RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING SCHEDULE E-5, RULES :kND REGULATIONS 12
AND 13 AND ADDING RULE AND REGULATION 12A TO THE
CITY OF PALO ALTO UTILITIES RULES AND REGULATIONS
The Council of the City of Palo Alto does RESOLVE as fol-
lows:
SECTION 1. That p ursuant to Secti on 12.20.010 of the Palo
Alto Mu nicipal Code, Schedule E-5 and Rule and Regulation N o.
12 a nd Rule and Regu lation No. 13 are he reby amended to r ead
as se t fo rth in the documents so designated attached he reto and
by reference ma de a part hereof.
SECTION 2. That pursuant to Secti on 12.20.010 of the Palo
Alto Municipa l Co de, Rule a nd Regulation No. 12A as set forth
in the do cument so designated, attached hereto and by reference
ma de a part hereof, is hereby added to the City of Pal o Alt o
Utilities Rules and Regulations.
SECTION 3. The fo regoing changes shall become effective
on the date he reof.

REPLACEMENT OF OVERHEAD WITH UNDERGROUND DISTRIBUTION FACILITIES
I POLICY AND PRIORITIES:
The Depa rtment of Light and Power will r eplace existing o verh ead
distribution facilities with u ndergr ound facilities f or the oper-
ating con venience of the utility, or upon applicati on of an in-
dividua l or grou p of individuals, and/or at the directi on of the
City Cou ncil, subject to budg et ary considerations, the pri ority
schedule listed below, and minim um project size specified in the
applicable section of this rule.
The ex ten t of the City's financial particip ation in a c on version
project will depend upon w he ther the loc al e of the project is d es-
ignate d by the City Council as an aria of general publi c i nterest
a nd bene fit, or an area of primarily local public ben:.fit, or wh e-
ther the area fails to qualify fo r either of the f oregoi ng desig-
nations.
Underground c on version in a reas of general and l ocal p ubli c be nefit
will be considered in accordan ce with the following order or prior-
itie s a nd classification of are as as illustrated by th at cert ain
City ma p titled, "Four Cla sses of Need fo r Un derground Utilities
Distribution ."
(1) First priority will be given to overhead utility li nes
along str eets, roa ds, or rights -of -way on which major new
roadway co nstructio n of realignment will take pla ce.
(2) Secon d prio rity will be given to o ve rhea d utility lines
along stree ts, road= , or rights -of -way which a re e stab-
lished as areas of greate st aesthetic need an d designa ted
as Class D on the a bove map.
(3)
Third priority will be given to ov erhead utility lines
along stre ets, roads, or rights -of -way in a reas zoned
residentia l and design ated as Class D on the above map.
(4) Fourth prio rity will be given to overhea d utility lines
along streets, roads, or rights -o f -way in areas zo ned for
commerc ia l, light in dustrial, and limited manufactu ring
And designated as Class D on the above map.

II. IN AREAS OF GENERAL PUBLIC INTEREST AND BENEFIT:
The City will re place its ex istin g ove rhead distribution lin es
with electr ic underground distr ibution fac ilities at the City's
e xpense a lo ng pu blic stre ets a nd roa ds, on public lands, and on
pr ivate pro pe rty across which satisfa ctor y ea sements or rights -of -
w ay have been obtained or may be o bta ined without cost or condem-
nation by the City pro vided that:
(A) The Project exten ds a minimum distance of two City blocks or
750 feet.
(B) The City Coun cil has:
(1) Determin ed that su ch undergroun din g is in the gen eral
pu blic in terest. Included amo ng the reaso ns for su ch de-
termination may be:
(a)
Such unde rgrounding will avoid or eliminate an unusu-
ally heav y con centration of o verhea d distribution
facilitie s or the re constru ctio n of an ex isting pole line
to acco mmodate additio nal overhead circuits.

(d) Said street or road or right-of-way adjoi ns or p asses
through a civic or publi c recreati on area or an a rea
of scenic interest to the gen eral public.
(2) Adopted an ordinance creating an undergr ound district in
accordance with the applicable secti ons of Chapter 12 .'5,
Unde rground Utilities , of the Palo Alto Municip al Cod e,
which fur ther pr ov ides among o ther things:
(a) That a ll existing overhea d co mmunicati on and electri c
distribu tion fa cilitie s in such district shall be
removed.
(b) That eacl' property o wner serve d fr om such overh ead
distribution facilities sha ll provide within a period
of time established by City Council a nd at the pro-
perty owner's e xpense and in ac co rda nce with the City's
applicable utility rules and regula tions an d schedule
of charge s for unde rground serv ice con nec tio ns, a ll
electrical service facility Lo nstructio n and changes
on his premises necessary to receive service from the
undergro und distr ibution fa cilities after the y are
comple ted and in operation.
(c) That the City is autho rize d to disco ntinue overhead
services after the perio d of time established by the
City Cou ncil for reconnec tio n to the underground
distribu tio n facilitie s has ex pired.

