Present: Arnold, l,3eahrs, Berwald, Clark, Comstock, Dias, Gallagher, Gullixson, Pearson, Spaeth, Wheatley Absent: None Approval of Minutes Mayor Arnold requested that the first motion on page 258 of the Minutes of October 21 be corrected to read as fo11o°,ks: "Councilman Comstock introduced the following resolution and moved, seconded by Pearson, its adoption, and also that the Council consider the abandonment of a portion of Vista Avenue in executive session on Monday, November 25, 1968 at the time of the hearing: Resolution No. 4174 untitled 'Resoiution of the Council of the City of Palo Alto Its Intention to Order the Vacation of a Portion of Vista Avenue.' The resolution was adopted and the motion carried unanimously by voice vote." There were no objections. Mayor Arnold referred to the previous question motion on page 256 and observed that the Minutes record that the motion carried by majority voice vote and noted that a two-thirds vote is required for the previous question. Vice Mayor Dias, who presided on October 21, stated that there was only one "no" vote and therefore the:notion did carry by the proper number of votes. There were no objections to the corrections. Vice Mayor Dias requested that on page 252 in the third paragraph referring to subjects included in Council discussion the subject of City policy in regard to multi -use of other City rooms be included. There were no objections. Vice Mayor Dias also stated that on page 252 the 'Dote is recorded as "unanimous" on the motion and on the amendment dealing with a separate room for an information center in the Downtown Library and that it should be recorded as "majority" since she had voted "no" in both ca.aes. Councilman Pearson requested that on page 256 an addition be made to the Minutes noting that the 24 signature petition presented 2b3 11/4/68 by Mr. Judy should be added to the 148 signature petition previously presented in support of the proposed parkette on Cowper Street. There were no objections, The Minutes of October 21, 1968 were then approved with additions and corrections. Hearing - Weed Abatement Mayor Arnold declared open the public hearing. on weed abatement, stating that notice of the' Baring has been given as required by the Palo Alto Municipal Code. In response to question, City Clerk Klamrn stated that no written protests have been received. There being no one present who wished to speak, Mayor Arnold declared the hearing closed. MOTION: Councilman Clark introduced the following resolution and moved, seconded by Comstock, its adoption: Resolution No. 4175 entitled "Resolution of the Council of the City of Palo Alta Ordering Weed Nuisance Abated:" The resolution was adopted unanimously by voice vote. Planning Policy Committee Secretarial Help and Procedure re General Plan MOTION: Councilman Comstock :moved, seconded by Spaeth, that the City of Palo Alto accept its pro rata share for Inter - City Council secretarial help. The motion carried by majority voice vote. MOTION: Councilman Comstock moved, seconded by Pearson, that the "Procedure for Subregional Adoption of General Plan and Its Implementation" submitted by the Planning Policy Committee of Santa Clara County be referred to the Planning and Procedures Committee for review. The motion carried urkanizxaously by voice vote. Derck Pond DevPloprnent (CMR:80O9) MOTION: Councilman Beahrs moved, seconded by Comstock, the adoption of the following ordinance: Ordinance No. 2475 entitled "Ordinance of the Council of the City of Palo Alto Approving and Adopting a Plan for Phase 1 of Development of Duck Pond" (first reading 10/21/68) The ordinance was adopted unanimously by voice vote. 2 4 11/4/68 Oreen/Pa(e Mill Expressway Agreement (CMR:94:9) MOTION: Councilman Spaeth moved, seconded by Beahrs, to table the matter concerning the Oregon/Page Mill Expres away Agreement. The motion carried unanimously by voice vote. (NOTE: See below - Agreement set for consideration by Committee of the Whole on November 18, 1968) San Francisquito Creek Flood Control Proposals (CMR:095:9) City Manager Morgan described recent developments concerning San Francisquito Creek in connection with proposed interim and long-range improvements in regard to flood control and responded to questions concerning details of his report. MOTION: Councilman Pearson moved, and it was duly seconded, that the Council support the Willow Road Diversion Scheme as outlined in the Manager's report (CMR:095:9) providing (I) that the project qualifies for and receives funding proposed as a Federal Flood Control Improvement and (2) that there are assurances from the Santa Clara County Flood Control District that the project in its design will provide an adequate measure of flood control protection to the City of Palo .Alto and all lands within this jurisdiction; and, further, that the staff be directed to convey this decision to the County Flood Control District, the Corps of Engineers,- and other appropriate parties. The motion carried unanimously by voice vote. Miranda Avenue et al, Project Iva. 8— M City Manager Morgan referred to his report and described the area to be included in the proposed improvement project, noting that part of the proposed project is the former Old Trace Road Project No. 64-4, other parts were included at earlier Council direction, and that consolidation permits certain construction economies and simplifies legal proceedings. Discussion followed concerning streets included in the proposed project, desires of property owners, future communication with property owners when more information is available, the lack of .authority in the staff to negotiate City standards for street improve- ments, whether there is a need for more information at this time, and details of the economies which aright be effected. Richard Sweet, 4076 Ornie Avenue, President of the Loma Vista Homeowners Association, referred to the wall niap indicating the area he represents, and stated that responses to a questionnaire distributed by h:s organisation indicates most residents do not favor any improvement project. Mr. Sweet t responded to questions from the Council. 