RESOLUTION NO . 4134
A RESOLUTION DETERMINING UNPAID ASSESSMENTS
AND PROVIDING FOR ISSUANCE OF BONDS
GREEN ACRES II U NDERGROUND UTILITIES CONVERSION
PROJECT 66-6
RESOLVED, by the Council of the City of Pal o Alto, Califor nia,
that
WHEREAS, said Council did, on J anuary 22, 1968, pass and adopt
its Reso lu tio n No. 4067 of Prelimina ry D eterminatio n and of Int entio n,
rela ting to the acquisition and co nstruction of public improvements
in said City under and pursuant to the pro visions of Chapter 13.12,
Palo Alto Municipal Code , and did therei n p rovide that se rial bonds
wo uld be issued thereunder pursuant to the provisions of Bond Pl an B,
Section 13. 16.110 of Chapter 13.16 of Title 13 of s aid Code, reference
to said Resolutio n of Pr eliminary Determination and of Intention
hereby being e xpr essly made for further par ticulars;
WHEREAS, notice of the r ecor da tion of the assessment and of the
time within w hich a ssessments may be paid in cash, has been duly
published and mailed in the man ner pro vided by said Code , and th e
time so provided for receiving the pa yment of a ssessme nts in cash has
expired, and the City Tr ea surer ha s filed in his office a list of all
a ssessments which now remain unpaid; and
WHEREAS, the Council has duly considered said list an d ha s
determined that the sa me is an accura te statement thereof;
NOW, THEREFORE, IT IS HEREBY ORDERED, as follows:
1. That the assessments in said unpa id list which n ow rema in
un paid, and the aggre gate there of, a re as shown on Exhibit "A" hereto
attached and by refe ren ce made a par t hereof.
2. That for a particula r description of the lo ts bearing the
respectiv e asse ssment numbers set forth in sa id unpaid list and upon
which assessmen ts rema in un paid,_ severally and respe ctively, re fer-
en ce is hereby made to the assessment an d to the diagr am recorded in
the office of the Superi ntendent of Streets of said City after con-
firmation by s aid Cou ncil, the se ve ral lots represented by said
assessment numbers bei ng so numbered and designated up on said diagram
and assessment as so confirmed a nd recorded, seve rally and respec-
tivelj.
3. The unpaid list is in the amount of $41,288.00, a nd bo nds
shall be issued upon the secu rity of said unpaid assessments in s aid
a mount in accordance with the pr ovisio ns of Bond Pl an B, Sectio n
13.16. 110 of Chapter 13.16 of Title 13 of the Palo Alto Municipal C od e
and under and pursua nt to the provisi ons of s aid Res olution of Pre-
limin ary Determination an d of Intention and the proceedings the reund er
duly ha d and taken; that said bon ds shall be forty-tw o (42) in number,
shall be da te d July 15, 1968, and bear interest f rom thei r d ate at
the rate of not to exceed six per cent (6%) per an num, and the den omi-
na ;;ion of said bon ds with their respectiv e numbers and date of
matur ity are as sho wn on Exhibit " B" hereto attached and m ade a part
hereof by r efere nce.
4. That sa id bon ds shall be issue d in series, and the unpaid
asses sments as shown on said list filed w ith the City Treasure r of
sa id City a nd determined by -said Council, together'with the interest
thereon, eha ll r emain and con stitute a trust fund fo r the redemption
and payment of said bonds and of the in terest w hich may be due there-
o n, which unpaid assessments sha ll be taxabln in annual ser ies cor-
re spo ndin g in n umber to the numbe r of series of bonds issued, a nd an
an nua l propor tion of each assessment sha ll be payable in e ach year
preceding the date of the maturity for each of the severa l bonds
issued, an d such proportion of each a ssessme nt coming due in any
year , to gether w ith the annual intere st thereo n, shall in turn be
paya ble in installments as the gener al taxes of sa id City on real
property are payable, an d shall be come delinquent at the same time
and in the same propor tion ate a mou nts an d bear the same pr opo rtiona te
pena lties for delinqu enc y.

5. The bonds shall be e xecut ed on beh alf of the City a nd under
its offici al se al by the Clerk a nd Treas ure r of said City, and the
interest coupons attached thereto sh all be e xecuted by s aid Treasurer.
For such purpose the Tre asurer may use an engraved, printed or litho-
graphed fa csimile of his sig nature in lieu of signature by ha nd. The
sea l of the City may be affixed to the b onds by printed, lith ogr aphed
or other reproduction thereof; and such signing and sealing of said
bo nds by said office rs, and signing of said c oup ons by said Treasu rer,
shall constitute a nd be a suffi cie nt a nd bi nding exec ution of each and
ever y one of said bonds and coupons the reof respectively . Said b onds
shall be s ubstantially in the form set forth in s aid Bond Plan B.
Said Treasurer and Clerk of said City are hereby autho rized and
directed to sign said bo nds.
6. The interest coupons attached to each of said bonds and a
evide ncing the in tere st to accrue ther eo n shall be numb ered c onsecu-
tively and be substantially in the fo llowing form, to wit:
