Mayor Dias announced that prior to the Council Meeting an executive session had been held to discuss the vacancy created by the resigna- tion of City ,'attorney Michalski effective February 1, 1967. She stated that t_re matter had been referred to the Personnel Liaison C o:n-irnittee who will conduct the search for a new city attorney -and may call in a management consultant; if necessary. Absent: Sher San Francisco Bay Filing Counc.ilrna.n Flint referred to his letter of December 8 concerning the filling ar.d development of the shoreline of the South Bay. San Francisco Bay Lands Investigation MOTION: Councilman Debs moved, seconded by Pearson, that the .;*:attar of possible acquisition of lands lying under San Francisco 477 1/3/67 Ray waters, within the city limits of Palo Alto, be referred to the Planning and Procedures Committee for investigation and that the City Attorney's office report to that Committee on title to those lands. AMENDMENT: Councilman Comstock moved that the City staff be directed to report to the Planning and Procedures Committee on possible financial assistance programs that might be available for financing such a program. Councilman Debs replied that with the consent of his second he would include the amendment in his motion. In reply to questions from Council members, City Attorney Michalski stated that the cost of a title search varies but would probably be about $500. 00 in this case. Fred Kunkel, 765 Garland, Palo Aito, stated that he had contacted Dave Callan of the State Lands Commission in Sacramento, and also the attorney for the State Lands Commission in Los Angeles and Robert Natley of the Land Sales Section of the State Lands Commis- sion concerning title of the lands in question. He stated that Mr. Nadey's office in Los Angeles has the full record of ownership in his files and suggested the Council might wish to contact Mr. Nadey or: the subject. David Dawdy, 3139 Avalon Court: Palo Alto, stated that there are instances where ownership of the lands in question is in dispute. The motio:s carried by m&.jority voice vote. Written Communications Letter from Philco-Ford Corporation re electric power re- quirements. quirements. The subject matter of the letter was handled t the Council meeting of December 1.2, 1966. Absent: Sher 478 1/3167 Approval of Minutes The Minutes of the Council Meeting of November 28, 1966 were approved. Councilman Pearson requested that in the Minutes of December 12, 1966, on page 463 in Resolution 3946 the word "Urging" be changed to "Endorsing. '• There were no objections. The Minutes of December 12, 1966 were approved. Contract for Architectural Services or a ivYc enter City Manager Morgan referred to his report of December 2t3 re- garding the prop apd contract for architectural services for the Civic Center. MOTION: Councilman Arnold moved, seconded by Cooley, to approve the proposed contract fo, architectural services and authorize the mayor to execut^ it. Discussion followed concerning the fact that the two roundtrips by the architect from New York are in addition to those made during his regular trips to Palo Alto. Discussion also concerned costs c,utiiued in the previous proposed contract and the present one and the amount provided for landscaping materials. AMENDMENT: Councilman Pearson moved, eeco tded by Debs, to delete "including landscaping:" from Sec. 3. (a) (1) of the, proposed contract. Mr. John Hill, architect representing Edward D.-Stone, =e- plied to questions from Council Inemters concerning the landscaping costs involved and the selection of a landscape architect. The amendment failed on the following roll call vote: Ayes: Debs, Flint, Pearson, Worthingtot Noes: Arnold, Beahrs, Comstock, Cooley, Dias, Rohrs, Rus, Woodward The motion to approve the contract carried by majority voice vote. Site - Downtown Cornrnunity Service Center - Library Councilman Debs asked if the Council w old also consider ht item on the agenda concerning the Planning Commission statement re- garding the Downtown Library site. There were no objections, • 479 1/3/67 MOTION: Councilman Pearson moved, and it was duly seconded, to uphold the recommendation of the Committee of the Whole and request the Planning Commission to continue to consider the ques- tion of a site or sites for the facilities covered in the City Manager's report on the downtown community service center of November 23 and whether these facilities should be combined on the same site or separated, and that the Downtown Library site study by the Com- mission be continued and studied in conjunction with the Downtown Park Study. MOTION: Councilman Arnold moved, seconded by Beahrs, to con- tinue the matter until the Council meeting of January 13, 1967. The motion to continue failed by majority voice vote. Councilman Cooley requested that the first and seconc' parts of Councilman Pearson's motion be voted