The Council of the City of Palo Alto met on this date at 7:30 p. m.
with Mayor Arnold presiding.
Present: Arnold, Beahrs, Berwald (arrived 7:33 p.m.),
Comstock, Dias, Gallagher. Gvillixeon, Peak son,
Spaeth, Wheatley
Absent: Clark
Approval of Minutes
The Minutes of the Council meeting of August 26, 1968 were
approved as distribut ed.
Signalization Et Camino Real/
Park Boulevard/Serra Street
MOTION: Councilman Comstock moved, and it was duly sec,3n4ed,
that execution be authorized of both the State Division of Highways'
cooperative agreement and the City/Stanford University cost
sharing agreement in connection with intersection signalizat.ion
El Camino Real, Park Boulevard and Serra Street.
The motion carried unanimously by voice vote.
Proposed Parkette = Cowper
Between Lincoln and Kingsley
MOTION: Councilman Pearson moved, seconded by Wheatley,
that in the matter of the proposed downtown parkette that the
Mayor designate a time for an executive session to discuss the
property agent's findings.
Discussion followed and City Manager Morgan stated in reply
to question that the only parkette property on which he can report
is on the acquistion of all or portions of the parcel on Cowper
Street in response to the Council direction of May 27, 1968 to
investigate its availability.
MOTION: Councilman Berwald moved that the subject be referred
back to the Public Works Committee.
The motion o refer failed for lack of a second.
SUBSTITUTE MOTION: Vice Mayor Diaa moved, and it was duly
seconded, to drop consideration of t}. mattor.
Mayor Arnold ruled the motion out of order.

The motion carried by majority voice vote.
Mayor Arnold set the matter as the last item on the Agenda to
be considered upon completion of the Agenda for the September 16,
1968 meeting.
MOTION: Councilman. Spaeth moved, seconded by Comstock, to
table the matter at present.
The motion carried unanimously by voice vote,
Notification to State of Building

MOTION: Councilman Gallagher moved, and it was duly seconded,
that the Council authorize the Mayor to notify the State Department
of Housing and Community Development that the Uniform Building
Code, National Electric Code and Uniform Plumbing Code as
recently adopted by the City Council are recog, ,izcd as being
equal to or more restrictive than the State codes.
The motion carried unanimously by voice vote.
Property Tax Refund -
Stanford Leased Lanas
City Attorney Hildebrand advised the Council of the status of the
complaint for refund of property taxes on Stanford leased lands,
stating that the recent decision of the Superior Court will be
appealed, and observing that neither the City nor the County would
consider the matter settled short of a decision by an appellate
court,.

San Francisco Commuter -T... -et
MOTION: Councilman Berwald moved, and it was duly seconded,
that the Mayor be authorized to send to the Santa Clara County
Board of Supervisors the letter prepared by the City Attorney
stating Palo Alto's opposition to the San Francisco Commuter Tax.
The emotion carried unanimously by voce vote.

Councilman Comstock urged Council members to complete the form
distributed by the Planning Policy Committee and give them to
the City Clerk.
Expansion of Shell Oil Station -
Embarcadero Road
MOTION: C oun`ilmnan Gallagher moved, seconded by Comstock,
to refer the letter distributed to Council members on the subject
of possible expansion of the Shell Service Station on Ennbarcadero
Road to the Planning Commission for their information in connection
with the, consideration of any expansion of the Station.
The motion carried unanimously by voice vote.

