HomeMy WebLinkAbout07221968City Hall Palo Alto, California July 22, 1968 The Council of the City of Palo Alto met on this date at 7:34 p.m. with Mayor Arnold presiding. Present: Arnold, Beahrs, Berwald (arrived 7:36 p.m.), Clark, Comstock (arrived 7:3i p.m.), Dias, Gallagher, Pearson, Wheatley Absent: Guilixson, Spaeth Approval of Minutes The Minutes of the Council Meeting of July 8, 1968 wire approved. Report of Hurnan Relations Council Mayor Arnold read the report of the Pale, Alto Human Relations Council dated July 16, 1968, transmitted by C•hairrnan. John Zenger and containing the affirmative action guidelines for City contracts and services which would become a part of the City's non-discrimination Ordinance No. 2424 upon adoption Of resolution pursuant to Section 2. 30. 090 of the Palo Alto Municipal Code. Councilman Berwald, Council liaison representative to the PAHRC, commented on the report and recommended its approval. Dr. John Zenger was asked to comment on the report and to reply to questions from the Council. Discussion followed and City Manager Morgan and_ City -Attorney Hildebrand replied-to-question9 concerning specific provisions and requirements: of the proposed guidelines. MOTION: Councilman Berwald introduced the following resolution and moved, seconded by Comstock, its adopticn with "15 days" insertedin the blank space in Section 4. Resolution No. 4144 entitled. "Resolution of the Council of the City of Palo Alto Setting Forth Affirmative Action Guidelines to Promote Equal Opportunity in Employment on City Contracts" AMENDMENT: Councilman Berwald moved, and it was duly seconded, that in Exhibit A in item No. 1 in the fifth line following "taken" the rest of the sentence be deleted and the following be substituted: "during the past year and will take, if awarded the contract," The amendment failed by majority voice vote:. 173 7/ 22!68 AMENDMENT: Councilman Berwald moved, and it was duly seconded, that in Exhibit A, Section 2. c. "Any bidder" be substituted for "Those bidders" and "his" be substituted for "their." The amendment carried unanimously by voice vote. AMENDMENT: Councilman Berwald moved, seconded by Com- stock, to add language to the resolution approved by the City Attorney which would provide for the posting of notices of the law prohibiting discrimination and advising anyone who feels he is being discriminated against to advise the City Manager. City Attorney Hildebrand advised that the Fair Employment Practices Commission is the agency designated by the State of California to rule on such matter, although anyone may be advised advised. The motion carried by majority voice vote. AMENDMENT: Councilman Berwald moved, seconded by Com- stock, that in Section 2. d. the words following "presents" be deleted and' the following substituted "a satisfactory affirmative action program to further minority employment and provide equal opportunity for upgrading and promotion." Discussion followed and Mr. Morgan and Mr. Hildebrand observed that the line in question refers to subcontractors in addition to the contractor. Councilman Berl. ald, with the consent of his second, withdrew his proposed amendment. ------------- MOTION: CouncilmanBerwald moved, .seconded by Whoatiey, to hear -frorn-aai one in the audience who wishes to speak. William Flately, 479 O'Keefe, East Palo Alto, spoke in support of the guidelines presented in the PAHRC report and suggested the City might share with individual contractors any costs for the contractor's program. AMENDMENT: Vice Mayor Dias moved, seconded by Beahrs, that in Exhibit A, Section 2. e, in the second sentence "and the PAHRC" be stricken and that "they" which occurs in two places in the last sentence of Section 2. e. be changed to "he." SUBSTITUTE MOTION: Councilman Berwald moved, seconded by Beahrs, to add to Exhibit A, Section .2. e. "Any questions from the bidder to the City relative to the guidelines will be addressed to the City Manager." Councilman B.:ahrs asked to withdraw his second, and Mayor Arnold ruled that he could not do so. The substitute motion failed by majority voice votes. 174 7/22168 AMENDMENT: Upon ruling of Mayor Arnold that her amendment would not automatically come before the Council upon failure of the substitute motion, Vice Mayor Dias moved, seconded by Gallagher, that in Exhibit A, Section 2. e. in the second sentence "and the PAHRC" be stricken and that "they" which occurs in two places in the last sentence of the section be changed to "he." The amendment carried by majority voice vote. Discussion followed concerning an evaluation time table and report on the offertiveness of the guidelines just adopted, and City Manager Morgan replied that every contract over $5, 000 would come before the Council for approval at which time reference to the. contractor's Minority Employment Program (MEP) would be included in the report. The motion carried unanimously by voice vote. MOTION: Councilman Wheatley moved, seconded by Clark, to approve the appointment of Peter G. Stone as Assistant City Attorney as recommended by City Attorney Hildebrand. The motion carried unanimously by voice vote. Joint Sewage Treatment Plant Mayor Arnold moved, seconded by Comstock; to take up as. an urgency item the matter of the Joint Sewage Treatment Plant. The motion carried unanimously by voice vote. 175 7/22/68 City Manager Morgan and City Attorney Hildebrand _resented the report referred to ir, Mr. Hildebrand's letter of July 7,9, 1968 concerning the status of the agreement between Pale Alto, Mountain View and Los Altos by which the cities