RESOLUTION NO. 470
A RESOLUTION APPOINTING TIME A ND PLACE OF HEARING
PROTESTS IN RELATION TO PROPOSED ACQUISITIONS
AND IMPROVEMENTS, AND DIRECTING NOTICE
MISCELLANEOUS STREETS PROJECT NO. 67-3
RESOLVED, by the C ouncil of the City of Palo Alto, Calif ornia,
that
WHEREAS, pu rsuant to Res oluti on N o. 4122 of Prelimin ary Deter-
minatio n and of Intention, adopted by the Cou ncil of the City of
Palo Alto on Ma y 6, 1968, pursuant to the M unicip al Impr ovement Act
of 1913, the City En gineer has filed with the City Clerk the written
repo rt called for un der said Act and by said Resolution, which report
has bee n presented by sa id Clerk to this Council for consideration,
and this Co uncil ha s considered and pre limina rily appr oved and con-
firmed sa id repo rt an d ordered that the same stand as the rep ort
for the purpo se of all subsequent procee din gs had pursuant to said
Resolutio n of Preliminary Determination and of Intentio n;
NOW, THEREFORE, IT IS ORDERE D, that -4:4V, the 12th day of
a
Noveutbw, 1968, at the hour of 7:30 o'clock P. M., Co uncil Chambe rs,
City Hall, Palo Alto, Californ ia, be, and the same a re hereby
a ppo inted a nd fixed as the time an d pla ce when and where said Council
will consider and fin ally determine whethe r the public interes t,
conv enience and necessity require said a cqu isitions and impro vements,
and when an d where it will co nsider and fina lly act upon the Enginee r's
r eport u nder said Reso lution of Preliminary Determination and of
Inten tio n.
IT IS FURTHE R ORDERED, that the City Clerk be, and she is
here by, directed to give no tice of said hearin g on ce a we ek for two
w eeks in the Palo Alto Times, a newspaper published an d circulated
in sa id City, and by conspicuously posting a notice thereof a long a ll
the open streets within the asse ss ment district at not more than
thre e hundred feet a pa rt and n ot less than three in a11; said po st-
ing and first publica tion to be had and com pleted at le ast twenty
days before the date h erein set for he aring of pr otests.
IT IS FURTHER ORDERED, that said notices shall be headed "Notice
of Improvement" in letters of not less th an one inch in height and
shall, in legible characters, st ate the f act and d ate of the passage
of said Resolutio n of Prelimina ry Determination and of I ntenti on, and
of the filin g of said report, and of the date, hour and place s et for
the hearing of said pr otests, and b riefly describe the acquisitions
and im pro veme nts proposed to be mad e, and refer to s aid R esol ution of
Preliminar y Deter mination and of Inte nti on and report f or furth er
pa rticulars.
IT IS FURTHER ORDERED, that the City Clerk sh all mail, or cause
to be mailed, no tice of the a doption of said Res ol utio n and of the
filin g of said re port, postage prepaid, at least twenty days before
the date set fo r hearin g of sa id protests, to all perso ns owning re al
proper ty to be assesse d whose na mes an d addresses appear on the l ast
equ alize d assessment r oll fo r City taxe s prior thereto or as known
to the Clerk, which notice shall co ntain a statement of the time,
place and pu rpose of the hearing on sa id Reso lution of Prelimin ary
Deter mina tion and of Intention and report, and a sta te ment of the
to tal estimated co st of the pro po sed a cquisitions a nd improvements,
the account as shown by said report to be a ssesse d against the partic u-
la r parcel co ver ed by the notice, toge ther with a statement that any
person intereste d ma y file a protest in writing as pro vided in said
Act.
I he reby ce rtify that the foregoing is a full, true and correct
copy of a reso lution duly passed a nd adopted by the Co uncil of the
City of Palo Alto, Califor nia, at a meeting thereo f held on the
day of October , 1968, by the fo llowing vote of the members therof:
