RESOLUTION OF THE COUNCI L OF THE CITY OF
PALO AL TO FIN DING AN D DET ERMINING T HAT TH E
PUBLIC INTERES T AND NE CESSITY OF SAID CITY
REQ UIRE, FOR PUBLI C US E FOR PU BLIC GR OUNDS,
CERTAIN LAND LOCATE D IN THE CITY OF P ALO
ALTO, COUN TY OF SANTA CLA RA, STA TE OF
CALIFORNIA
The Co uncil of the C ity of Palo Alto d oes RESOLV E as
fo llows:
SECTION 1. That the Counc il of the City of Palo Alto has found
and dete rmine d, and hereby doe s find, determin e and d ecl are, th at the
public inter est a nd necessity requir e the acquisition by the City of Palo
A lto of the r eal pro per ty descr ibed in Section Z hereof f or public grounds
purpose s.
SECT ION 2. T hat the taking in fe e simple of the property
described in EXHIBIT A attac hed her eto a nd delineate d on the map marked
EXHIB IT B a ttac hed here to and by refer enc e made a pa rt hereof, situat ed
in the City of P alo Alto, C ounty of Santa C lara, State of C alifor nia,' is
ne cessar y for such purpo se.
SECT ION 3. That said pr oposed ac quisition is planned and loc ated
in a manner whic h will be mos t compatible with the gr eatest public good
a nd the least pr ivate injur y, and all of suc h acquis ition if.. loc ated within
the territorial limits of the C ity of Palo Alto.
SECT ION 4. That the C ouncil of the City of Palo Alto he re by de-
c lares its intention to acquire title in fee simple in said la nd de scribed in
EXHIB IT A under eminent do main proce edings, a nd the City Atto rne y of the
C ity of Palo A lto and the law firm of Messrs. Wilson, Jone s, Morto n & L ynch,

employ ed for that p urp os e, are hereby direct ed to institute and conduct
to conclusion an action in emin ent d omain for the acquisiti on of said
prop erty in fee simple, and to take such action as is necessary therein.
SECTIO N 5. The City Man ager is her eby auth orized and direct ed
as an alternative to tri al of any acti on in eminent domain initiated her e-
under to purchase f or such reas onable sums as he may deem appr op riate
the several parcels of land afor es aid and to cause to be draft ed exec uted
and delivered on beh alf of th e City all d ocuments, eithe r to be used with-
in or without the cond emnation p roceeding afo resaid, necessa ry or
convenient to a ccomplish this purpose.
SECTION 6. The City Man age r is furth er authorized to sp end fr om
gene ral funds of the City heretofore appr opriat ed for such purpos es such
monie s as are nec essary and as in his opinion may constitute the fai r
ma rket _ va lue of said parce ls Lased upon apprais als of duly qu alified and
competent real estate appraiser s.
SECTION 7. The City C le rk shall certify to the adopti on of this
reso lution by a vo te of two-thirds of a ll of the memb ers of the City
C ouncil.