265 11/4/68 Discussion continued and Mr. Morgan replied to questions concerning what might be expected in the way of meeting City standards by areas wishing to be annexed to the City and what had been the under- standing in this regard at the time the Loma Vista area joined Palo Alto. MOTION: Councilman Comstock moved, seconded by Beahrs, that the Council adopt the proposed resolution indicating the Council's intention to obtain more information with the exception that Section 17 (relating to Old Trace Road Project No. 64-4) and any other appropriate sections in the resolution be deleted. Upon advice of Mr. Morgan that any changes in the proposed res- olution should be referred to the Bond Counsel so that the resolution may be redrafted, Councilman Cornstock, with the consent of his second, withdrew the motion. (The Council recessed from 9:20 to 9:32 p. rn, ) MOTION: Councilman Comstock moved, seconded by Spaeth, that the proposed resolution regarding Miranda Avenue et al, Pro- ject No. 68-56 be returned to staff to be redrafted and said re- drafted resolution to delete reference to the Old Trace Road Project. The motion carried by 'majority voice vote. Safe Bicycle Route - Middlefield Road - East Meadow to Cubberley High School rtmgnk:96:9) City Manager Morgan referred to his report on the safe bicycle route, stating that an item of this type which affects any. individual school should have been sent to the City -School Traffic Safety Committee for their recommendation before final action is taken by the Council. 266 1114/68 MOTION: Councilman Clark moved, seconded by Dias, to con- tinue the matter until the first Council meeting after the next City -School Traffic Safety Committee meeting on November 13, 1968. Mayor Arnold stated that if there were no objections or challenges he would recognize anyone wishing to speak, although there is a motion befor the Council. There were ' i'o objections. Mrs. Frank Hamaker, 796 Gallen, Palo Alto, President of Cubberley High School PTA, and also authorized to speak for the Principal, urged immediate adoption of the safe bike route and spoke in oppositions to the motion. Jacob Miller, 3145 David, Palo Alto, urged support of adoption of the bike route and in opposition to the motion. Jarete:0- Wagstaffe, 3556 Ramona, Palo Alto, spoke in opposition to the motion and urged immediate adoption of the bike route. George Desposito„ 607 Wellsbury Way, Palo Alto, spoke in support of immediate adoption of the bike route. Peter Parrish, 719 Holly Oak, Palo Alto, spoke in support of adoption of the bike route now. Robert. Debs, 3145 Flowers Lane, Palo Alto, spore in support of immediate adoption of the bike route and in opposition to the motion. Discussion followed concerning the Council's obligation to follow regular procedure, the groups and individuals who had participated ill preparing the proposed route and the possible effects of approaching winter weather on the safety of bicyclists. The motion to continue failed by majority voice vote. MOTION; Councilman. Spaeth introduced the following resolution and moved, and it was duly seconded, its adoption: Resolution No. 4176 entitled:"Resolution of the Council of the City of Palo Alto Amending Resolution 2971 to Prohibit Parking Along Certain Portions of Middlefield Road" The resolution carried unanimously by voice vote. MOTION: Councilman Berwald moved, and it was duly seconded, to direct the staff to initiate the appropriate provisions to effectuate a safe bike route in the area of Middlefield Road near Cubberley High School. The motion carried unanimously by voice vote. Downtown Library and Recreation C nter- 1:9) MOTION: Councilman Berwald moved, seconded by Beaters, that the Mayor be authorised to execute an amendment to the architect's contract for Downtown Library and Recreation Center in accordance with recent Council direction to him to rake structural provisions for a rooftop terrace. The motion carried unanimously by voice vote. Council Meeting Dates - November and December MOTION: Mayor Arnoid moved, seconded by Clark, to cancel et./ Council meeting regularly scheduled for November 18, 1968. The motion carried unanimously by voice vote. (See P. 279) 267 11/4/68 1477 MOTION: Mayor Arnold moved, seconded by Beahrs, to cancel the Council meetings regularly scheduled for December 9 and December 23, 1968. The motion carried unanimously by voice vote. Oregon/Pa a Mill Ex ressway Agreement CM . MOTION: Councilman Spaeth moved, seconded by. Beahrs, to lift from the table the matter concerning the Oregon/Page Mill Express- way Agreement. The motion carried unanimously by voice vote. MOTION: Councilman Spaeth moved, seconded by Clark, that a Cor e ittee of the Whole meeting be set for. Monday, - November 18, 1968 at 7:30 p.m. in the Council Chambers to consider the Oregon/Page Mill Expressway Agreement. The motion carried unanimously by voice vote. Election Nights Activities In response to inquiry from Councilman Berwald, City Manager Morgan stated that the City has been advised there is to be a parade down Palm Avenue to Lytton Plaza on University Avenue where planned activities include rock bands and speeches. gnvironmental Control and Liquor Licenses MOTION: Councilman Wheatley moved, seconded by Gallagher, that the staff be directed to prepare a protest in c-nnection with filing a protest with the Alcoholic Beverage Control department concerning local right of control of environment and the granting of a liquor license to the "Morgue" at San Antonio Road andBay- shore Freeway. The motion carried by majority voice vote. Oral Communications G arias Sasisls, 74O Seale Avenue, Palo Alto, attorney repre- senting the Central Business Area Association of Palo Alto who filed on October 28, 1968 an initiative, petition regarcFerig the one-way loop:' traffic system, described his r.easdns for filing the petition on that date.