upon separately, and Mayor Dias ruled the Council would do so. Architectural Contracts Recreation Projects MOTION: Councilman Rohrs moved, on behalf of he Public Works Committee, that the City Manager be authorized to negotiate con- tracts for the projects follows: Baylands Interpretive Center and -r oothiiisInterpretive Center Spencer, Lee te Busse; Mitchell Park Expansion - William Guy Garwood; and Junior Museum - Kal H. Porter; and further, in the event that after Council appz oval, the architectural contract is not negotiated, that that particular project be referred back to the Public Works Committee for another recommendation. The motion carried unanimously by voice vote. $aylands Athietie Center MOTION: Councilman Rohrs moved, on behalf of the Public Works Cornrnittee, that the Baylands Athletic Center prospectus be approved with the deletion of "Item 5 of'3. Objectives" and that the City Manager be . uthorized to screen qualified persons to develop the site, the submittal of said person to be reviewed by the Public Works Committee and that the architect should work with the staff and the Committee in development of the concepts of plans for the Center The motion carried unanimously by voice: vote. 480 1/3/67 California Avenue Assessment District 1 MOTION: Councilman Comstock introduced, on behalf of the Plan- ning and Procedures Committee, the following resolution excluding Section 5 re City -owned parcel and moved .ts adoption: Resolution 3948 entitled "Resolution of Preliminary Deter- mination under Division 4 of the Streets and Highways Code - California Avenue Area Parking Project No. 65-9." (Councilman Rus left the Chambers at 8:49 p.m.) Mike Golick of the California Avenue Association replied to ques- tions from Council members concerning the background of the pro- posed assessment district. The resolution was adopted on the following roll call vote: Ayes: Arnold, Beahrs, Comstock, Cooley, Dias, Flint, Peat son,, Rohrs, Woodward, Worthington Noes: Debs MOTION: Councilman Comstock introduced, on behalf of the Plan- ning and Procedures Committee, the following resolution and moved its adoption: Resolution 3949 entitled "Resolution Directing Preparation of Investigation Report Under Division 4 of the Streets and Highways Code - California Avenue Area Parking Project No. 65-9." The resolution was adopted on the following roll call vote: Ayes;____ ________a mold,_ Beahrs, Comstock, Cooley, Dias, Flint, Pearson, Rohrs, Woodward, Worthington Noes: Debe MOTION: Councilman Comstock introduced, on behalf of the Plan- ning and Procedures Committee the following resolution excluding reference in Section 9 to City contribution from sale of City -owned parcel and moved its adoption: Resolution 3950 entitled "Res., 'cation of Intention to Acquire and Construct Improvements - California Avenue Area Park- ing Project No. 65-9." (Councilman Rus •eturned at 9:05 p.m.) The resolution was adopted on the following roil call vote: Ayes: Arnold, Beahrs, Comstock, Cooley, Dias, flint, Pearson, Rohrs, Rus, Woodward, Worthington Noes: Debs 481 1/3/67 (The Council recessed from 9:06 to 9:17 p.m.) MOTION: Councilman Comstock moved, on behalf of the Planning and Procedures Committee, that development o the parking struc tare at Cambridge Avenue be directed toward that which will pro- vide a structure similar in appearance to a regular building that will utilize potential landscaping. The motion carried by majority voice vote. MOTION: Councilman Comstock moved, on behalf of the Planning and Procedures Committee, that the Planning Commission be re- quested to study the area of proposed parking district for a very broad study of lard use in the district, traffic, parking, projected and prospective development such as financial, high-rise, retail and all other aspects of the planning problem which they need to consider. AMENDMENT: Mayor Dias owed, seconded by Eohrs, to delete "to study the area of proposed parking district" and insert "to study an expanded area of the proposed parking district to include from Page Mill Road to College Avenue, and both sides of El Camino Real to the railroad tracks." Discussion followed concerning the zoning in the area and that the College Terrace people have asked for a parking district in te past. J. B. Swartz, 2805 El Camino Real, Palo Alto, questioned the Council as to details of the amendment and the motion. The amendment carried by majority voiee vote. AMENDMENT: Councilman Flint moved that "and that the Planning rer,n =d to council. if desired, that a tech Commission turthcr__:_�uss�a ��, �._� - uic consultant be hired to make the study in detail." The motion failed for lack of a second. The motion as amended then carried by unanimous voice vote. West Bayshore Fr�e Road Councilman Comstock requested that Councilman Pearson give the report of the Planning and Proceduze Committee since she