A RESOLUTION OF INTENTION TO AMEND SECTION 12.16.020
OF CHAPTER 12.16 OF TITLE 12 OF THE PALO ALTO
MUNICIPAL CODE BY ESTABLISHING UNDERGROUND UTILITY
DISTRICTS NOS. 8, 9 AN D 10
MISCELLANEOUS STREETS PROJECT NO. 67-3
RESOLVED, by the Cou ncil of the City of Palo Alto, Californi a, as
follows:
1. That in its opinion th e public necessity, he alth and safety
requir e an d that it 1s the intention of said Cou ncil, pursuant to
Section 12.16.040 of Chapter 12.16 of Title 12 of the P alo Alto Muni-
cipal Co de, to amend Se ction 12.16.020 of said Code by orde ring the
establishmen t of undergrou nd utility districts and to prohibit the
con str uction in and r equ ire the removal from said proposed districts of all po les and overhead line s and associated overhead structu res
u sed or useful in supplying electr ic, communication or similar or
associated services.
2. That the names of the proposed districts are Underground
Utility District No. 8 of the City of Palo Alto, Underground Utility
District No . 9 of the City of Palo Alto, and Un dergro und Utility
District No. 10 of the City of Palo Alto .
3. That the descriptions of the a reas co mprising said pro posed
dis'. r1..ts are as follows:

Utility District No. 9 - West Bayshore Road Area
fro m Chabot Terrace to Loma Ver de Avenue
Utility Distr ict No. 10 - Laura Lane Area from

Emba rcadero Road northwester ly approx imately
610 feet
all as mor e pa rticularly delineated on tho se certa in ma ps entitleei
"Unde rground Utility District No . 8" , "Unde rground Utility District
No. 9", and "Undergro und Utility District No. 10", on file in the
office of the City Clerk.

4. That f rom and aft er the effective dates of the establish-
ment of said prop osed districts, no perso n or utility sh all erect or
construct withi n said districts any pole, overhead line or associated
ov erhead structur e used or useful in supplyi ng electric, co mmunic a-
tio n or similar or associ ated services.
5. That within ninety (90) days from the date of the completion
a nd a cce ptance of the proposed underground electric and telepho ne
facilities in the pu blic st reets within s aid districts to be c on-
stru cted by the City of Palo Alto and The P acific Telepho ne and Tele-
gra ph Company, all poles an d overhead li nes and associ ated structures
used or useful in supplying electric and similar or associated ser-
vices in said propo sed districts shall be removed, and from and after
said '•te no pe rso n or utility sha ll use or maint ain such facilities
within said propo sed distr icts. Additional notice shall be given
after said completion da te fo r ea ch distr ict has b een pr ecis ely
determined.
6. NOTICE IS HEREBY GIVEN that Monday, the 12th d ay of
No vember , 1968, at the hour of 7:30 o'clock P.M., in the
regular meetin g pla ce of said Council, City Ha ll, Palo Alto,
California, ar e hereby fixed as the time and place w hen and where
said Council shall hear all pro tests an d receiv e evidence for and
aga inst the ac tion here in propose d, an d w hen a nd wher e sa id Council
shall co nsider and fin ally determine w hether the pu blic necessity,
hea lth and safety r equire the establishment of said districts a nd the
removal of poles, overhead wir es an d a sso ciated overhead structures
and the undergroun d insta llation of wires and facilities for supply-
ing electr ic, commu nication or similar assoc ia ted serv ices in the
districts hereinabov e described.

Tha t at said hear ing all person s in terested shall be giv en
an opportunity to be hea rd. Sa id hearing may be con tin ued from time
to time as may be determine d by said Council.

8. Th at the City Clerk of this City shall give notice of said
hearing by m ailing copies of this resolution to all pr operty owners
within said pr oposed districts as show n on the last equalized tax r oll
of the City, and to all utilities supplying electric, communication
or similar or associ ated se rvices within said proposed districts, said
mailing to be completed at le ast thirty (30) days prior to the date of
sa id hea ring.