Transporation Policy Committee
Councilman Gullixson reported that a report of the Transporation
Policy Committee with his covering letter was rn@tii.ed to Council
members today. It was requested the report be made an Agenda
item at the next Council meeting.
Northern California Power Agency
Vice Mayor Dias announced she had just returned from the meeting
of the Northern California Power Agency held in Sacramento today.
She advised that the Agency has hired R. W. Beck & Associates
to update and make additions to the studies for the Agency and that
an attorney has also been engaged. Vice Mayor Dias continued,
stating that five alternatives had been presented and two were
selected for presentation to Secretary of the Interior Udall in
Washington, D. C. at a meeting set for September 23, 1968, and
that Palo Alto representatives believe that it is not necessary or
desirable for Palo Alto to participate at this early date in view of
the City's l'�z-�x range interest in providing power.
Watson Amendment
-MOTION: Mayor Arnold moved, seconded by Gallagher, that the
staff be requetcd Ilub'rnit a cop rt giving the pros and cons
of the ',Watson Amendment" to be included as Proposition 9 on the
General Election y allot in Novernber.
Upon advice of City Manager Morgan that his office is preparir•g
such a report calling to the attention of th. Coui cil the impact
on .cities if Proposition 9 is adopted, Mayor Arnold withdrew the
motion,

MOTION: Councilman Beahrs moved, seconded by Berwald, to
lift from the table for consideration at this time the motion
regarding findings of the property agent in regard to the proposed
parkette on Cowper Street.
The notion carried by majority voice vote,
(The Council recessed to executive session from ii:20 to 8:35
p.m.)
MOTION: Councilman Wheatley moved, and it was duly seconded,
that the Council authorize the City /vIanager to prepare a resolution
of condemnation to prepare for acquisition of the available property
owned by Mr. John Newson on Cowper Street. (See P. 244)
SUBSTITUTE MOTION: Councilman Gallagher Moved, seconded
by Beabrs, that the matter be referred to the Planning C. .mission

prior to consideration of adoption of a condemnation resolution by
the Council.
Mayor Arnold ruled the substitute motion out of order since the
motion before the Council. is also a referral motion.
MOTION: Councilman Spaeth moved, seconded by Gullixson, to
continue the matter for three weeks (October 7, 1968).
AMENDMENT: Councilman Spaeth moved, seconded by Arnold,
to continue the matter for five weeks (October 21, 1968).
The amendment carried unanimously by voice vote.
The motion to continue as amended then failed on the following
roll call vote:
Ayes: Beahrs, Dias, Gallagher, Gullixson, Spaeth
Noec: Arnold, Berwaid, Comstock, Pearscn, Wheeticr
AMENDMENT: Councilman Wheatley moved, seconded by Beahrs,
that the proposed condemnation resolution to be prepared by the
City Manager's staff be returned to Council in five weeks (October
21, 1968).
The amendment carried unanimously by voice vote.
AMENDMENT: Councilman Gallagher moved, seconded by Dias,
that the proposed resolution be one which stops "short of
condemnation proceedings."
a_mendment failed by majority voice vote.
The motion as amended that the proposed condemnation resolution
be presented to Council in five weeks then carried by majority
voice vote.
Adjournment
There being no further business, the Council adjourned at 9:05 p.m.

Akproval of Minutes
Vice Mayor Dias requested that on page 720 of the Council Minutes
of September 10, 068 be corrected to indicated Mrs. McCann's
first name is "Kay."
Councilman Pearson requested that on page 210 of the Minutes of
September 10, 1968 in regard to the relocation of Embarcadero
Road than an addition be made to indicate that Santa Clara County
Director of Public Works James Pott stated in respnne to a ques-
tion from Councilman Comstock that he would consult with the
Sea Scouts on the location of their base at the Yacht Harbor.
There were no objections.
The Minutes of September 10, 1968 were then approved with the
correction and addition.

Mayor Arnold declared open_the__ hearing -ten the —Engine its Report
and Assessment —L et on Weed Abatement, stating that notice has
been given and publication has been made in accordance With the
law.
In reply to question, City Clerk Klarnrn reported no written
protests had been received.
Mayor Arnold then declared the Hearing closed.
MOTION: Councilman Spaeth introduced the following resolution and
moved, seconded by Beahrs, it'3 adoption:
Resolution_ No. 4161 entitled "Resolution of the Council of the
City of Palo Alto Confirming the Engineer's Report and Assess-
ment List for Weed Abatement"
The resolution was adopted unanimously by voice vote.
