Old Trace Road Project MOTION: Councilman Comstock moved, on behalf of the Planning and Procedures Committee, the following: a. that the staff be directed to prepare a report for a revised Old Trace Road project and to return this report to the Planning and Procedures Committee for further review and that the revised project should incorporate the circu- lation elements of Plan R, should include water, gas. sewer and storm drain improvements, should include 25 foot street widths an&` should include minimum prepara- tions for the inclusion of underground utilities at a later date; b. that the staff be directed to provide information showing the impact of increased City contributions to the road system, and the problems and cost involved in making 01d Trace Road a straight street out to Araetradero Road,. and c. that the staff be directed to provide information on the variations in width of the road, both cost and traffic. -wise, from 20 to 30 feet, and on rolled versus vertical curbs. MOTION: Councilman Arnold moved, seconded by Dias, to con- tinue discs:.seion of the subject until the Council meeting of January 23, p ndizg receipt of the Committee minutes. The motion to continue carried by majority voice.vote: Arastradero Road Park MOTION: Councilman Comstock moved, seconded by Beahrs, to continue the item concerning delay of consideration of plans for Arastradero Road Park until January 23 pending receipt of the Planning and Procedures Committee minutes. The motion carried by majority voice vote, Coon: ilman Debs dis- senting. Middlefield Road/Lorna Verde Avenue Zoning MOTION: Councilman Comstock moved, seconded by Beahrs, the adoption of the following ordinance: Ordinance No. 2329 entitled "ordinance of the Council of the City of Palo Alto Amending Section 3. 02 of Ordinance No. 1324, the Zoning Ordinance, Changing the Zoning of Certain Property Along Middlefield Road and Loma Verde Avenue." Mrs. Irwin Wolfe, 3467 Rarnbcw, Palo Alto, spoke against blanket zoning and in favor of permits for the commercial recreation facilities in the Middlefield/Lorna Verde area. George Armstrong, 976 North California, Palo Alto, representing the United Committee of Appraisers, spoke against any change in the present zoning. Robert Cavallero, 95 Fleur Place, Atherton, owner of the property at 3163 Middlefield Road, spoke against any changes in the present zoning. Rus_rnoved, seconded by Woodward, to re- fer the ordinance to the Planning Commission for further study. The ordinance was adopted by the following roll call vote: Ayes: Arnold, Beahrs, Comstock, Debs, Dias, Flint, Pearson, Sher Noes: Cooley, Rohre, Rus, Woodward Architectural Contracts for Recreation Projects Bay an s Interpi Ptive sate°, Foothi is Interpretive Center, Mitchill Park itecreation Building, and Junior Museum Expansion City Manager Morgan referred to his report of January 11, 1967 concerning proposed agreements for architectural services for recreation projects and recommended the Mayor be authorized to execute the contracts on behalf of the City. MOTION: Councilman Rohrs moved, seconded by Comstock, that the Council authorize the Mayor to execute the proposed contracts as follows: Baylands Interpretive Center and Foothills Interpretive Center - Spencer, Lee & Busse; Mitchell Park Recreation Build- ing - William Guy Garwood; and Junior Museum Expansion Kal H. Porter. Di cuusswn followed and Mr. Morg:ln replied to questions concern- ing the architects' fees for the projects. The motion carried by unanimous voice vote. Architectural Services - 7,1=1;71777;71=king Structure Project 65-9 City Manger Morgan referred to his report on architectural ser- viC'4s tor the California Avenue Parking Structure Project 65-9 • recommended the Council authorize the staff to negotiate a •,ntract: pith the architectural -engineering firm recommended by the California Avenue Development Association. MOTION: Councilman Sher moved, seconded by Pearson, to refer the matter to the Public Works Committee to work with the staff in selecting an architectural -engineering firm for the project and the Committee to make recommendation to the Council. Discussion followed as to the number of brochures the Committee might receive, whether or not the Public Works Committee could deal adequately with a large number, or whether the staff should re- view the brochures and select a few for Committee consideration. The motion to refer failed on the following roil call vote: Ayes: Arnold, Comstock, Debs, Flint, Pearson, Sher Noes: Beahrs, Cooley, Dias, Rohrs, Rus, Woodward Councilman Debs asked that it be noted before the name of the firra is revealed to the Council that he is opposed to the selection of the architectural -engineering firm by the California Avenue Develop- ment Association and is not prejudiced against the firm itself. Mr. Morgan then announced the name of the firm in question is Jones, Thehn & Tilson Associates. MOTION: Councilman Comstock moved, seconded by Woodward, that the matter be continued. until January 23 and the staff be directed to prepare a contract and a summary of the qualifications of the er- gineering firm in question. The motion failed on the following roll call vote: Ayes: Noes: Arnold, Comstock, Cooley, Pearson, Sher, Woodward Beahrs, Debs, Dias, Flint, Rohrs, Rus Discussion followed and Mr. Morgan replied to questions concerning the qualifications of the firm. MOTION: Councilman Arnold introduced the following resolution and moved, seconded by Beahrs, its adoption: 16/67 Resolution 3956 entitled "Resolution of the Council of the City of Palo Alto Adopting and Submitting a Budget for Expenditure of State Allocated (Engineering) Funds." The resolution was adopted by ,manimous voice vote. (The Council recessed from 9:20 to 9:32 p.m.) Clainne for Kama es - l+ilar;a 'iguero� 'JS�ClI R!�r'C�L Assistant City Attorney Hildebrand referred to City Attorney Michalski's report of January 9 concerning the claim against the City of Maria Figueroa in the amount of $51,956.48 for alleged in- juries sustained when struck by an automobile at an intersection and recommended the claim be denied. MOTION: CourcilmanRohrs moved, seconded by Comstock. to deny the claim in its entirety. The motion carried by unanimous voice vote with Councilman Flint abstaining. Pacific Ready Mix vs. Cifi Pala Alto Assistant City Attorney Hildebrand referred to the case of Pacific Ready Mix versus the City of Palo Alto in which the validity of an ordinance restricting truck travel' on Oregon Avenue Expressway was challenged and stated that the plaintiff has now appealed from the Judgment of the Superior Court and an minion -fright be expected between nine: and 18 months. MOTION: Councilman Cooley introduced the following ordinance and moved, seconded by Beaters, its approval for first reading: "Ordinance of the Council of the City of Palo Alto Amending Subsection (a; of Section 2.450 of the Palo Alto Municipal Code Relative to Assessment of Property." Discussion followed with City Assessor Marty and City Manager Morgan replying to questions concerning the tax rate. MOTION: Councilman Dells moved, seconded by Flint, to refer the report to the Finance Committee for review, 17 1/16/67 The motion to refer carried on the following roll call vote: Ayes: Debs, Flint, Pearson, Rohrs, Rus, Sher, Woodward Noes: Arnold, Beahre, Comstock, Cooley, Dias Mr. Marty suggested that some u: Erency is involved as assessment commences as of March 1, 1967. The motion to reconsider failed on the following roll call vote: Ayes: Arnold, Beahrs, Comstock, Cooley, Dias, Rohrs Noes: Debs, Flint, Pearson, Rus, Sher, Woodward Truck Traffic - Foothill Expressway Councilman Comstock asked that his item regarding modification of the Foothill Expressway Agreement to permit Palo Alto to retain control over truck traffic on Foothill Expressway be continued un- til January 23 pending receipt of material groin =he office of the City Attorney. Mackay Lease and Lands' MOTION: Councilman Pearson moved_ seconded by Flint, that the Mackay radio lease be reviewed by the Public Works Committee and that, at the same time, the present zoning designation of the -Mackay lam-ae. shor=n Qn the baylands use proposal be reviewed- by the Planning Commission. In reply to questions from the Council, City Manager Morgan stated that the staff has taken the positi,n that Mackay does not have an option to renew its lease. The motion carried unanimously by voice vote. Written Communications Petition re Arrnaranta Way traffic MOTION: Councilman Comstock moved, seconded by Cooley, to refer the petition received from 67 residents of the Amaranta Way area requesting the City consider altering the traffic cir- culation to exclude through traffic on Amaranta to the Planning and Procedures Committee. Mayor Dias requested that the petition also be referred to the Planning Commission and Councilman Comstock agreed to in- clude the Commission in his motion. The motion carried unanimously by voice vote. Letter re traffic on Embarcadero Road City Manager Morgan called to the attention of the Council the letter of Paul A. Grit -nerd, 965 Embarcadero Road, Palo Alto, concerning traffic on Embarcadero Road and his reply stating that the subject is currently under review by the City staff. MOTION: Councilman Rohrs moved, seconded by Comstock, to set a uniform speed limit of 25 miles per homes on th*_ entire - - length of Embarcadeeo Road. Councilman Peareon reminded the Council that Planning and Procedures Committee has an item before it concerning streets that intersect Embarcadero. MOTION: Councilman Pearson moved, seconded by Cooley, to refer the letter to the Planning and Procedures Comtnittee. AMENDMENT: Councilman Arnold moved, eeconded by Rte, to change the speed limit to 30 miles per hour. Mr. Grimdard then spoke of the difficulties presented to resi- dents on Embarcadero Road by the heavy rapid traffic on that street. The amendment failed by majority voice vote. The motion carried by majority voice vote. Oral Communications William E. Chapala 3. M. D. , 3583 Louis Road, Palo Alto, spoke of his crncern in connection with the landscaping of power substation Fi. Jake Schwartz, 2805 El Camino Real, Palo Alto, stated that in connection with lowering the speed limit on Embarcadero Road, he would hope to see the speed limit strictly enforced.