had served as chairman when West Bayahore Frontage Road was dis- cussed. MOTION: Councilnnan Pearson .moved, on behalf of the Planning and Procedure Committee that (1) the staff be directed to make an analysis of traffic generated by the industrial property on West Bayahore Frontage Road in the sector between San Antonio ate; Oregon, staff to report back to Council solutions for han.dlia = g it relates to the Frontage Road access to and from 8ayshore aid 462 1/3/67 and as it relates to infiltration of traffic into residential areas with the additional recommendation that if an exhaustive technical study is indicated then that too be recommended; and (2) also that the staff be authorized to make an estimate of the cost of widening the entire West Bayshore Frontage Road, this study shall not be di- rected at the inclusion of an additional interchange between San Antonio and Oregon, with the further recommendation that the staff be directed to investigate the possibilities of State and Federal aid for this purpose and also using Phase 1 Expressway money. Councilman Flint requested that the motion be considered in two parts, and Mayor Dias so ruled. The first part of the motion then carried by unanimous voice vote. The second part failed on the following roll call vote: Ayes: Beahrs, Comstock, Debs, Pearson, Rus, Worthington Noes: Arnold, Cooley, Dias, Flint, Rohr s, Woodward MOTION: Councilman Debs moved, and it was duly seconded, that the Planning Commission be requested to make a broad study of traffic and land uses of the area from San Antonio to Oregon ad- jacent to West Bayshore Frontage Road including the adjoining industrial, amusement, apartment and the residential areas. Discussion followed concerning the next review of the General Plan which would include a review of the area under discussion. The motion failed on the following roll call vote: Ayes: Comstock, ^^vley__Debs, Flint, '•'earson, Worthington Noes: Arnold; Beahrs. Dias, Rohr', Rus, Woodward MOTION: Councilman Pearson rnoved that the staff be directed to investigate with the State the possibility of building a method of traveling -southerly via the San Antonio overpass. Discussion followed in which it was brought out that the staff under- standing is that the present motion is included in the earlier motion which had carried. Councilman Pearson then withdrew her motion. Use Permit Requirements wassesto, Wiese Planning Officer Fourcroy referred to the Planning Commission recommendation that the existing C-1 Zoning Ordinance be revised to add to the uses presently permitted with a use permit which are recreation enterprises, liquor stores, service stations, and to revise the parking requirements for C-1 zones to include "One 483 1/3/67 parking space for each 144 square feet of floor area on the ground floor, and one parking space for each 288 square feet of f`,00r area on the upper floors. MOTION: Councilman Flint moved to refer the matter to the Plan- ning and Procedures Committee. The motion failed for lack of a second. MOTION: Councilman Comstock moved, seconded by Arnold, to table the matter. The motion to table carried by majority voice vote. Zoning - Middlefield/Loma Verde Planning Officer Fourcroy referred to the recommendation of the Planning Commission that there be a change of district of property in the vicinity of Middlefield Road. and Lorna Verde Avenue from M -1:S (Light Industrial: Special Parking District Regulations) to R-2 (Limited Apartment District), R -3:G (Garden Apartment Dis- trict), C -1:D (Neighborhood Business District: Site and Design Con- trol), and R-3:G:D (Garden Apartment District: Site and Design Control). Mayor Dias read a letter from Carl Hinckle requesting the area be zcned according to the 1963 General Plan. She stated the Council would hear from anyone in the audience who wished to speak on the subject before the Council at this time. Duncan Williams, owner of the Winter Club, 3009 Middlefield, Palo Alto, read his letter to the Council attaching postcards from RO members of the Winter Club and urged the Council not to change the zoning in this area. Mrs. Patricia Sears, 800 Sycamore Drive, Palo Alto, a member of the Winter Club, spoke in favor of not changing the zoning. Chuck Thompeon, owner of Chuck Thompson Swim Club, presented a petition signed by 150 persons in the area urging the Council not to change the present zoning. Discuaeion brougl~t out that Mr. Williams and Mr. Thompson own the improvements on their property but each !aas a ten-year lease with an additional ten year option. In reply to questions from Coun- cil niembers, City Attorney Michalski stated that the proposed zoning change would make the clubs non -conforming, but no suit would be brought against them, and they could probably continue in business indefinitely. Platanin.g Officer Fourcroy replied to questions concerning possible expansion of either club, stating that expansion would be related to the club's ability to furniah re- quiresi.taarking. 