The Council of the City of Palo Alto met on this date at 7:33 p. m.
with Mayor Arnold presiding.
Present: Arnold, Beahrs, Berwald, Clark, Comstock
(arrived 9:00 p.m.), Dias, Gullixsoji, Wheatley

The Minutes of the Council "ri+eeting of August 12, 1968 were
approved as distributed.
Hearing - Park Abandonment
Mayor Arnold declared open the hearing on discontinuance as a
public park of certain lands in connection with the Joint Sewage
Treatment Plant site.
City Manager Morgan, using the exhibits on display, described
the relationship of the parcel of land involved and the significance
of the proposed abandonment.
There being no one present wishing to speak, Mayor Arnold
declared the hearing c:osed.
MOTION: Councilman, Clark introduced the following ordinance
and moved, seconded by Beahrs, its adoption:
Ordinance No. 2454 entitled "Ordinance of the Council of
the City of Palo Alto Calling a Special Election to Submit
to the Electors the Question of Discontinuance of the Use

The ordinance was adopted unanimously by voice vote.
City Clerk Klamm read a notice of date for submission of ballot
arguments, setting the date at 5:00 p.m., Friday, September
13, 1968.
Mayor Arnold announced he would appoint two councilmen to write
the argument for the ballot.
Civic Center District Regulations
MOTION: Councilman Beahrs introduced the following ordinance
and moved. seconded by Clark, its approval for first reading:
"Ordinance of the Council of the City of Palo Alto Amending
Chapter 18.79 of the PAMC ("--C Civic Center District

Regulations") to Provide Uniform Height Requirements
Throughout the District, to Restrict Special Setback
Requirements to Certain Frontages, and to Clarify Off -Street
Parking and Sign Regulations"
AMENDMENT: Vice Mayor Dias moved, seconded by Clark, that
in Section 18.79.040 of the proposed ordinance "block" be changed
to "blocks" and "City Hall" be changed to "City Hall -Library
complex."
AMENDMENT TO THE AMENDMENT: Councilman Clark moved,
that the properties south of Forest on Ramona Street be exempted.
The amendment failed for lack of a second.
The amendment carried by majority voice vote.
The proposed ordinance as amended was approved for first
reading on the following roll call vote:

Tax Rate - 1968-69 (CMR:030:9)
MOTION: Councilman Wheatley introduced the following ordinance
and moved, seconded by Beaters, its adoption with the tax rate set
at $.74:
Ordinance No. 2459 entitled "Ordinance of the Council of
the City of Palo Alto Fixing the Tax Rate for the Fiscal
Year 1968-1969 at $.74."
AMENDMENT: Councilman Berwald moved that the tax rate be
set at $.75.
The amendment failed for lack of a second.
The ordinance was adopted unanimously by voice vote.
1968-69 Ad Valorem Tax Rate

MOTION: Councilman Wheatley introduced the following ordinance
and moved. seconded by Beahra, its adoption with rate set at
$.413:
Ordinance No. 2460 entitled "An Ordinance Fixing Ad Valorem
Assessment for Fiscal Year 1968-69, University Avenue
District Off -Street Parking Project No. 52-13 and University
Avenue District Off -Street Parking Project No. 52-14"
The ordinance was a r'pted unanimously by voice vote.
MOTION: Councilman Wheatley introduced the following ordinance
and moved, seconded by Clark, its adoption with the rate set at
$. 857:
Ordinance No. 2461 entitled "An Ordinance Fixing Ad Valorem
Assessment for Fiscal Year I968-69, California Avenue Dis-
trict Off -Street Parking Project No. 55-5"
The ordinance was adopted unanimously by voice vote.
MOTION: Councilman Berwald introduced the following ordinance
and moved, seconded by Clark, its adoption with the rate set at

MOTION: Councilman Oullixson introduced the following ordinance
and moved, seconded by Clark, its adoption with the rate set at
S.788:
Ordinance No. 2464 entitled "An Ordinance Fixing Ad Valorem
Assessment for Fiscal Year 1968-69, California Avenue
District Off -Street Parking Project No. 60-8"
The ordinance was adopted unanimously by voice vote.
Bond Election - Sewage
Treatment Facilities
MOTION: Councilman Wheatley moved, seconded by Dias, that
since eight votes are required for the proposed ordinance calling
a bond election in connection with sewage treatment facilities
and only seven councilmen are present that the item be continued
to the meeting of September 10, 1968.
The motion carried unanimously by voice vote (NOTE: See below
for further action)

MOTION: Councilman Beahrs moved, seconded :sy Berwald, that
since eight votes are required for the proposed resolution regarding
the need for private parcels of land in connection with the sewage
treatment facilities that the item be continued to the meeting
of September 10, 1968.
The motion carried unanimously by voice vote (NOTE: See below
for further action)
Rinconada Park Expansion project No. 66-11

described present plans for the expansion of Rinconada Park.

