ca sin() Real to - the substation
and a long the n ortherly line of the Fo othill Expre ssway fr om
Page Mill Road' to Hillview Avenue and fr om the nor thea sterly
terminus of the existing facility e xtending northeaste rly from the
Hillv iew Av en ue cur ve further northea sterly to nea r an an gle
corn er of the City -limits.
d) Gene ral
All p rimary a nd seco nda ry facilities, splice bo xes, tra nsformer
vaults and street lighting facilities, and the perf orm ance of
all work necessa ry to ch ange over all of the existing ser vic e
connections to the n ew underg ro und systems, together with the
acquisition of all lands and e asem ents and th e co nstr uctio n of
all work auxiliary to any of the above and necessary to c omplete
the same, including the r zmoval and disp osal of all o ve rhead
poles and facilities .
2. All of the bl ocks, streets and all eys herei n m entioned a re
shown on maps of record in the office of the Cou nty Recorde r of Santa
Clar a Coun ty, California, and shall be sho wn upon the plans he rein
referred to and to be filed with the City Cle rk of this City.
3. Whene ver any public way is herei n referred to as running
between two public ways, or from or to any p ublic way, the inte rsec-
tio ns of the public ways referr ed to are includ ed to the extent that
w ork sha ll to sho wn on the plan s to be done th erein .
4. All of sa id wor k a nd improvements have bee n a nd are to be
constructed at the places an d in the pa rticular locati ons, of the
forms, sizes, dimen sio ns and mate rials, and at the lines, grades
a nd e leva tions as shown and delineate d upon the plans, profil es and
specifica tions made a nd to be made therefor, as hereinafter pr ovid ed .
5. Sa id Council does here by ado pt an d esta blish as the official
grades for sa id wor k the grades and eleva tions to be sho wn upon said
pla ns, profiles and specificatio ns. All such gra des and elev ations
are to be in feet a nd decimals the reo f with r eference to thedatum
plane of the City of Palo Alto .
6. No tice is her eby give n of the fact that in many ca ses sa id
wor k and improvement has brought or w ill br ing the finished work to
a gra de different from tha t formerly existing, and that to _said exte nt
said grades are hereby changed and that said work has been or w ill
be done to sa id cha nge d gra des.
7. The de scription s of the acqu isitions and improvements and
the ter min i of the wor k containe d in this Resolu tion are gene ra l in
nature . All item s of wor k do not necessarily exten d fo r the full

length of the description thereof. The plans and pr ofiles of the
wo rk and m aps and descriptio ns, as contained in the Enginee r's r eport,
shall be cont rolling as_ to th e correct and det ailed description
the reof.
8. The City will cont ribute the entire cost of the undergrou nd
60-KV circuit to replac e. the existi ng overhe ad 60-xv ci rcuit on Page
Mill Ro ad, the entire cost of the underground distributio n lines on
Page -Mill Roa d and the Foothill E xpressway, seve nty-five p er cent
(75%) of the cost of un de rground dist ributi on facilities in othe r
stree ts an d easements in the project (s aid 75% to includ e the entire
cost of any work done by City forces), a nd the e ntire cost of system
betterment. The balance of the cost of the p roject (including the
incrementa l co st of the second 60 -KY undergro und circuit b ack to
El Ca mino Real, twe nty-five per cent (25%) of the underground distri-
bution facilities in the other str eets a nd easements, and the e ntire
co st of an y new u ndergro und se rvice connectio ns on private p rope rty,
to gethe r with all expenses in ciden ta l ther eto), in the opi nion of
this Council, is of more tha n local or o rdinar y public beneflt and
is made chargeable upo n an a ssessment distric t, the exte rior bound a-
ries of which district ar e the composite an d consolidate d area as
mo re par ticularly sho wn on a map thereo f on file - in the office of the
City Cler k, identified as "Pro po sed Bounda ries of Stan for d Industrial
Park Underground Utilities Conver sion Pro ject No. 68-83 As se ssmen t
District, City of Palo Alto, State of Ca lifor nia", to w hich reference
is her eby made fo r fur ther particulars. Said map indicate s by,a
boundar y line the exte nt of the ter ritory included in the proposed
district an d shall gov ern for all deta ils as to , the e xten t of the
assessment district.
- -9. Said Co uncil fu rther declares that a i3. public str eets,
highways, lanes an d a lleys within said a sse ssment distr ict in use in