would purchase, erect and operate a Joint Sewage Treatment Plant. It was pointed out that the general obligation bond issue could be put to the electorate in the November election, however, an element of the total project would be the abandonment of a small parcel of park dedicated land for which 30 days notice and hearing are required, and the deadline date for submitting ,-o.,==mac:e to he Board of Supervisors for propositions to be included on the November ballot is September 6. MOTION: Councilman Beahrs introduced the following resolution and moved, seconded by Wheatley, its adoption: Resolution No. 4145 entitled "Resolution of the Council of the City of Palo Alto Declaring that the Public Interest or Convenience Requires the Discontinuance of the Use of Certain Lands as a Public Park and That the Council Intends To Call a Special Election to Submit the. Question of Dis- continuance to the City Electors" Thr' resolution was adopted on the following roll call vote: Ayes: Arnold, Beahrs, Berwald, Clark, Comstock, Dias, Gallagher, Wheatley Noes: Pearson University Underpass Irrigation ystem MOTION: Councilman Beahrs moved, seconded by Gallagher, to reject the bid from Collishaw Sprinkler Company for the inatalltion of an automatic irrigation system in the. University Avenue Underpass area in accordance with the request of the City Manager. +California Avenue Area Parking (CMR:007:9) MOTION: Councilman Wheatley introduced the following resolution and moved, and it was duly seconded, its adoption: f.esolution No. 4146 entitled "Resolution of the Council of the City of Palo Alto Amending Resolution No. 2971 to Limit Parking Along Certain Prctione of Washington Avenue, California Avenue, Emerson Street and High Street" The resolution was adopted on the following roll call vote: Ayes: Arnold, Beahrs, Comstock, Gallagher, Pearson, Wheatley Noes: Clark, Dias 176 7/22/68 Report on Downtown Parks Project No. 66-12 (CMR:009:9) City Manager Morgan presented his report on the Downtown Parks Project in connection with Council direction of May 27, 1968 designating the block bounded by Waverley, Kipling, Everett and Hawthorne as a neighbo:rloo.l park site. MOTION: Councilman Bcahrs introduced the following resolution and moved, seconded by Wheatley, the adoption of the following resolution: "Resolution of the Council of the City of Palo Alto Finding And Determining that the Public Interest and Necessity of Said City Require, for Public Use for Public Grounds, Certain Land Located in the City of Palo Alto, County of Santa Clara, State of California" AMENDMENT: Councilman Comstock moved, seconded by Pearson, that the City Manager be directed to report to the City Council the status of each property and its state of negotiation prior to initiating any eminent domain trial proceedings. CHANGE OF MOTION TO AMEND: Upon advice of City Manager Morgan, Councilman Comstock, with the consent of his second, added that the item also be continued and staff be directed to redraft the resolution to include the proposed amendment. AMENDMENT TO AMENDMENT: Councilman Pearcon moved that the staff be directed to include a section in the resolution regarding the leasing of lands to persons involved in the proposed park block. The amendment failed for lack of a second. PREVIOUS QUESTION: Councilman Clark moved, seconded by Wheatley, the previous question. The motion carried by majority voice vote. The mot: on to continue pending redrafting of the resolution to include an amendment then carried by majority voice vote. Sale General License - 14iddlefielc(R.oad City. -Attorney Hildebrand reported that an off -sale general license has been issued over the City's protest to Arden -Mayfair, Inc. 3922 Middlefield Road. Mr. Hildebrand advised that a strong protest had been prepared by his office in accordance with Council direction, but that the protest had been denied. He added that the School Dibtrict also lodged a protest but failed to have any representative appear at the hearing. 177 7/22/68 1976 Olympics Committee Vice Mayor Dias, Secretary to the San Francisco Bay Area Olympics Committee, reported on the status of the efforts of the Committee to have the P. iy Area selected as the site of the 1976 Olympics. She advised that the site will be selected in September at a meeting in Chicago, and that, if the Bay Area is selected, Palo Alto will be heavily involved since the temporary Olympic Village would be constructed at Stanford and the track and field events would be held there. She added that funds are being solicited in the amount of $25, 000 to make the presentation and suggested Palo Alto might pledge $11, 500. She announced such an item will be on the Council Agenda for the next meeting on August 5, 1968. Wr*4en Communications Letter dated July 11, 1968 from Bakke/Cann/Page Associates requesting reactivation of rezoning of property request re- ferred to staff August 17, 1964. MOTION: Councilman Clark moved, seconded by Wheatley, to refer the letter to the Planning Commission for review and return to Council. The motion carried unanimously by voice vote. Oral Communications Melvin Hawley, attorney representing Robert Cave.11ero, owner of property at 3175, 3179, 3183 and 3187 Middlefield Road, requested a variance be granted for his property in connection with compliance with Ordinanc' No. 2274 which requires certain paving and barriers in parking lots. MOTION: Councilman Comstock moved that the request he filed. The motion failed for lack of second. Adjournment There being no further business, the Council adjourned at 11:06 p. m.
