HomeMy WebLinkAboutRESO 4133• ORIGIN AL RESOLUTION NO . 4133 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO DECLARING THE RESULTS OF THE SPECIAL ELECTION HELD IN THE CITY OF PALO ALTO ON JUNE 4, 1968, UPON THE PROPOSITION AMENDING THE CH ARTER OF THE CITY OF PALO ALTO WHEREAS, on the 25th day of M arch, 1968, th e Council of the City of Palo Alto, Co unty of Santa Clara, State of California, by Resolution No. 4107 did call a special election to be held in said City and to be consolidat ed with the State and Cou nty Primary Election on the 4th day of J une, 1968, for th e purpose of submitting to the qualified voters on its ow n initiativ e a proposition a mending the Charter of the City of P alo Alto re ading as follows: PROPOSITION 1 Shall the Cha rte r of the City of Palo Alto be amended by deleting ther efrom the a rchaic re fer ence to police judge; and further by removing as a charter office the office of assessor so as to empower the City Council by or din ance to transfer to appropriate o ffices of the Co unty of Santa Cla ra the functions of the assessment of city property for city taxe s, the equalization a nd co rrection of the a sses sme nt, the collec tion , payment and enfo rcement of the taxes, including delinquent ta xes, a nd the re demption of property from sale or o the r penalty for nonpayment of city taxes, a nd r ela te d functio ns; and to make the lie n date for proper ty tax asse ssment c onform to gener al. law? and; W HEREAS, due and le gal notice of sa id specia l elec tion wa s given as required by law and by said Reso lution; and WHEREAS, on the 4th day of Ju ne, 1968, at the ho ur of 7:00 a.m. the polls were duly and regularly ope ned for sa id special election in sid City an d sa id po lls wer e con tinuou sly kept o pen for said purpose fro m the time they were so o pened until 8:00 p.m. of said day a nd during said ho urs a spe cial electio n was held in said City of Palo Alto on sa id measur e 1 • • and in ac cordance with said resol ution; and WHEREAS, immediately thereafte r said special election was regularly and duly canvassed by th e Registra r of Voters pursuant to autho rity given him by the Board of Supervisors of the Cou nty of Santa Cla ra by and as provided in said R esoluti on and the results of said special election duly d eclared as foll ows, to wit: That a majority of the qualified v oters voting on said propo sition voted in favor thereof . NOW, THEREFORE, the Council of the City of P alo Alt o does RESOLVE as follows: SECTION 1. Tha t a s pecial election was duly and r egularly called and held in all things according to Resolution No . 4107 of said City of Palo Alto duly ado pted for th e objects and purposes ther ein specified and according to the laws of the St ate of Californ ia. SECTION 2. That a ma jor ity of the qualified electors voting in said special election ha ving cast the ir ballots in favor of said pro position a me nding the charter of the City of Palo Alto, said ame ndme nts have become thereby duly r atified amendments to the charter of the City of Palo Alto in the manner pr ovided in said Resolutio n No . 4107. SECTION 3. Tha t the City Attorney is hereby dir ected to pr epare a concu rrent resolution setting for th sa id a mendments so ratified to be c ertifie d by the Mayor and the City Cle rk for intro ductio n and passage as a co ncurrent r esolution by the Legislatur e of the Sta te of Ca lifornia confirming said a mendments.