III. IN AREAS PRIMARILY OF LOCAL PUBLIC BENEFIT:
The City will replace its existing overh ead distribution facilities
with underground distribution facilities along public streets, ro ads,
or other lo cations mutually agreed upon when r equested by a gr oup
of a pplican ts or an a uthorized repr esent ative of a gro up of appii-
can ts, prov ide d tha t:
(A) The pro je ct includes at least one block or 600 feet.
(B) The City Co uncil has:
(1) Determined that such unde rgroundi ng is in the g en eral
public interest, hut primarily of l oc al b enefit.
(2) Adopted an o rdinance c re ating an undergr ound district in
accordance with the applic able sections of Chapter 12.16,
Un de rground Utilitie s, of the Palo Alto Muni cipal C od e,
whic h further pro vide s a mong other things:
(a ) That all existing ove rhead co mmunicatio n and electric
distribution facilities in su ch district shall be
remo ve d.
(b) That e ach prope rty owner se rved fro m such ove rhead
dis tribution fa cilitie s shall pr ovide within a period
of time e sta blishe d by City Council and at the property
owner's expense and in a ccor dance with the City's
applica ble utility rules a nd regu la tion s and schedule
of charges for undergro und service connections, all
electrical service facility constr uction an d changes
on his premise s ne ce ssary to r eceive service fro m
the un derground distribution facilities after they
are comple ted an d in operatio n.

(c) That the City is authorized to discontinu e overhead
se rvice afte r the pe riod of time established by City
Council for reconnection to the undergrou nd distri-
bution facilitie s ha s expired.

(C) The a pplic ant or gro up of applica nts pays 25 perc ent of the
total costs, excl usive of tr ansf ormers and associated equip-
ment, fo r th-, replacem ent of the o verheat distrib ution lines
with underground distribution facilities in the p ublic right-
of-way or easement . The City will pay 75 per cent of s aid
cost an d will provide the transf ormers and associated equip-
ment. Whe re the street -lighti ng system in are as to be u nder -
groun ded is mou nted on overhead p oles to be removed, the
street -lighting facilities shall be replaced in accordance
with the standards and requirements of the City, a nd the cost
sha ll be in cluded in the total costs.
IV. IN AREAS OF INSUFFICIENT PUBLIC BENEFIT TO QUALIFY UNDER SECTIONS
II OR III:
Where mutua lly a gre ed upon by the Chie f Engineer, D ep artment of
Light an d Power, and an a pplicant, overhead distributio n may
be replaced with underground distribution facilities pr ovided
that:
(A)
The applicant requesting the change en te rs into an ag ree-
ment with the City to pay, in advance, a nonrefundabl e sum
e qual to 75 percent of the estima ted total co st of the
replacemen t of overhea d distribu tion lin es with undergr ound
distribution fac ilities, in the public r ight-of-way or ease-
men t, exclusive of transformers and a ssocia ted equipment.
Twen ty-five percent of sa id cost will be bo rn e by the City.
(B) Eac h proper ty owner serve d from such overhea d distribution
fa cilities shall agree to pro vide at his o wn expense , with-
in a period of time e sta blished by the Chief Electric al.
Engineer, a ll electrical service facility constructio n a nd
c han ges on his premises necessary to rece ive service fro m the
undergroun d distribution fa cilitie s after they a re completed
and in o peration .

ELECTRICAL SERVICE CONNECTIONS
AND
FACILITIES ON CUSTOMER'S PREMISES
A. SERVICE CONNECTIONS:
Upon an a ccepted applicatio n for service, the City will c on nect a
se rvice lateral of suitable c apacity from the customer's service
entrance equipment to the City's distribution system at a s ervice
poin t design ated by the Dep artme nt of Light and Power, provided
that:
(1) The Chief Ele ctr ica l Enginee r has approved the switchb oard
design and location and the Building Inspect or has issued a
Certificate of Approval authorizing the cust omer to energize
his equ ipment.
(2) The property fron ts on a public street, highway, all ey, l ane,
or right-of-wa y along_which the City has or will inst all dis-
tribution facilities; or the prope rty has a contig uous ease-
ment or right-of-way alo ng which the City has or will install
distribution fa cilities.
(3) The a pplican t ha s paid a ll required co nnection charges as set
forth in the Schedu le of Utility Connection Charges, E-5.
(4) The applican t has satisfied on e of the following requireme nts:
a. He has furnished a nd in sta lled as required the pads and
vaults for transformers a nd associated equipment, conduc-
tors, co nduits, ducts, bo xes, pole rise rs, an d perfo rmed
all other work relate d to structu res and su bstructures,
including brea king of pav ement, trenching, backfilling,
and repairing, r equired fo r the installation of the elec-
trical ser vice connection from his service entra nce equip-
ment to the designated se rvice po int, a ll in a ccor dance
with the requirements, sta ndards, an d specificatio ns of
the Department of Light and Power.
b. He ha s fulfilled a ll the c onditio ns listed in Par agraph A.4.a
exce pt insta llation of service conductors a nd ha s requ ested
that the Departmen t of Light an d Power install sa me in