the p erformance of a public functi on as such, shall be omitted from
the assessment he reafter to be made to c over the costs and expenses of
said acquisitions a nd improvements.
10. Notice is he reby given th at serial bonds to represe nt unp aid
assess ments and b ear interest at the rate of n ot to exceed six per cent
(6%) per annum, will be issued her eunder in the m anner pr ovided in B ond
Plan B, Sectio n 13.16.110 of the Palo Alto Municip al Code, anal agous to
the Improvement Bond Act of 1915, Divisi on 10 of the Streets and High-
ways Code, the ass t installment of which bonds shall m atu re not to
ex cee d nine (9) year s from the second d ay of July next succeeding ten
mon ths from their date.
11. Except as her ein otherwise pro vided for the issuance of
bo nds, a ll of said wor k and acqu isitions shall be do ne as p rovided in
Se ction 13:12.040 of said Code, bein g analagous to the M unicipal
Impr ove me nt Act of 1913, Division 12 of the Stre ets and E1ghweys Code,
an d Sectio n 13.12.010 of said Code, pr oviding a procedu re fo r compli-
ance with Se ctio n 17 of Article XIII of the Constituti on of the State
of Ca lifornia
12. Sa id acquisitions and rovements are hereby refer red to
the City En gineer of this City as the officer having charge and con-
tro l of the acquisitio ns and construction of public impro vements in
an d for said City of the kind descr ibed he rein, an d bein g a competent
pers on emplo ye d by said City for that pur pose ; an d said Engineer is
hereby directed to make and file with the City Clerk a r epor t in
w ritin g, presenting the following
a) !la ps and deacr iptians
the Hindi and ease ents to be
acquir ed, and a gene ral de scr iption of the facilities .in Which r ights
of se rvice and use are to be acquire d;
b) plans and specifications of the pr oposed improvements
to be made pursuant to this Reso lution;
c) Engineer 's estimate of the total co sts and expense s of

said acquisitions and impr ovements and of the incident al exp enses in
connection there with;
d) Diag ram showi ng the assessme nt district ab ove referred
to, and also the boundaries and dimensions of the respective subdi vi-
sion s of land Within slid district as the same existed at the time of
the passage of this R esolution, each of which subdivisions shall be
given a se par ate number upon s aid diagram;
e) A proposed assessment of the t otal amo unt ( after deduct-
ing contribution s) of the coats and expenses of the p roposed a cquisi-
tions and impro vements upon the several s ubdi visions of land in said
dis tr ict in pr oportio n to the estimated benefits to be received by such
subdivisio ns; re spe ctively, from said acquisitio ns and improv ements and
of the expenses incidental thereto.
When an y portio n or per centage of th e cost and exp enses of
the ac quisitions a nd impro vements is to be paid from sources othe r than
assessments, the a mount of such portio n or percentage shall first be
deducted from the total estima ted cost and expe nses of s aid acquisi-
tio ns and improvements, and said assessment shall include only the
rema inder of the e stim ated cost and expen ses. Said assessment sh all
refer to sa id subdivisions by the ir respective numbe rs as assigned
pursua nt to subdivision (d) of this section.
13. Notice is her eby given that, in the o pinion of th is Council,
the public intere st will no t be serv ed by allowing the proper ty owners
to take the con tra ct for the co nstruction of the iapiovem snts a nd that,
pursu ant to Se ction 10502.4 of the Streets and Highways Code, no notice .
of aw ard of contract .shall be published.
14. If any excesn shall be r ealised from the asse ssment it shall
be use d, in aur:b a moun ta as the Coun cil my de te rmine , 3n accor da nce
with the pro visions of law , fo r the m ain ten ance of the impr ove ments,
unless the Coun cil sha ll he rea fter determine that it s hould be applie d
as a cre dit upon the assessment and a ny supplemental a ssessment.
