RES OLUTION NO. 4145
RESOLU TION OF THE COUNCIL OF THE CITY or PALO ALTO
DECLARING THAT THE PUBLIC INTEREST OR CON VENIENCE
REQUIRES THE DISCONTINUANCE or THE USE OF CERTAIN
LANDS AS A PUBLIC PARK AND THAT THE COUNCIL INTENDS
TO CALL A SPECIAL ELECTION TO SUBMIT THE QUES TION
OF DISCONTINUANCE TO THE CIT Y ELECTORS
WHERE AS, pur suant to the requirem ents of Arti cl e VIII of
the Char ter of the City of Palo Alto, the C ou ncil did by O rdinance
No . 2252 dedic ate lands known as Byxbe e P ark and the City -owned
Baylands for par k pur po ses, and
WHEREAS, the Counc il de sires to utilize a po rti on of said
lands, as delineate d on thy: map marked EXHIBIT A att ached hereto,
as a part of the site for the Joint Sewa ge Treatment Plant said
additiona l la nds bein g ne ce ssar y for the a esthetic d ev el opme nt
of the to tal site in harmon y with su rrounding lands r emaining
dedica ted for park use ,
NOW , THEREFORE, the Council of the City of Palo Alto does
hereby re solve as follo ws:
SECTION 1. That the public inte rest or co nvenie nce requires
the disc ontinuanc e of the u se as a public park of lands desc ribed
in sa id EXHIBIT A, so that said lands can be a dded to the site
for the Joint Sewage Tre atment Pla nt.
SECTION 2. That the Coun cil intends to call an election
for the purpose of s ubmitting the questio n of suc h discontin uance
to the city elec to rs.
SECTIO N 3. Tha t Auguste 26, 1968 at 7:30 p. m. in the Counc il
Chamber s of the City Ha ll in the City of Fs lo A lto is here by
fixe d as the time and place at which the public or perso ns
particularly inter este d may pr ote st such disc on tinua nce .
SECTION 4. That any time before the hour set for such he arin g
an y per son or pe rsona inter ested ma y protest in writing against
the prop os ed ab andonment and disco nti nuan ce, or to the extent
thereof. Such p rotests sh all be deli ve red to the City Clerk at
the City Hall .
SECTION 5. Th e City Engi neer shall c ause at l ea st three
n otices of the ad option of th e resoluti on to be p ost ed conspicuou s-
ly not mor e than thr ee h und red fe et apart along the exte rior
boundaries of the area prop osed to be dis continued or aband oned
as a public park. Posting sh all be completed at least twe nty
da ys before the time set for the heari ng. Failur e to post the
no tices shall no t in validate the p ro ceedings or prevent the
Cou ncil fro m a cquiring jur isdiction to proc eed with the discon-
tinua nce and aban do nme nt. The posted notices shall be head ed:
"No tice of propo sed disco ntinuance of public park land" in
legible chara cter s, state the date of adoption of th e resolution,
and recite the facts c ontained in the resolution .