accordance with the applicable sectio ns of the Sched ule of
Utility Con nection Ch arges, E-5. At the optio n of the City
the service conduct ors may be cables inst alled in conduit
pro vided by the applicant or pr eass embled cable -in -c onduit.
OWNERSHIP AND RESPONSIBILITY FOR SERVICE LATERALS AND METERING EQUIP-
MENT:
All materia ls an d equipment installed by th e City on the c ustom er's
premise s in the constru ction or operation of electric service will at
all times be and re ma in the sole property of the City and may be r e-
paired, repla ce d, or remov ed by the City at any time.
The City will assume own ership and responsibility fo r m ai nte nance of
an underground e lectric serv ice insta lled by the c ust om er if the ser-
vice mee ts City of Palo Alto specifications and has be en approved and
accepte d by the Chief Electrical Enginee r.
The cu stomer shall exercise reasonable care to prevent City equipment
on his premise s from being injure d or destr oyed and sh all refrain fr om
interfering with sage. The customer shall immediately n otify the City
upo n the discover y of any defect in the City's equipment.
No rent or other charge whatsoe ve r shall be made by the custome r agai nst
the City for placing or main ta ining any nec essa ry electr ical facilities
on the customer's pr emise s.
The custo me r shall pro vide and install all n ecessary mete ring equip-
ment, exclusive of meters, in strument transfor mers, a nd test switches,
in a loca tion approved by the Depar tme nt of Light an d Power a nd in
accordance with requirements publis hed by the Departme nt. Suc h equip-
ment shall be accessible for inspe ctio n, meter r eading, and testing
dur ing the norma l working hours of the City personn el assigned to such
work. The City will install me ters, instrument transforme rs, and te st
switches as required.
Where se para te meters are to be installed fo r v arious flo ors or groups
of rooms in order to measure the electr ica l en er gy supplied to e ach
tenant of a multiple -occupan cy building or gro up of bu ildings, these

meters shall be located at a central p oi nt or points appr oved by th e
Chief Ele ctrical Engi nee r. E ach service switch a nd/or meter sh all be
clearly marked to indicate the parti cul ar locati on it s upplies.
C. TOTALIZING METERING:
Unle ss o the rwise a pproved by the Chief Electrical Engi neer, the t otal-
izin g through a single me ter of electrical e nergy delivered to a
cu stomer by two or mo re separate s ervices will be consid er ed only if
the custcmer's require ments a re estimated by the Department of Light
a nd Po wer to total at le as t 1,500 kva a nd the s ervi ce v oltage is 480 v olts
or higher .
If,in the opinion of the Chief Electrical Engineer, such totalizing
is do ne sole ly for the customer's benefit, the customer will be re-
qu ired to pay the difference between the installed cost of a single -
ser vice metering in stallation capable of serving the cust omer and
that of the desired totaliz ing in sta llation.
Totalizing will be co nsidered to be solely for the customer's benefit
if:
a. An equ ivalent sin gle service at 600 vo lts or less would not
exceed 4,000 ampere s in capacity.
b. A sin gle primary ser vice equiva le nt to the totalized prim
service s would no t exceed 3,000 kva in ca pacity.
D. CITY'S RIGHT OF ENTRY TO AND FROM CUSTOMER'S PREMISES:

The City shall at all times have the right of entry to and ex it fro m
the customer's premise s at a ll rea sonable hou rs for any purpose
reasona bly connected with furnishing an d maintainin g of utilities and
the exercise of any and all rights secu red to it by law or these Rules
and Regu lation s.
E. CUSTOMER'S RESPONSIBILITY FOR EQUIPMENT FOR RECEIVING UTILITIES:
The customer shall at his own expense fu rnish, install, and keep in
good a nd safe condition all service c ompone nts su ch as conduit, cable,

