The Council of the City of Palo Alto met on this date .-it 7:33 p. m.
with Mayor Dias presiding.
Present: Arnold, Beahrs (arrived 7:38 p.m.), Berwald,
Clark, Comstock, Dias, Gallagher, Gullixson,
Pearson, Spaeth, Wheatley
Absent: None
Approval of Minutes
Councilman Clark requested that on page 141 of the Minutes of
June 10, 1968 a correction be rnade to the amendment regarding the
Civic Center District Regulations to indicate the maximum height
is to be 70 feet rather than 60 feet.
There were no objections.

Hearing - Old Trace Road Project No. 64-4

on Old Trace Road, et al, Project No. 64-4 will he on file
in the Office of the City Clerk)
Mayor Dias opened the public hearing on the Old. Trace Road, et
al., Project No. 64-4, stating that there are three separate hear-
ings all of which will be combined and held at the same time
because they all deal with the same basic project: (1) Hearing on
the guest on of -whether the public corveruence and necessity require
the proposed acquisitions and improvements. This hearing is
held under the State Constitution, and any Council determination in
order to be legally effective must be made by a vote of 415ths of
the Council; (2) Hearing on the Engineer's Report prepared pursuant
to Resolution No. 4077. This report, prepared by the City Engineer,
consists of plans and specifications, estimates of cost, property
descriptions, assessment diagram, and a proposed assessment,
all of which are on file in the office of the City Clerk; (3) Hearing
on the question of forming Underground Utility District No. 7.
in response to request, City Clerk Klarnrn reported that she has
on file the affidavits indicating publication and mailing of notices
has been completed as required.
Mayor Dias then asked for the staff presentation, stating it would
be followed by oral testimony and comments from the public.
City Manager Morgan made an opening statement describing the
proposed project and introduced individual staff members for
testimony in each of their own special fields of knowledge.

Planning Officer Fourcroy described pact and present requests for
lot splits, future development of the area and Planning Commission
proceedings.
Assistant Fire Chief Korpf referred to wall maps and made a
slide prese'.itation regarding street pattern and emergency fire
roads, fire insurance rates and spoke of Fire Department concerns.
Police Chief Hydie described the relation of street pattern and
safety lighting to law enforcement in the area.
City Engineer Witbeck described the project assessment formula
and benefits to be derived from the proposed project and filed the
Engineer's Report with the City Clerk. Mr. Witbeck introduced
members of the Public Works Department for specific comment
on each of their portions of the proposed project!
Chief Engineer May of the Water -Gas -Sewer Department
referred to a wall map and described the present and proposed
facilitie ,.
Chief Engineer Bosza of the Light and Power Department,
referred to wall maps and described the present and proposed
light and power facilities and the plans for telephone lines.
Bond Counsel Kenneth 1. Jones described his qualifications and
those of Leonard J. Doyle, MA. 1. , the project appraiser. He
questioned Mr. Doyle as to his experience, qualifications and
opinion regarding the project benefits. Mr. Doyle replied that in
his opinion benefits to be derived from the project would exceed
their cost.
City Clerk Klarnm read a form protest and the names of the
property owners in the proposed assessment who had sighed it.
Mrs. Klamrn also read the names of those who had written to the
'Council in protest of certain portions of the project ann'of those
who had written in favor of the project.
Mayor Dias then invited public comment.
The following persons spoke in opposition to all or parts of the
proposed project:

representing property owners Majorie and Edith Eaton
Kenneth Gardner, M.D., property owner, 4174 Oak Hill.
Frank Bower, property owner, 4256 Manuela.
Albin E; Dannell, 200 Third Street, Los Altos, attorney
representing property owness Mr. and Mrs. Hendrik Ligtelyn,
4270 Manuela.

Frank Grist, Jr. , attorney representing property owners on
Mesa and Oak Hill, presented a petition containing 30 signatures,
Judson Shutts, son of property owner, H. Shutts, x_225 Manuela
Edward Arbuckle, property owner, 4131 Old Trace Road.
Mrs. Robert Goodlin, property owner, 900 Old Trace Road.
Jock Schmidt, property owner, 868 Robb Ro :d.
Gary Nielson, tenantg945 Oid 'brace Road.
Colin Hacking, property owner, 865 Mesa,
Geoge Ditz, property owner, 911 Arastradero Road.
S. G. Creasey, property owner, 920 Old Trace Road
Hamilton Shutts, property owner, 4225 Manuela.
Jack White, property owner, 850 Mesa.
Thomas Phifer, property owner, 883 Robb Road.

Bond Counsel Jones then replied to points raised by property owners
in the letters and at the hearing. City Engineer Witbeck also replied
to some of the questions, and City Manager Morgan reported on all
of the previous :meetings with property owners concerning the
project.
Mayor Dias them closed the Public Hearing.
City Engineer Witbeck reported the percentage of protest by
property owners was 31%, , and that the percentage of protest was
calculated on an area basis.
MOTION: Vice Mayor Arnold moved, seconded. by Spaeth, to
cantanue Council consideration of the item for two weeks.
AMENDMENT: Councilman Wheatley moved, seconded by Behars,
to continue the item for three weeks during which time councilmen
could consider the matter and put any motions they may wish to .
make in writing.
The amendment carried unanimously by voice vote.
The motion as amended carried unanimously by voice vote.

MOTION: Councilman Spaeth moved, seconded by Beahrs, to
adjourn until 7:30 p.m. on Monday, July 1, 1968.
