RESOLUTION NO . 4168
A RESOLUTION OF PRELIMINARY APPROVAL OF ENGINEER'S REPORT
MISCELLANEOUS STREETS PROJECT NO. 67-3
RESOLVED, by the Council of the City of P al o Alt o, California,
that
WHEREAS, on the 6th day of May, 1968, said Co uncil adopt ed its
Resolution No. 4122 of Prelimin ary Deter mination a nd of Intenti on to
acquire and con struct improvements in said City, and did refe r th e
proposed a cqu isitions and improveme nts to the City Engin ee r, being
the offic er having charge and control of the acq uisiti ons and con-
struction of public impro vem ents in and f or said City of the kind
described therein, an d be ing a competent person empl oyed by said
City fo r tha t purpose, and did therein direct s aid City Engi neer
to ma ke a nd file with the City Cler k of this City a rep ort in writi ng,
all as therein more particular ly described, u nder and pursu ant to
the Mu nicipal Impr ovement Act of 1913;
WHEREAS, said City Engineer ha s made an d filed with the City
Clerk a report in writin g a3 called for in said Resolu tion of Pre-
limin ary Determination and of Intention and under and pursuant to
said Act, which r eport has been presented to this Coun cil for
considera tio n;
WHEREAS, this Co uncil has duly co nsidered said report and e ach
and ever y pa rt ther eo f, and finds that ea ch an d every part of said
repo rt is su fficien t, an d tha t neither said report n or a ny par t
thereof requires or shou ld be modified in any respec t;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. That the plans and specifications for the propo se d improv e-
me nts to be ma de, contained in sa id report, be, and they a re hereby,
prelimina rily a ppr oved and confirmed.
2. That the En gineer's estim ate of the itemized and total
costs and expen ses of said acqu isition s and improv ements and of the
incide nt al expenses in con nection there with, contained in s aid
r eport be, and each of them are hereby, p reliminarily approv ed and
confirmed.
3. That the diagram showing the assessme nt district referred
to and described in said Res olution of Prelimin ary T::.!ter mi nation and
Of In tentio n and also the bounda ries and dimensions of the respective
subdivision s of land within s aid assessment district as the same
existed at the time of the passage of said Resolution of Prelimi nary
Determination and of Intention, each of which subdivisio ns have be en
given a separa te number upon said diagram, as co ntained in said
report, be , and it is hereby, preliminarily approved and confirmed.
4. That the proposed assessments upon the several s ubdi vi-
sio ns of lan d in said assessment district in prop orti on to the
estima ted ben efits to be receive d by such subdi visions, respectively,
from said acquisition s and improve ments, a s,contained in said report
be, an d they are hereby, pre liminarily a pproved and confirmed.
5. That the maps and descriptio ns of lands and easements to
be acquired, as co ntained in said report, be, an d the same are
hereby, prelimina rily a pprov ed.
6. Tha t sa id r epo rt shall stan d as the En gine er's Report for
the purpo se of all subseque nt proceedings had pursuant to said Resolu-
tion of Preliminary Dete rmina tion an d of In tention.
