RESOLVED, by the Council of the City of Pal o Alto, Calif ornia, that
1. It does hereby p relimi narily determine th at the p ublic interest,
convenie nce and necessity req uire and that it intends to o rder the wo rk to
be done and acquisition s and impro vements to be made, as more particularly
her ein described.
2. All of the blocks, streets and all eys herein m ention ed a re shown
an maps of recor d in the office of the Co unty Reco rde r of the County of
Santa Cla ra , State of Califo rn ia , and shall be shown on th e pl ans herein
referred to and to be tiled w ith the City Clerk of s aid City.
3. Wh eneve r any public wa y is herein referred to as ramp between
two publicTways or from or to any public way, the int ersections of , the
public w ays referre d to are include d to the extent that work shall be
shown on tha pla ns to be do ne there in.

Dep artment right-of- way to Rillview Avenu e by c onstr ucti ng therein
grading, base p avement and wearing su rface, Po rtl and cement
concrete curbs, gutters, driveway aprons, sidew alk, storm drain
pipe, catch basins, manholes and appurtena nces, u ndergrou nd elect ric
power and telephone faciliti es and appu rtenances, a nd street light-
ing facilities.
b} The improving of M aybell A ve nue f or its entir e length, excluding
that portion the reof lying outside of th e City limits of the City of
Palo Alto, by the acquisition of eas eme nts necess ary to achi eve a
standard str eet width, a nd by the c onstruction therein of g rading,
base pa ve men t a nd wearing surface, Portla nd cement c oncrete curbs,
gutter s, drivewa y aprons and sidewalks, storm drain pip e, cat ch
basins, manholes and app urten ances, undergro und electric po wer and

ple te the same , including the re moval and dispos al of all over -
head ale ctr ic and telephone poles a nd facilitie s Where nece ssary.
8. It is th e intention of this C ouncil to ente r into an ag ree-
ment with the Pacific Telephone and Telegraph Company, which agree-
ment will pr ovide fo r the owne rship by said Company of underg round
telephone facilities in said City to be installed by said Company,
an d for the providing of se rvice to the pr ope rties •in said area by
s*id Company in accordance with its rates, rul es and regul ations, and
that said agreement shall beeesz e effecti ve after p roceedings have
been taken fo r the levy of ! the a ss essments and sale of b onds and it udie
ar e available to carry out its t erns.
9.: Notice is hereby given of -the fact that in many c ases -said
work and improvement will bring the finished w ork to a grads diffe r-
ent fro m that fo rme rly existing, and that to -said extent said g rades
ar e hereby chan ged and that sa id work will be done to s aid changed
grades.
10. The descriptions -of the ,equisitions and imp revrsata •and
the termin i of the wrk contained in this Resolution are feral in.

12. Said Council further declares that all public streets,
highways, l anes and alleys within said assessment district in use in
the performance of a public function as such, shall be omitted from
the asse ssment he reafte r to be made to c over th e costs and expenses
of sa id a cquisitions a nd improvem ents.
13. No tice is hereby given th at serial bands to repr ese nt unpaid
assessm en ts a nd bear inter est at the rate of not to exce ed six per
cent (6%) per annu m, will be issued he reunder in the m anner provided
in Bond Plan B, Section 13.16.110 of Chapt er 13 .16 of Titl e 13 of the
Palo Alto Municipal Code, anwlagous to th e Impr oveme nt Hand Act of
1915, the last installment of w hich ba nds shall m ature not to
ex ceed -nine (9-) year s fr om the second day of July n ext succeedi ng
ten months fr om their date.
14. Exce pt as herein otherwise provided fo r the issu an ce of
bonds, all of said work shall be do ne se provided in Secti on
13.12.040 of Chapter 13.12 of Title 13 of said Code, and Secti on 17
of Ar ticle XIII of the Constitu tion of the Sta te of Calif or nia.
15. Said acquisitions and impro vemen ts a re h ereby referred to
the City Engine er ofthie City, es the officer having charge and
co ntro l of the acquis itions and cons tr uction of public impro vements
in and for said City or the kind described he roin, being a competent
pe rson employed by said City for tha t pur pose; and said Engineer is
hereby directe d to .fie and file with the City Clerk a repo rt in
writing, presenting the follow ing:
a) lisps anal description s of the rands and e ases is to
be a cquir ed;
b) plans and specifications of the proposed improvemen t$
to be ma de pu rsuant to this 'Re solutio n;
c) Engineer's estima te of the total costa an d ex penses
of sa id acquisitions and improvem ents end of the incidental expenses
in co section there with;
d) Di agram showi ng the assessme nt district ab ove
r eferred to, and als o the b ound aries -and dimensions of the respective
su bdivisions of la nd withi n said district es the same existed at th e
time of the passage of this Resolution, e ach of which subdivisions
shall be given a sep arate number upon said diagram;
e) A proposed assessment of the tot al amo unt of the cost
an d ex penses of the proposed acquisitions and imp rovements upon the
sev era l subdivisions of land in said district in proportion to the
estimated bene fits to be received by such s ubdivisions, respectively,
fr om said acquisitio ns and improvements.
When any portion or percentage of the c ost . and exp enses
of the acquisitions and improv ements is to be paid from sources
other than assessme nts, the amou nt of such porti on or p ercentage
sha ll first be deducted from the total estimated cost and expe nses
of said acquisition and impr ov ements, and said asse ssment sh all
inc lude only the rema inder of the estima te d cost and expenses.
Said assessment shall refer to said subdivisions by their respecti ve
numbe rs as ass igned pursuantto su bdivisio n (e) of this section..
16. If an y e xcess shall be re alized from the asse ssment it
shall be used, in such assts as the:: Council'sl de termine , in
ac corda nce with the prov isions of law, for the.maintenance of the