484 1/3/67 George J. Desposito, 607 Wellsbury Way, read a letter suggesting the property in the area be zoned R -3:G. Colin Peters, 531 Cowper, representing the owners of 735, 737, 745 and 769 Loma Verde, presented a petition signed by 140 resi- dents of the area requesting no change in the present zoning. Mel Hawley, representing the two property owners at Middlefield and Lorna Verde, spoke in favor of either not chang ng the zoning or changing it to C:1 -D. Arthur Covitt, 3324 Middlefield, Palo Alto, urged the Council to zone the areal William Ross, representative of Gulf Oil Company, opposed the proposed zoning plan, stating it is discriminatory. Frank Grist. _Tr, ; repre eating the Peary eetute, owner of the property where the swim and winter clues are located, spoke in favor of keeping the present zoning. Ray Ferrari, 656 Towle Way, Palo Alto, spoke in favor of keeping the present zoning. Bernard H. Smith, 640 Towle Way, Palo Alto, spoke in favor of the Planning Commission recommendation to change the zoning. Harry Lowenstein, 3481 Middlefield, Palo Alto, spoke in favor of returning to the Master Plan zoning for the area. Earl Fields, 641 Towle Way;, Palo Alto, spoke it favor of the Plan- ning Commission recommendation. Mrs. Arthur Covitt, 3324 Middlefield, Pilo -Alto;,- spoke ire -favor residential zoning. Edward Arbuckle, 4131 Old Trace Road, Palo Alto, urged the Coun- cil to look at the General Plan and adopt the zoning recommended in it. Richard Stock, President of United Palo Altana, opposed comnzerciAl development along Middlefield Road. William Pickthorn, 540 Loma Verde, Palo Alto, President of the - Christian Center Corporation and Pastor of the church, spoke in favor of the present zoning. Mrs. Virgil Place, 809 Northampton, Palo Alto, spoke in favor of the present zoning. Discussion brought out that the Eichler Swim Club which is located in an area is a non-profit c:ub serving members in the neighbor- hood and not a commercial operation, but that perhaps use permits could be obtained in certain zones which would permit commercial 485 1/3/67 recreation. In reply to questions, City Attorney Michalski stated that the Council must avoid being arbitrary in any zoning plan. MOTION: Councilman Worthington introduced the following ordi- nance and moved its approval for first reading with revisions changing areas to be C -1:D to R -3:G and adding following the d. ie "as revised January 3, 1967:" "Ordinance of the Council of the City of Palo Alto Amending Section 3.02 of Ordinance No. 1324, the Zoning Ordinance, Changing the Zoning of Certain Property Along Middlefield Road and Loma Verde Avenue." The motion was duly seconded. Discussion followed concerning the possibility of issuing use per- mits to commercial recreation operations in the area. AMENDMENT: Councilman Delis moved, seconded by Beahrs, that the zoning change be to R-3:G:D, rather than to R -3:G thereby adding site and design control. MOTION: Councilman Rus moved, seconded by Cooley, to refer _ the mattes to the Planning Commission for further consideration. The motion to refer failed on the following roll call vote: Ayes: Arnold, Beahrl, Cooley Rohrs, Rus, Woodward Noes: Comstock, Debs, Dias, Flint, Pearson, Worthington The amendment adding site and design control carried by majority voice vote. (Councilman Woodward left the Chambers at 11:59 p.m. and did not return) 486 1/3/67 Fire Zones MOTION: Councilman Comstock introduced the following ordinance and moved, seconded by Arnold, its apprr•val for first reading: `Ordinance of the Council of the City of Palo alto Amending the Official Fire Zone Map of the City of Palo Alto (Section 1601 of the Uniform Building Code) by Changing the Property Rezoiu'd from M __:S :: R=2, R=3:C ::d R -3:C 'D in the Middlefield Road -Lorna Verde Avenue Area from Fire Zone No. 2 to Fire Zone No. 3." City Manager Morgan suggested that the ordinance be returned to staff to be reworded in accord with the Council action just taken in connection with toning on Middlefield. Road -Lorna Verde. Councilman Comstock there withdiew his motion. MOTION: Cour,rilman Comstock moved, seconded by Arnold, to return the ordinance to the staff. The motion carried unanimously by voice vote. SUBSTITUTE MOTION: Councilman Rohrs moved, seconded by Debs, to send a representative to the Board of Supervisors meeting of January 4, 1967 to ask them to defer action on the matter until their first meeting in February so that the Coun- cil may review the situation and make suggestions. Discussion followed in which City Attorney Michalski brought out the fact that the area under discussion is not in Palo Alto and that the City has no control over its dispos:.ion except possibly where an opening on to Page Mill Road might be concerned.