and moved, seconded by Wheatley, its approval for first reading:

The ordinance was approved .tnani:nously by voice vote.
MOTION: Councilman Clark moved, seconded by Wheatley, that
the staff be authorized to commerce bidding procedures in
connection with Rinconada Park Expansion Project No. 66-11.
The motion carried unanimously by voice vote.
MOTION: Councilman Clark introduced the following ordinance
and moved, seconded by Berwa!d, its approval for first reading:
"Ordinance of the Council of the City of Palo Alto Amending
Chapter 22.08 (Park Dedications) of the Palo Alto
Municipal Code by Adding Thereto Section 22.08.211 En-
larging Rinconada Park"
The ordinance was approved unanimously by voice vote.
Tax Rate 1968-69
Mayor Arnold stated that the s eport of the City Manager on the
tax rate for 1968-69 had been considered along with the adoption
of Ordinance No. 2459 (see above).
Planning Policy Committt a Staffing
(Councilman Comstock arrived at 9:00 p.m.)
MOTION: Councilman Comstock moved, seconded by Beaters,
that the Council go on record with the Inter City Council as
favoring staff support of the Planning Policy Committee at the
County level and that the ICC be asked to__ a z,.. st th -Santa Cara-
County Board of Supervisors to provide the desired staff assistance.
AMENDMENT: Vice Mayor Dias moved, seconded by Gullixson,
to add "with no assessment upon the individual cities."
The amendment carried unanimously by voice vote.
The motion as amended carried by majority voice vote.
Bond Election - Sewage
Treatment Facilities
MOTION: Councilman Beaters moved, seconded by Berwald,
reconsideration of the continued item relating to a bond election
in connection with sewage treatment facilities.
The motion carried unanimously by voice vote.

MOTION: Councilman Beahrs introduced the following ordinance
and moved, seconded by Comstock, its adoption:
Ordinance No. 2465 entitled "An Ordinance Calling A Special
Municipal Bond Election in the City of Palo Alto for the
Purpose of Submitting to the Electors of Said City the Measure
of Incurring a Bonded Indebtedness of Said City for the
Acquisition, Construction and Completion of the Following
Municipal Improvement, to wit: Sewage Treatment Facilities;
Declaring the Estimated Cost of Said Municipal Improvement,
the i°►mount of the Principal of Said Indebtedness to be
Incurred Therefor, and the Maximum Pate of Interest to be
Paid Thereon; Making Provision for the Levy and Collection
of Taxes; Fixing the Date of Said Election, the Manner of
Holding the Same and Providing for Notice Thereof; and Con-
sclidati ig Said Special Municipal Bond Election with the State
of California General Election to be Held on November 5, 1968"
The ordinance was adopoed unanimously by voice vote.
Regional Wastewater Treatment Works Project No. 68-81

MOTION: Councilman Beahrs moved, seconded by w dd,
reconsideration of the continued item regarding the need for
private parcels of land in connection with the sewage treatment
facilities.
The motion carried unanimously by voice vote.
MOTION: Co.ncilrran Beaters introduced the following resolution
and moved, seconded by Berwald, its adoption:
Resolution No. 4157 entitled "Resolution of the Council of
the City of Palo Alto Finding and Determining that the Public
bite -rest -and -Necessity ofSaid-City Require for Public
Use the Acquisition of City Land"
The resolution was adopted unanimously by voice vote.
El Camino Park
Councilman Wheatley requested that the itern relating to -the tax
situation concerning El Camino Park be continueri until there is
a final report from the City Attorney on the matter.
There were no objections.
Performing Arts Center
MOTION: Councilman Wheatley moved, on behalf of the Public
Works Coxarnittee, that the matter of a study of construction of
a new performing arts center be returned to Council and that no
action regarding such a center be taken.
The motion carried unanimously by voice vote.

Trails and Paths Plan
Councilman Wheatley moved, on behalf of the Public Works Com-
mittee, that the Council: (1) adopt the concept of the Trails and
Paths Plan as interim policy and all referral to the Planning
Commission, and that the Planning Commission will include
San Francisquito Creek and the Hetch Hetchy right-of-way in their
considerations; and (2) request the staff to investigate with other
jurisdictions the feasibility of joint participation in establishment
of routes and report their findings to the Council.
The motion carried unanimously by voice vote.
Commuter Tax - City and County
of Sari Francisco
MOTION: Councilman Berwald moved, and it was duly seconded,
to authorize the City Attorney to draw up an appropriate com-
munication which would indicate to the Santa Clara County Board
of Supervisors that the City Council c.f Palo Alto supports them in
their opposition to the City and County of San Francisco commuter
tax.
In discussion Councilman Berwald stated that it was his intention
the proposed communication would be a draft letter and that the
City Attorney would obtain for reference a copy of the ordinance
recently enacted by the San Francisco Board of Supervisors.
The motion carried unanimously by voice vote,