quir ed for receiving and utilizing electricity from the City . Such
e quipment shall be m odifi ed, replaced, or rel oc ated at the customer's
e xpense when it is necessary f or the cust omer to receive se rvi ce f rom
a new location, or when required becaus e of highw ay widening or r elo-
c ation, or when po wer lin es are con verted fr om overhead to under-
ground, or fo r o ther reasons deemed to be in the best inter est of the
City.
The City shall not be responsible fo r any loss or dam age oc ca sioned
or ca used by the ne glige nce or wrongful act of th e customer or of any
of his a ge nts, employees, or licensees in inst alling, maintaining,
using, opera ting, or inter fe ring with said f acilities.
SERVICE CONN ECTION MADE BY CITY EMPLOYEES:
Only duly a uthor ized e mployees of the City shall be allowed to c onnect
the custome r's service to, or disconne ct the servi ce f rom, the City's
distr ibution system.
ELECTRIC UTILITY SERVICES:
It is the polic y of the City tha t all new e le ctric utility services
sha ll be provided by undergr ound facilities on the customer's p remises.
The onsite e lec tr ic utility lines s ha ll be provided at the custom er's
expen se and sha ll meet City specifications. Overhead services will be
permitted only when, in the opinio n of the Chief Electrical Enginee r,
underground c onstruction is not feasible .
(1) Number of Servic es per Building:
Only one serv ice dr op or lateral may be extended to a building
or o ther premises to be served, exc ept:
a. Two or mor e service dro ps or laterals may be extende d to a
single building or premises provided they en ter the building
or other structure at po ints at least 150 feet apart (mea-
sured in a stra ight line) and pr ovided all wirin g, other
than co ntrol or mete ring conducto rs, su pplied by each service
ha s no common r ac ewa y or c onnection or serv ice are a with

ELECTRIC SERVICE CONNECTIONS
APPLICABILITY:
This sc he dule applies to all connections to the City's electric dist ri-
butio n system except thos e which serv e street lighting or t raffic sig-
nals.
TERRITORY:
Within the inco rpora ted limits of the City and l and owned or le ased by
the City.
GENERAL DESCRIPTION OF CHARGES:
A. Undergrou nd Systems.
The connectio n charge for u ndergro und residenti al, commercial, or
industrial servic e will consist of one or m ore of the foll owing
types of fe es, wher e applicable:
1. Ser vice Conne ction Fee:
Where the City installs the service conductors, a s ervi ce con-
nec tion fe e shall be charged.
2. On -Site Distributio n System Fee:
Where the City installs or will install the co nducto rs and
s witches in duct systems pro vided by the developer within the
bo undar ies of a subdivision or othe r development, an on -site
distribution system fee shall be cha rged.
3. Off -Site Distribution System -Fee:
Where the City installs or will insta ll an e lec tric distri-
bution system, a system e xtension, or a system reinfo rce men t
o utside the boundaries of a subdivis io n or o ther development
to be served, an o ff -site distribu tion syste m fee shall be
charged.
b. Where the City installs or will install the necessary du ct,
c on ducto rs, junction bo xes, an d pole riser for an un der-
gro und exte nsio n to pro vide for an unde rgr ound service to a

an off -sit e distributi on system fee sh all be charged.
B. Ove rhead Services:
No overhead serv ice for new construction s:: a11 be permitt ed except
with the approval of the Chi ef El ect ri cal E ngineer and only after
a finding tha t an un derground ser vice is not feasible. Where s uch
a serv ic e is allowe d, an overh ead service f ee shall be cha rged .
C. Temporar y Ser vice :
A fe e sha ll be charged to connect a temporary service. For an
under grou nd se rvice, the custo mer shall furnish and install all
mater ial up to the de signated point of conn ection. For an overh ead
se rvice, the City will supply only the servic e -drop co nd ucto rs fr om
ex isting fa cilities. All additional facilities, wh en requi red,
shall be supplied and removed at the customer's expense.
D. Replacement Service:
W here , in the opinion of the Chie f Elec trica l Engineer, repl acement
of service con ductors is necessary, suc h repla cemen t will be mad e
witho ut c ha rge ex cept under the following circumsta nces:
1. Custo mer wisi'es to change the ex isting se rvice to a 125 -ampe re,
3 -wire ser vice but the ex isting co nduit is inadequate.
2. Cu sto mer wishes to change the ex isting service to a siz e larger
than a 125 -amper e, 3 -wire service.
3. Cu sto me r or his agents have damaged the serv ice.
4. The o riginal installa tion _ was no t installe d in accorda nce with
City standar ds and the City has not accepte d responsibility
for mainte nance.
When the City re plac es a service without char ge to the c ustome r, the
custo mer is obligated to ac cept a shu tdown of serv ic e during re gula r
working hours to ac hieve the repla cement. The time of the shutdown
shall be a gre ed upo n as mutually acce pta ble.

When the City repl aces a service for the c onve nience of th e cus-

I. Undergroun d systems:
A. Residential:
These charges a pply to developments in which electric metering
will be on a single-fa mily basis.
1. Service Connection Fe e:
a. 125 -a mpe re ma ximu m, 250 -volt maxim um.
3 -wir e, 100 -foot max imum se rvice length . . . . $60 .00
b. 200 -ampere maximum, 250 -volt maximum,
3 -wire, 100 -foot maximum service length . . . . $80 .00
c. The connection fee for a service re quiring gre ater
